It is a 90 day buffer zone, where the foreign bride begins her adaptation period to the USA and her new man. There are TOO MANY cases seen on this board, where the relationship implodes prior to the 90 day marriage deadline period. Sorry you don't see it that way, but if you were a man whose Filipina flipped out on him, stole money, went out with other guys, by day 55, and then you could send her back home by day 60, then maybe you would have a different perspective. Oh, and to quote a guy who did CR1 Visa, and had the latter happen to him, "Gee, I wish I had a 90 day K1 Trial Period. "

12/01/2010 - Received a letter from DOS dated 11/29/2010 stating that the petition will be forwared to USE AD within a week and that I will received the packets very soon from embassy.

01/18/2011 - Interview. APPROVED!!! No words can express how happy i am.

01/25/2011 - VISA in hand! YAY!!!

02/20/2011 - POE Chicago (O'hare)

May I suggest that you use the generic term "foreign fiance/e" instead of "Filipina" when referring to negative behavior on the part of the foreign national? This is out of respect to the many Filipinas like myself who are in genuine relationships and only wish to be with their loved ones, like most people on this site.

By the way, good luck on your own visa journey :-)

May I suggest that you use the generic term "foreign fiance/e" instead of "Filipina" when referring to negative behavior on the part of the foreign national? This is out of respect to the many Filipinas like myself who are in genuine relationships and only wish to be with their loved ones, like most people on this site.

He should have use "wife" instead of "Filipina". Anywho, goodluck to everyones visa journey. :star:

Being in the US as an illegal alien might be appealing to someone from a third world country, but living legally in any country in Europe would be better than being an illegal alien in the US.

I agree.... why would someone have issues going back to EuropE where you'd be better... money there is great know that much been to london in 1998 quality of life was as good.

quality of life is not guaranteed even in Europe. That is a HUGE misconception. If that was the case then there wouldn't be people homeless and destitute. I saw a good number of people who were destitute in England. You would have had to be blind to miss them in London.

The 90 day rule is NOT a trial period and anyone using it as such probably shouldn't have applied for a K1 in the first place.

OP - the fact is, you have no basis for adjustment of status. I wish you good luck in the future

NO i wasnt Blind.. but i was 14 years old when i visited LONDON (south hall) but the same is here in the USA not a misconeption about the great America.. take a walk thru ANY city just go at random but we know that's anywhere though list isnt guranteed in america - the bed of roses .

quality of life isn't guaranteed anywhere not in USA, Europe, or anywhere else. However I'd imagine quality of life is similar between USA and much of the European Union. I'm sure there's places that its worse, but there's places that its worse here too.

Here's my bullet list: :whistle:

  • The OP cannot stay in the US legally. Either marriage to the petitioner or a successful asylum claim are the only two options available. The K1 entry doesn't allow for any other route to immigrate.
  • The 90 day period is not intended to be a "trial period". It's intended only to provide enough time for the petitioner and beneficiary to get married - nothing more. That said, there are lots of people who discover that the relationship just isn't going to work within this 90 day period. Consider this a 'side benefit' of having 90 days to get married, and not specifically an intended use of this period of time. Be damned sure that both parties want to marry before you send the petition.
  • USCIS will not help the OP return to their home country unless they are deported. If they leave voluntarily then they must arrange their own transportation. They may be able to get help from the embassy of their home country in the US.
  • There is no cap on how many K1's a beneficiary can apply for. Plenty of people have been approved for a K1, but something came up and they couldn't move to the US before the visa expired. They subsequently applied and were approved for a second K1. It doesn't raise any suspicions if it's the same petitioner. If a subsequent K1 is filed by a different petitioner then it substantially raises the level of suspicion that the beneficiary's primary goal is immigration rather than a genuine relationship.

Precious80, you asked for "good advice". My advice is to go home and start putting your life back together. As difficult as you think it will be to return home, it will be far more difficult to remain in the US. You have no path to legal immigration without marrying your fiance. Being in the US as an illegal alien might be appealing to someone from a third world country, but living legally in any country in Europe would be better than being an illegal alien in the US.

Particularly the bolded part. Precious80, you don't want to stay in the US ilegally. Believe me. I know plenty of people who live and work in the US ilegally and their lives is no "American Dream." As hard as it may seem right now, you would be much better of in your country than in a bad marriage in the US or living ilegally in the US. I am sorry to know things did not work out. Best wishes.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Me and my husband, yes husband made it...it took a while since I was pregnant at the time. I got knocked up a few weeks after I arrived in the US. I guess that but a strain on the relationship, plus the hormones I guess. But now we are happy with our little bundle of joy and we are doing great, I thank God.

Filipina is gender specific, means a woman... not offensive at all. Filipino is more male, or generic more or less and for sure proper. Calling a person Philippine is offensive..
