You would report her income in Canada as foreign income, and you would not need to pay any taxes on it if it's less than $93,000 as stated here:http://www.irs.gov/businesses/small/international/article/0,,id=97130,00.html

I want to include my spouse and file married as filing jointly to take the $3K deduction but do we need to add our spouses income? I wonder how that works cause she will be paying income tax in Canada so she has to pay here as well? That would be bad if its true. I learned that form W7 is needed since she doesn't have a social security number. Although yes it is true we don't need to show 2010 papers in AOS if we send it before April 15 but I still want to send a copy of 2010 with my AOS. Anyone know anything about showing or not showing spouses income?

Why not? I doubt they can put A and B together between TSC and CSC. Maybe they know they f#cked up and do the right thing this time? I don't want to get approved at TSC then wait 3 months for them to transfer it to NVC. I'm now in like the 95% percentile in terms of time since NOA1. Our cases are really exceptional at this point, they should realize that and do something about it.

Our cases are really exceptional at this point, they should realize that and do something about it.

I'm really hoping they have sorted themselves out at TSC with the NVC transfers, although there is no real evidence of that yet. I'm looking closely at rpratts and skynauts approvals. I think they were the latest of the current batch to be approved. I see U&S finally got a case number, but nothing yet for poor DanTes and EGSUZI. It's like chinese water torture!

The whole idea of filing jointly was to take the 3K deduction. How can I take the 3K deduction if we file separately? I don't think thats possible is it? I still don't get why a person has to pay income tax twice. So I am still at lost at what I can do cause showing her income on my taxes would just make me pay more cause of her income. I know all about the ITIN and waiting 8-10 weeks for a refund thats not a problem. If my wife wasn't working than I could have taken the deduction easily. Than maybe I shouldn't even write her on my tax papers. Cause I read that there is no law saying you have to show your spouse on your tax papers.

to file married/Joint you will need the ITIN, the just list her income as foreign income made by her, she wont have to pay tax on it as she is not responsible for tax in US but will need to file in Canada. this can be sticky and can get you audited so be careful what you deduct, do not take a iffy deduction and be prepared to show that she filed same amount exactly with the Canadian tax service.

Unless there is some tax treaty between Canada and the US that I'm not aware of, this is not true. Everybody filing in the US is responsible to report and pay tax on their foreign income earned above the exclusion cap. I already posted a link to the rules on the IRS website.

NEGATIVE....

According to the dude (man) at the IRS office yesterday.... you do NOT have to claim your [out of country] spouses income on your return if you are filing jointly (with ITIN). The reason being.... they didn't pay any money(ies) to the US Government (IRS). The exact example that I gave him was....

"My wife is in Brazil, we are currently going through the immigration process. She has not lived here or earned any money here (in the US). Can we file "Married/Jointly"? He said .... YES....

Next question... Do I need to include my wife's (foreign) income on our tax return? He said.... NO, she did not pay taxes to the US Government... so, NO... you do not include her income.

Makes sense to me.... but.... if you have different info... please let me know before I go through this lengthy pain in the butt process of ITIN...

If you do 'married filing jointly', this means you are married and you want to send a joint tax return, meaning that yes, you would have to put your spouse's income since you're filing together. And yes, your spouse would still have to do their tax returns in Canada. You're right, W7 is needed, it's to file for an ITIN, which can be used in replacement of an SSN since your spouse doesn't have one. Remember though, filing for an ITIN during tax season means you won't get your refund for 8-10 weeks.

You could also consider doing 'married filing separately'. You won't need to report your spouse's income and you won't need to file for an ITIN, you just write 'NR' or 'NRA' in the SSN field.

3/17/11- received by Bogota, emailed consulate and was told to send DS-230 and DS-2100 (packet 3)

3/18/11- packet 3 emailed to Bogota consulate, email confirmation on March 23

3/31/11- Interview date! Approved!!!!!!
