Wow everyone I know it is tough. It took 25 months from filing to receipt of visa for us. Try to distract yourselves with hobbies or activities. Stay in touch with your loved one but try to be positive and not always moan about how long the process it taking. Make plans but keep them generic as no one knows what the future may hold.

We all know the immigration process is broken, we all are/were in the same boat. I think the ideas of how to fix the process is much better than moaning about how broken it is. Maybe we can't fix it for ourselves but think of all the people to come after us.

Please try to stay positive everyone. (F)(L)

Why did it take you so long? Looks like your I-129F was approved quite fast.

I AGREE 100%. We WILL eventually get through this, but we should NEVER forget the problems we have faced, or are facing now, and should continue helping others navigate through the troubled waters of immigration. From what I have seen though, when individual families are finished with the process, and are finally reunited, they tend to "move on" with their lives. All 50 States, and most Countries are represented here by individuals from different religious beliefs, cultures, values, and social-economic backgrounds, with ONE common goal - to be together as a family!! I, for one, will never forget, and will do whatever I can to keep the broken immigration system in the spotlight. U.S. Citizens who are being forced to take a back seat to illegals and scammers should make OUR voices heard throughout the United States, and demand we be given respect and priority.

Personally. I would be concerned to go after a government agency with a lawsuit in a situation like this. For most, I believe the cases are maybe 1-2 months past the desired 5-month processing time. Is that enough elapsed time to file a suit...? ...I'm not sure but doesn't seem like it would be,,,especially since there's no uscis guarantee for any case to be completed within the 5-month target.

I would be afraid that if my name were on such a class action suit, they would just get peeved and somehow misplace my file! It could also potentially result in even further delays if suddenly they (uscis) had to engage in legal proceedings for all the cases listed on the suit. The link you have referenced also mentioned that even if you win your case,,,the anticipated time for them to complete processing & obtain approvals is 180 days! Man! What if legally the uscis could then re-start the clock over again with the dreaded 180 day time frame! Augh!

I don't know,,,, maybe it would have merit,,, but I'm a big chicken! bak bak! :D

USCIS Journey (223 days):

03/31/10: Married mi hermosa angelito!

07/14/10: Notice Date (NOA1)

02/23/11: Approval!!/Post Decision Activity

03/01/11: Received hard-copy NOA2 for cases. Has been forwarded to the Dept. of State NVC!

03/09/11: Case(s) at NVC!

NVC Process (78 days)

03/10/11: Case #'s assigned! Woot!

03/31/11: 1 year wedding anniversary!

04/20/11: Attorney submitting IV application to NVC

04/21/11: DS-260 receipt confirmation e-mail received

05/25/11: Received "checklist" e-mail (asking for AOS docs...but already submitted)

I'm not a lawyer, I'm just a guy who likes cats. But in my opinion is not so much about the 2 months delay (thats a conservative estimate for my petition). It is about their decision to transfer their oldest cases (June/July/August or JJA) on hand to a new service center that didn't have any experience processing I-130s and was evidently understaffed and/or ill-equipped to handle the work load. No chance that those cases would be touched for at least 3 months, and they should have known that. What should have been done is to forward all NEW cases to TSC, or transfer the 35000 newest cases instead of the 35000 oldest cases. That way, all cases would probably still be completed within 5 months. They way they chose, they guaranteed that all JJA cases would be done in 6-8 months while other cases would be done in 2-5 months. Seems to me that goes against their mandate to process cases in the order that they are received. Certainly what they did was unjust, but I don't know that it constitutes a lawsuit. I know that civil cases follow a different set of rules than criminal cases. I'm certainly willing to look into it though.
