Hi everybody.

I know the effective rule from Feb 1st. But my I-130 and I-129F got approved together in 23rd September 2010. NVC did not recive my I-130 approval yet but they already forwarded the I-129F petition to the Embassy on September 29th, and I received the NVC case # for my I-129F today.

What should I do now?

- Should I wait for the embassy to contact my wife and continue with I-129F and forget the I-130?

- Should I try to contact Embassy and asked them to stop the process of K-3 visa?

- Should I wait for my NVC# for the I-130 and continue both in parallel?

Thanks for your help.

Depends on what your priorities are.

If you want your spouse to come here ASAP, even if s/he can't work, continue with the K-3.

If working is important for your spouse, pursue the I-130.

Anyway, there is no need to cancel the K-3. If the I-130 is processed before the K-3 visa interview, you can tell the consulate that you prefer just going with the I-130.

Just a few reasons why to go with the CR-1. If you are eligible for a IR-1 then you would be nuts going with a K3!

The K3 has to adjust status which cost $1010 + $131 visas application fee.

Have to go thru the cost and hassles of getting a I-693 also.

K3 normally has to do biometrics and have a AOS interview. Time off from work cost the petitioner. PLUS the hassles of submitting the paperwork and going for the interview. Tain’t fun.. Especially if denied or questioned. Ever done a Stokes interview?

That’s the second interview if they are in doubt of your relationship.

Also a possibility of being deported. Yeah doesn’t happen much but it happens.

K3 has to wait about 90 days after they file to get EAD or GC so they can get SSN and be able to work.

CR-1 can work as soon as they get the GC and SS card in the mail. Normally with 6 weeks.

Can’t do a LOT of things without SSN. Like work or get a drivers license in some states.

Some K visas don’t get GC for a LONG time.

If petitioner goes belly up before you get GC you stand a chance of being deported.

If the petitioner loses his/her job after the interview you don’t have to worry about getting a co sponsor to adjust status!

CR-1 cost about $470

Get their GC and SS card in the mail within 6 weeks of arrival.

No biometrics , dealing with civil surgeons, AOS interviews, going to SSA for SS card.

I’m sure I’ve missed a few things.

Bottomline is anyone that goes with the K3 the way things are now are masochist!

Yeah I did but at that time K3s were a LOT faster. That’s not the case anymore.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

I would go with the CR-1/IR-1 because......if you come with the K-3 he has to file for adjustment of status which opens you up to delays in receiving the green card. My hubby came on the K-1 and after 17 months of AP you would think his greencard would be in the bag but Noooooooooooo....it took another nine months of waiting for him to get it, I assume to them doing more background checks (like what did they have left to check, his shoe size?).

Hi Mehdi,

So, what happened with your case. I'm in the same situation. Did they close your I-129f?

Yes, I understand that she sticked with the I-130. My issue is that mine were both approved on the same day. And a few days ago NVC assigned a case number to my I-130 and is waiting on my fee payment now. However, my lawyer is telling me not to pay the fee and wait to get the I-129f forwarded to the embassy instead. He says that I-129f will be faster. I'm getting a little worried because I don't want to wait a month only to find out that my I-129f has been administratively closed by NVC. In that time period I would have needlessly kept my 130 in limbo. So, far NVC hasn't received my approved I-129f.

UPDATE

My lawyer told me that he spoke with NVC and my I-129f was administratively closed. I have paid my fees online for I-130.

Going through NVC, a lawyer will certainly slow down your case. Unless you have a need for a lawyer, this is a DIY site which can offer you support and guidance. Our lawyer said no one gets through NVC is less than 60 days. We got rid of our lawyer just before NVC and were through NVC in 25 days.

Good luck

A recent post in this thread from 2010 was split into its own topic, moved to the CR-1 Process forum, and given this thread title: "Stepdaughter Included on I-129F but not I-130; Problem? [split topic]"

This old thread is now closed to further comment.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
