looking for help before i apply for wife and stepson

my wife and stepson came here on a tourist visa, with no intent to get married. i met her and thing went their way. received my citizenship and we got married, long story short i want to get her paperwork done. her visa is still good but she over stayed her i-94. i looked at the guides and i have almost everything ready. queations is....

do i send out two full i-130 and i-485 for both?

does my three yr old stepson need a physical also? sounds wierd but you never know

or can i just include him on his moms paperwork..

TIMELINE

10/21/10 - sent i-130 (2) and i-485 (2) for wife and stepson

10/28/10 - received SMS and E-mail Recepts for applications

11/04/10 - Received paper receipts

11/08/10 - Fingerprint letter

11/17/10 - fingerprint appointment for both stepson and wife

Are you sure about that? Without underlying I-130 petition, the child (stepson) won't be able to adjust - it's not one of the K visas, it's an AOS from tourist visa.

I say I-130, I-485 each for mom and the child - mom can even go for the EAD, not sure about AP as we don't know how long the overstay was.

I'm not sure what to do. I went to one lawyer and he said for both. But he also wanted 3,000 to do the paperwork. Then I asked a immigration lawyer on justanswer.com and she said just the mom. I was thinking of doing just mom and if nothing send in another application for him. But I'm a bit lost with this one

I just re-read the I-130 instructions and it states that each relative needs their own I-130, and then on the I-485 instructions, it got very confusing with legal custody and blah blah blah, so not sure about that.

Someone will probably come along here that really knows for sure, but for the end-all, you can make INFOPASS appointment at your local USCIS office and ask them. They will help you with forms and get you on the right track. Good luck!

noooooo, no riding piggyback on an I-130 or I-485..... each requires a separate petition/application.
