K1 visa disaster, need help!

Hi,

I married my wife under a K1 visa. Unfortunately things did not go as planned because I found out she had been cheating on me the whole time and all she was after was the visa. After 4 months of trying to "make it work" I realized she had not stopped contacting the man she cheated on me with. So to make story short I kicked her out of the apartment and she went to live with her family. As of now she's not in the states, she left to visit that guy in Europe. My question is, what are the chances of me getting her conditional green card taken away?

I have compiled as much proof as possible of her cheating ways and also the fact that she's not in the states at the moment. I have an appointment this coming Thursday at the inmigration service center here in Texas, please let me know all you can to help me.

To clarify, she already has her conditional greencard? Do you have proof that she is visiting another man? I suggest you take any actual proof you have with you to your appointment.

Yes, to clarify has she gotten her greencard yet??I think so right otherwise she wouldnt have being able to visit anyone outside USA..I am cuban too I dont really thing you can do anything about it..but since you have the appt with immigration they might be able to give you options..maybe you can just divorce get and start from scratch and forget about her completely..

oh and one more thing my friend even if you can prove it was scam and she gets a deportation order she can still remain in the country...remember the laws for cubans are way different..i hope eveything works out for the best..

I understand how the laws work with inmigration and Cubans; however, most Cubans tend to think that such law makes them inmune to the rest of inmigration laws here in the states, when in fact all you get is certain priviliges when applying for status. I've done a bit of research and what I'm coming to is that she might be able to stay in the states but since she'll be accused of inmigration fraud, then she'll lose her right to citizenship and maybe even to hold employment. Also will have to deal with an eternal deportation warrant following her everywhere. I don't want to sound like a hateful person bent on vengeance but honestly if she gets that much, then I'll be a happy camper.

sorry to hear about that. That is the chance that many of us take. Some are so sure their fiancee are the real deal and they will never do that to them. I started the K-1 procedure but I am still on the lock out :blink: just in case.

  • 02.22.2011 - Packet reached ABU DHABI's consulate
  • 03.02.2011 - packet 3 & 4 received by email
  • 03.02.2011 - Confirmation of Interview on 04.14.2011 -
  • 03.07.2011 - Fiancee passed medical exam.
  • 04.14.2011 - K1-Visa Approved!!!!!!!!!!!!!!!!!!!
  • 04.21.2011 - Picked up Visa !!!!!!!!!!!!!!!!!!!

I am not trying to make u the bad guy I will hate for that to happened to me..I dont know exactly how everything worked for you and how you guys met and circumstances.I was reading what you have research you could be right..Now I can tell you from personal experiences and friends of mine most cubans dont care about becoming a citizen specially if her purpose was coming here based on false pretenses..Second yes she can stay on the states, and yes they can issue her a warrant for deportation..Cuban deportation doesnt work the same way as other countries I know people that have worst offenses and all they have to do is report once a couple of months and that is they have a normal job and everything. I am just saying yes you are angry which I understand but you are going through way to much and you are really not going to make a difference at all..Sorry I dont want to make you feel bad you are just having bad and bad moments trying to make her pay and it wont affect it her at all..she will go on with her life. Hope everything works out keep us post it..

Conditional green card means just that conditional. The USCIS is waiting to see if you have a real marriage. If you divorce during the conditional period than I think her green card will be revoked. Maybe you should begin divorce proceedings as soon as possible. Be careful when you speak to USCIS. I tried to report my ex-wife in a similar way bit USCIS, suspected me as trying to take advantage of my ex-wife. It is very difficult to revoke a woman's green card but if you begin divorce proceedings before you meet with the immigration officer and show them your divorce action and the evidence you have for your cheating spouse, then I think USCIS will believe you after they are finished scrutinizing your claims.

I hate cheaters and frauds. Good luck to you and your situation.

Cuban Adjustment Act. Once a Cuban is admitted or paroled into the US for any reason, they are eligible to adjust status.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

Look up the Cuban Adjustment Act and the "wet foot, dry foot" policy. If she's already been here, she's not likely to be sent back as the other poster stated. As in 99.999% not likely.

To the OP - Sorry this happened but your best bet is to divorce her and move on...

And, yes, I hate frauds, too. They're the reason the rest of us are now seen as "guilty until proven innocent."

It's not possible for 'you to get her deported', ie - you have no 'direct-linkage' to do that.

BUT.

If you have EVIDENCE of VISA FRAUD (IE, marriage solely for immigration status) (emphasis on EVIDENCE)

then

you can build a 'casefile', and submit the casefile, with a cover letter,

INTO the local Fraud Prevention Unit at the local USCIS office, along with submitting a copy of the entire 'thing'

into

ICE

US Embassy/Fraud Prevention Unit (is special names for this in Cuba, btw)

and then if your evidence is substantial, ICE and others will take action. It's up to you, really, and whether or not you have the pile of evidence or not.

Yes, like i said once she is here she will be able to stay because once she touches american soil she falls under the cuban act of the dry foot and you can build a case for fraud and the only thing they are going to do is summit a warrant for her to be deported which wont affect her at all because cuba doesnt accept deportations...I am truly sorry I can imagine cause the process is so hard and for her to do its terrible. Like I said my advice is let it go cause all you are doing is putting yourself through immigration processes and bad moments and apparently she doesnt care. Good luck..

First of all, I am sorry to hear that things did not work out between the two of you. I was thinking about what you shared, that she is going to Europe to visit. How do you know she would even have an intent to come back to the US? Maybe, for her it would be better/more enticing to live in Europe (specially if she is really into this "guy" and there is a possibility of just staying there). I kind of tend to agree with the other members in that I do think it is terrible that this happened to you, but I do not know if it would be the best use of your time, energy, and money trying to make things difficult for her in the US. She might not even return from Europe for all you know! Again, sorry to know that this happened and best wishes to you as you attempt to move on.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

It is not your business to take away her green card. Report to the USCIS that you are getting divorced. That is all you can do. She will probably not be able to get conditions lifted, but she may be able to do that also since you divorce her. USCIS does not worry about if someone cheats on you, they couldn't possibly care less.

Her whereabouts are none of your concern if you get divorced. Say goodbye and forget it.
