Hello everyone,

I have been reading about the K1 and AOS processes and I wondered about "real" times for AOS once married to the K1 holder. I was reading that when one sends in the application to register permanent residence (I-485)one can concurrently file for employment authorization (I-765) and advance parole. So, I wondered how long it was really taking to get employment authorization? Would the 3 applications be approved at the same time or, hopefully, the employment authorization is really approved first and much more quickly? Or is it really taking 3 months?

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

We filed in May...EAD & AP were approved in about 2 1/2 months and received almost 3 months after initial filing. We're still waiting for GC approval.

12/2009 - Interview (2nd time) APPROVED! VISA ISSUED

02/2010 - Arrived USA

4/26/2010-Received texts and emails 7th day

4/30/2010-Received NOA's(Hardcopies) 11th day

5/3/2010-Received ASC appointment notice(mailed 4/29/2010)14th day

5/7/2010-Walk-in Biometrics done(2 weeks earlier)18th day

5/13/2010-Case transferred to CSC

6/2/2010- Case received/resumed at CSC

6/28/2010- EAD production and touch on AP

I would check the time lines at the USCIS web site to see what is the current processing times for your center. Generally the EAD, AP and GC can be accomplished pretty close to the same time with the GC taking just a little longer.

In our case, my wife got EAD and AP about three weeks before the GC interview. They confiscated her EAD at the GC interview. So, consider saving money and just get the GC.

It doesn't cost anything additional to file for EAD and AP concurrently with AOS, so how would this save money?

You'll want to be sure to read the fee information from USCIS's site.

Special Instructions :

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

Sorry for the misinformation. When we did it there were separate fees for each form. I couldn't imagine the USCIS giving up fees when it was already set for separate fees per service. Wow!

I got my green card in 2 months and 8 days after it was approved it arrived in the mail box. Never applied for EAD or AP.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

It would be silly for them to be approved at the same time because then the AP and EAD would be of now use because the green card would override them and take their place.

I just got my EAD approval e-mail and it has been 2 months since we filed. Also note that we had an RFE that stopped the processing on the case for 1 and a half months almost. But, each case is different. :) Good Luck.
