Hello all,

Going CRAZY over here, so maybe posting too much, sorry!! I got an incredible job offer through a reference from a friend this past weekend. Seriously, best of my career and it is KILLING me that I may not be able to take it. I filed AOS and I-765 etc on July 1st (accepted on the 5th) and did biometrics on July 28th, but not a single touch or status update on my file since, or ever. The job starts Sept 13th-- which would be... 70 (?) days after filing, so I am so afraid I will not have an EAD by then. My husband and I are BROKE. He lost his good job last spring and had to take a job at less than half the pay that leaves us at a large deficit each month. When I was in TN status (which I overstayed, and now cannot work) i used to supply more than half of our income.

I am not trying to be a jerk about jumping to the front of the line, but I feel like it would be TRAGIC to turn down the job, and then likely receive my EAD two weeks later. This job could give us the fresh start we need, and they do not come along often in my field. It could be months and months before I find another.

So... I first called USCIS and opened an expedite file for the EAD, claiming financial loss. Not likely to work without proof, I figure.

Then, i spent hours compiling a 24 page document of all our bills, lease, medical expenses etc and his pay stubs, showing we come nowhere near making it each month. And, I added in the job offer email. I faxed it to our local congressperson yesterday, and got a call to come in and sign a form today. I was only able to speak to the receptionist, but I wonder if they are going to forward my petition to USCIS.

(btw, also sent it to the senator, but was told they do not deal at all in these matters-- had read on here that they sometimes do)

I feel like I need to know one way or the other if there is any hope. I cannot let down my reference, so I need to decline the job with plenty of notice. Uggh. Any opinions?

I think everybody would like their EAD expedited.

You can only try, it seems that it does occasionally happen.

Yes, I think they were successful, which gave me hope.

i did expedite my EAD i call USCIS and got an e-mail saying that the case was under review and a decision was going to be made in a week after 10 days my EAD was approved and in 2 weeks i got the card on the mail.

In the end my congress office would not send my petition. :( I did get my interview notice today though-- for a week after the job would have started. A bit frustrating!

There are more congressmen and senators you can send it to. You will at least have one more senator, and depending on the state you can have 50 more congressmen. The only difficulty with the congressmen is that they will probably want you in their district. But you can always use you in-laws address, or friend's addresses when petitioning. In my case they didn't check my name and address with USCIS, they just needed my A# and receipt number.

Try it again, you have a complete package done.

Thanks Robert. I tried the senate and they said they do not deal on a federal level. My congress person was actually willing to send in my package (I shouldn't have made her out badly!), but when she contacted the USCIS they said they needed an official offer letter, on letterhead, with a date saying when I had to accept the job by. The job I was offered was full-time freelance, through an agency, which is the case for almost all jobs in my field these days. Agencies (that I have dealt with) do not do offer letters. I did have an offer email and my acceptance email printed out, but USCIS said it had to be on letterhead. I was unable to get that, so my congress person would not send the package in the end. It has been my experience that many companies scare at "letters for immigration.. etc."

Congrats on your speedy EAD though! My interview is only 8 days after the job would have started. A little frustrating, but oh well.
