@belinda: The first two links show that Arpaio is a racist dirtbag, which most people already knew. He's been doing his own version of immigration enforcement for at least two years before the AZ law, so you can't really use him as an example of the law being applied poorly. It's an example of his consistent racism and abuse of power.

The last link had nothing to do with the new AZ law, as it hasn't even come into play yet -- there was probably a CBP checkpoint involved, and they may have thought something was hinky.

The Feds can do what they want, no need for reasonable suspicion.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Well thank goodness not speaking English well is not a sole indicator of being illegal as my mother has lived here for almost 50 years and still has a heavy accent. I think the entire law is excessive and will cause a lot of problems for persons who are here legally.

I agree completely with you. We wanted to take a family vacation to Arizona late fall but have changed our minds because we don't want to be hassled. I am a U.S. born citizen and speak English fluently without an accent, but the scarf and abaya that I wear will be like a giant bulls eye to harass our family.

I would be stunned if the percentage of illegal aliens from Islamic countries in Arizona tops 1% of the total. I don't see any reason that dressing like a conservative Muslima would attract any additional attention from law enforcement in Arizona. If you get hassled for your hijab and abaya it's much more likely that it will be by a typical Arizona redneck, and not an Arizona cop. However, if the thought of having to deal with a few loudmouth rednecks bothers you then you are probably right to cancel your holiday in Arizona. Come to the west coast instead. Nobody will give your attire a second look. It's a common sight here.

any form of ID is acceptable. driver's license, ID card, passport, etc.

the police can only ask for it if they pull you over for doing something already. ie speeding, drunk driving, etc.

if they suspect you are illegal after they pull you over, then you must prove your citizen or status.

japan is like arizona. if you are foreign and are caught without your foriegner card they will jail you and it costs $2,000 to bail you out. so you always gotta have your ID with you!!

New Mexico does not require proof of legal status to get a driver's license, but this is partially in deference to the very large native American population there. I think Maryland now requires proof of legal status for a new license, but still renews licenses issued before their new law went into effect last year. Utah issues "driving privilege" cards to undocumented people, but they supposedly can't be used for ID at an airport.

Just a few remarks,

you now need some sort of federally issued paperwork as proof of being a native american in NM if you do not have a birth cert.

Utah cancelled the driver privilege cards back in January, now you need a birth cert, passport, valid visas or green card. The only thing driving privilege cards were good for was driving and to get insurance, technically you could fly with them too because you do not really require an ID to board a plane, if you are willing to subject yourself to a pat down.

Thanks. The law changes fast, and Google sometimes doesn't keep up!

Imagine the media frenzy when they put a Native American in detention and make them prove status!

And how do you prove it if you get stopped by the feds? With your drivers license? Don't some illegal people have a drivers license? If you can't get your proof soon enough will they then be able to detain you in detention?

Illegal IDs are JUST for show.. the Dl#s are not entered into the "real system" so when they run the DL and no info comes backon it then i suppose they go in persuit... Good!

I guess they csan tell by the Dl if you're USC or LPR since you have to show certin dcks to get the DL. The systems maybe migrated.... ya know.. govt offices working together.
