Hello VJ,

I was just wondering if anyone has ever re-applied for the k1 visa petition? My fiancee was denied yesterday and instead of us just waiting and procrastinating we just decided to re file so what do we need and what should we do? All advice will be very appreciated.

Depends on what the denial is for. Was something missing in the orginal application?

They denied my fiancee and I because I didnt meet his parents and he didnt meet mine. The CO was also against the fact that I didnt seen him in Nigeria. We met in Dubai in April. I dont feel like waiting for a rebutal.

When our fiance visa was sent back to USCIS, I went to Morocco and married 3wks later without waiting to find out what reason that they sent our petition back for because I knew it was bogus. It only took us a total of 4mos before he was granted his visa to come home to me after filing CR1. You may want to consider marriage. It's just a thought but you know your situation better then anybody else. Whatever you decide to do, I wish you nothing but blessings the next time around. Hang in there.

Refiling the denied petition or filing a petition for a different visa won't matter unless you address the reasons for the first denial. The petitions do not exist in a vacuum. The issues from the first petition will be considered along with the evidence in a second petition.

If meeting your fiancee's family was cited in the denial go and meet them and have plenty of photos to demonstrate that you've met.

:thumbs: I did send in a rebuttle letter of what I felt was wrong with the US Consulate decision, and additional proof such as bank statements showing that i paid my own way to morocco, and withdrew money out of the bank account when i was there visiting. I also showed how i purchased my own tickets through my bank statement.

I agree with everyone else. You need to address the first denial. Second application will only end up most likely being the same. They are going to see that you had already applied and then look at the denial. Make another trip over if you can, meet everyone, take lots of pictures. Its an expensive venture no doubt but I think it will help big time in the long run. I wish you both all the best.

What the Nigerian embassy deals with is a vast sea of people applying for any type of visa that will get them out of a rather broken country, just like immigrants from a lot of other countries. The fact they are prone to deny legitimate relationships is a terrible sign of their over zealous nature.

This will not be over quickly. You will not enjoy this.

Agreed. It is a really messed up place over there. And now comes along Mr.Nigerian Underwear Bomber, who doesn't help visa applicants get approved any faster, either. The Consulate has to be tough! Can you blame them?
