Filed i485 dec7. my i94 expires dec15. the i485 gets rejected due to insufficient fees. am i out of status?

I have the receipts here with a total of $1080.

I don't think i'm out of status since i filed the i485, and is no longer under the category of non-immigrant, but i'm not sure.

Do i have to leave the country? or do i just resubmit

Haven't received the notice yet but i just spoke to this guy from uscis to figure out why i haven't heard from them yet. thats when he told me it was rejected.

I asked him the same question in my post, and he told me i'm out of status so i should return to my country. But i really doubt that's the case.

Can someone help me with this pliz?

you would have gotten a letter about payments, prior to actual denial.

Did you move? USCIS notices are NOT forwarded to new address, ever. There's a clear statement on the envelope that states that, as well.

if you came in on K-1 visa, thats the right fees.

If you came in on tourist visa, well, sorry, not enough forms, not enough payments on the other fees.

I am really sorry to hear that.

The notice that you will receive in the mail will let you know what to do. I would advice you to follow those instructions, even if they would ask you to leave and most probabably they will. Again, I am very sorry.

If you didn't adjust from K-1 or K-3, then you're missing the I-130 fee $355.

Did you move? USCIS notices are NOT forwarded to new address, ever. There's a clear statement on the envelope that states that, as well.

if you came in on K-1 visa, thats the right fees.

If you came in on tourist visa, well, sorry, not enough forms, not enough payments on the other fees.

i came on a b1/b2 visa. my wife filed the i130. got the receipt letter. i filed the i485. it was rejected due to insufficient fees. we sent money orders $1000x1

$10x1 $70x1. i have no idea why they say insufficient fees. maybe because my wife signed the money orders. my main concern though is, since my i94 expired and my i485 is rejected, am i considered an illegal?

do i need to leave the country? or i just stay and resubmit the forms?

instructions say ...Application to Register Permanent Residence or Adjust Status I-485 $1,010 ($930 plus a biometrics fee of $80). Exceptions for refugees, applicants over 80 and applicants under 14 are listed below under "Special Instructions".

why did you send 3 money orders , you can easily pay with personel check

I would resubmit the forms with a personel check in the amount of 1010

REJECTED is not the same as DENIED.

Rejected means that you must resubmit with the correct forms and/or payment. The didn't deny your application, they just didn't accept it due to some problem with the amount sent. Try sending a check for the full amount ($1080), instead of 3 separate money orders.

You may be out of status until they receive the AOS again, but it's not a big deal as liong as you don't get in trouble or have to deal with any authority that would need to check your immigration status.

Denied means that your applications has not been approved and you must leave the country with 30 days.

I am sure i sent in the correct fee. the only possible problem could be that my wife signed the money orders, and i was the applicant. USCIS sent off the notice December 12 2009. 2 days before my 194 expires. so it would be weird if they ask me to leave. I guess i just have to wait and follow their instructions. should get the mail tomorrow.

Am i still considered a non-immigrant?

if not i think i have sometime to redo everything

That is not true. We moved and even changed our address with USCIS but they still sent my husbands greencard to the old address and it was forwarded.

I'll try the check next time.

I couldn't get the money order greater than $1000 so i had to split it up. I also had to address the $70 to department of state

am curiouse as to why you send 1080 and not 1010

when I did AOS it was 1010 , ( unless the fees went up , but even on theyr website it says ,

That is not true. We moved and even changed our address with USCIS but they still sent my husbands greencard to the old address and it was forwarded.

The USPO is not suppose to forward these - but they do :)

To the OP - you sent the wrong amount (1080 instead of 1010) as Lona pointed out. That is why it was rejected. follow the advice/instructions and you will have no issues.

Do not worry about your "out of status" - as long as you get the NOA for the AOS, your protected, however, your "clock" is ticking for overstay right now, so re-file ASAP.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
