Working for one (without EAD), I've seen many people don't know the rules from what i've seen on this site.

Regarding the relationship, what if the OP's husband had been on a long business trip and didn't have things like a toothbrush or dirty clothes in the house? What if its the middle of the day and a male friend was over etc. Those type of things can cause the situation to go down hill fast.

In theory if you happen to have a pirated film playing on your computer when they entered that could be passed on etc.

What if you have a letter from an EX on the table.

Simply ICE would not care on bit about what you are stating here if there is still proof of a relationship.

And ICE could care less about what movie is playing and how you got it that is not a criminal act it is a civil act.

Not sure about your first comment....they are looking for anything that validates there suspicions.

Piracy is a federal issue...i'm mean sure they probably could care less but if they were to confiscate your laptop/pc then they can and have charged ppl later. (Though in most cases it was for child porn or similar)

Just to let everyone know. I filed a Cr1 about 8 years ago. Got divorce from this guy ( from India) because of Fraud on his part. Filed again in 2006 for my present husband (syrian) a k1 visa. Had no problems with them granting the visa...only took 6 months for him to get here. We filed our AOS last year, March 08. Interviewed Dec 08. Hadn't heard one thing from them as far as approval or denial, even went to Seattle USCIS office to inquire about it when I decided it had been too long. Didn't even let us know at the USCIS what was going on, just said to wait. WELL, this morning at 6 am I get 2 Immigration officers coming to my door with badges out. I was still half asleep and asked " Am I under Arrest"?? They asked to come in, looked around at the pictures on the wall, asked to see mail with both our names on it, looked in our dirty clothes hamper :wacko: and said "ok we have what we need" and left.

Just wanted all the people know that have similar situation...beware...they might come knocking at your door early in the morning... :blink:

Let me be clear and unmistakeable about ONE thing. NO ONE, not any law enforcement of ANY kind, no governemnt agent or even the freaking MAILMAN wil EVER come into or onto MY PROPERTY with out a warrant issued by a judge, for ANY reason. I am not foolish enough to voluntarily surrender MY rights. YOU can surrender YOUR rights if you want, though I consider such act unpatriotic and downright dumb.

I do not care if you think I am somehow guilty of something or you disagree. Had these men shown up on my porch I would have immediately told them to show me their warrant or get the HELL off my property!!!!!!! No further discussin and they will immediately comply with my order or they will be charged with trespassing by the local police.

In order to get a warrant they need to show to a judge "probable cause" to belive you have committed a crime. They do not have it and CANNOT get a warrant. They KNOW they cannot get a warrant. So they arrive at 6am when they KNOW most people are just waking up, are groggy and disoriented and they KNOW there is a MUCH BETTER chance of getting your PERMISSION to enter your home than getting a warrant. NEVER allow a law enforcement officer to search your home, vehicle or person without a warrant or subsequent to arrest. You do not need to be polite about it. Simply say "NO" They do not have to like it. On occasions I have been stopped by police for traffic violations and they ask to look in my trunk I say "NO! Now write me a ticket, or not, I do not care...finish your business and let me go on my way...OR arrest me and take me to jail....your choice..make it NOW" It may have caused me to get a few extra tickets (I have only had 3 in 35 years so I doubt it) but I DO NOT CARE! NEVER give up a right, NEVER

It's easy to be tough and reassert your rights in front of the computer in your living room. It's a whole other story when ICE agents come to your house.

btw... most people don't usually have letters from ex's laying on the kitchen table; it would be very suspicious to me if anybody had

I guess the "my rights" people would be willing to risk getting rejected for their residency just to make a point. Or maybe only hypothetically speaking, and in real life would welcome ICE with open arms, offering coffee and donuts.

Back in Canada, I worked on a security enhanced location. Civilian contractors (for various companies and not contracted to the government) entering the site had to agree to be searched without a warrant any time while there. The contractors always had the option of refusing the search, but they’d be denied entry to the site. In all my years working there, I’d say about 95% of those who refused searches also incurred a ban from the site. The thinking being that they must have something to hide, and since the Canadian military has the authority over access regulations, there was little that the contractor could do. So their right to refuse the search without a warrant was upheld but they still needed to look for a new place to work.

I know it’s a different situation, but I’d be a bit worried about how much authority the adjudicator of your case has. If they’re suspicious about the validity of your relationship already, would refusing the search only add to their suspicion? If they have enough leeway with their interpretation of the laws that they can deny your AOS based on little things about your file that they don’t like, you could potentially be causing yourself a lot of headaches by not letting them in.

Their "suspicion" is irrelevant, until a couple more Supreme Court decisions formally turn the Fourth Amendment into an inkblot. Till then, the claim and exercise of a Constitutional right cannot be converted into a crime.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I agree with you, my dad was driving with a friend from western germany to the netherlands in the 80's had got two jerks searching through his car at the border... The two border guards tried to plant drugs under his floor mate so my dad attacked them.... (jumped on them and started punching). After a few hours of talking with other guards and their bosses they let them go. If he would have just sat there and let them screw him he would have gotten years in prision. There are far too many corrupt morons out there (uscis takes the cake with their opened ended laws) to just let them walk all over you. If they get a chance they will screw you over. I am not saying all or even most are that way.... but NONE of us know who we are going to get at our interview/door/poe and if we are unlikely enough to get a jerk we need to defend against it. I was also held for 4 hours at Irish Immig because I didn't have 2000 euros on me!!!! So they forced me to go to the money exchange and withdraw 2000 euros and then searched my bags, clothes, school books, everything for anything they could find that could get me in trouble. At the very end of this long deal I got a reduced Irish visa and sent on my way. To make a long story short... I went to the national police and filled a formal complaint and got not only an extended visa but a formal applogy.

I would never expect defending my rights to be easy. I do not care if it is easy, I do not care if it jeapordizes my wife's green card. If I must submit to warrantless searches we can move back to our flat in Ukraine, fine with me. NO ONE uninvited will enter my home without a warrant. Period. EVER.

And I think it is terribly irresponsible and disrepectful to the hundreds of thousands of people that have been killed and maimed to defend our rights, that wasn't easy either, my father was badly burned in the Ardennes on Christmas Eve 1944 for my rights and carried those scars, those badges of honor, for the rest of his life and I will not sully his honor, not easily gained, by submitting to warrantless searches in my home for any reason. What kind of AMERICAN would invite his foreign wife (or husband) here and then surrender their rights? :wacko:

I am not referring to me entering other property. I understand the need for security and I understand my right to refuse being searched and being refused entry into some other secure property. It IS NOT the same thing. I think I have been clear. NO ONE without invitation will enter MY property without a warrant. Using your secenario, I would be subjecting the law enforcement officers to warrantless searches of their person and vehicle before they entered MY property...not vice versa.

I do not care if you believe me, I do not care if you think I am guilty of something, I do not care if you think it is "keyboard courage". I do not care if you like it. I stated my beliefs and I go with my beliefs. My wife came from the Soviet Union and I will not bring her here to be searched without a warrant. Period, no argument, no discussion. I PROMISE you she would not either and she values that right more than I do. Gee, I wonder why?
