OK, here is the sane advice that you have been waiting for. If you feel you would like the assurance of being able to obtain legal advice on specific immigration/visa questions or issues when they occur, the compromise move here is to get a Pre-Paid Legal plan.

I have one, and have well gotten my money's worth by the 5 times I have called to the atty. Besides immigration issues, the Pre-Paid Legal lets me sleep better at night knowing that I can call an atty 24/7 at no charge for any legal issue, other than the $26/month I pay for a family plan.

The Plan has come in handy on numerous occasions. In todays litigious society, it makes a lot of sense to me. Feels so good to be able to say, "Let me consult with my atty and I will get back to you."

Let me know what law firm you work for....I'd love to have a job there..we could all hold hands together and say....lalalalalalalalalala. In the mean time... guess why when a lawyer goes swimming on the beach, he doesn't get eaten by a shark ?!???????????????? PROFESSIONAL COURTESY !!!!!

Hiring a lawyer is a personal preference, and like many on this on this site, i would suggest that you shouldn't need a lawyer to complete the K1 package, it is rather simple.

However keep in mind the process is not always simple, since USCIS has lost our case twice now we have consulted and hired a lawyer to deal with the appeal process we are currently going though, it was that or be up said creek without said paddle.

This being said though, the lawyer we hired when to collage with my fiance (USC) and is giving us his assistance at a reduced rate, his firm however has deal with our situation previously and he is certain that he can get things moving.

After 11 months of being screwed around it seemed like a logical choice to us.

06-18-2006 Met online in WoW

04-25-2007 Admitted that we had feelings for each other started talking on skype everyday!

10-12-2007 Met in US in person for the first time, love at first sight lol, 2 perfect months together.

06-21-2008 Engaged

08-16-2008 Package finally put together and posted to Vermont! Let the real games begin.

Does anyone feel that it would be best to hire a lawyer? How has it been doing this on your own? I am not ready to get one yet. but i am trying to inform myself with what is the best thing to do. So i am just trying to ask questions and see what i can find out.

I did everything on my own, with the help of VJ members, of of course. :) When I proposed to my fiancee I did not even know of the existence of the K-1 visa, I had no clue HOW I was going to do this! That's how much a "newbie" I was! I went online, googled "foreign marriage" or some such and this site came up. I started reading and studying the guides and forums and discovered it really is not such a big deal.

In my opinion a person with a "normal" visa process absolutely does not need an attorney. If you can read and FOLLOW, instructions, study the process, you will have a better experience doing it on your own. I filed for and received a K-1 for my (now) wife, a K-2 at the time of her visa and a K-2 to follow just a few weeks ago...no problems, no questions asked and have doen the AOS also. No problems.

When you study the process, you will find there is actually very little an attorney can do anyway. All of the informationm and documents needed are of a persoanl nature, YOU have the information and documents, there is nothing the attorney can provide except to fill in forms with the information you give them.

Have you seen job applications for some of the big chain stores lately? WalMart? Lowe's? They are more complicated than the visa petitions! Would you consider an attorney to fill out a WalMart job application for you? How would they do it? YOU have to give the information to them, you may as well fill in the form yourself and save a couple thousand dollars.

READ, STUDY, FOLLOW INSTRUCTIONS and you will be fine.

As an aside I can say that I have been to the interview process and there are hundreds, even thousands of people every day, all over the world, applying for visas to the USA, I assure you, virtually NONE of them have attorneys.

Most of the people lined up in the consulate for interviews are there for student visas; work visas; J-1's or tourist visas.

The percentage of applicants there for family petitions is small in comparison to the rest.

I used a lawyer for the K-1 visa just in case and I am glad I did. For most people it truly is a waste of money but it turns out we needed one because we ran into problems getting a police report from St Maartin from when he lived there. So our lawyer took care of the paperwork and getting what we needed and letting us know what we had to do. If we didn't have a lawyer either he or I would have had to go to St Maartin to get things straightened out.

But most peoples cases run smoothly so if you don't for see and problems then you can do it yourself. Since we already came across all possible problems during the K-1 process we are doing the AOS ourselves. We just sent the paperwork off last week :).

me and my fiance hired an immigration specialist that we found online, contacted some of his former clients and i found out he was legit so we hired him but it is a whooping $1000; it was not until like a week or so after we hired him that i learned of visajourney, we could've saved money but oh well, things happen for a reason

but i do think the posts here are right, you can file it on your own and if you have a lot of queries, then post them on forums or IM the experts :)

My husband hired a lawyer and asked him for $5000 :angry: and not so happy about that. Not worth it!!!He didnt do anything after he filed the papers. We did all the downloading of forms and worse was he didnt not work on my working permit just like what we had in our contract. :angry:

You most certainly DO NOT need a lawyer. Everything you need to do is right here in the VJ guides. It is not hard but it is somewhat thorough and at times can seem overwhelming. Take 1 piece/step at a time and you will be fine. ask questions..........believe me, If I can do it, I am most certain you can!

That's just really bad advice. You don't know enough about the OP's case or their consulate to make that statement.

swoozygirl - At least have a consult with a good qualified attorney who specialized in family based immigration. A good lawyer will happily tell you if you don't his/her services.

a lawyer doesnt get the visa for u or ur spouse,,, the lawyer just fill ur papers and mail'em to where they supposed to go.. and charge u bunch of cash

the only good point about the lawyer that in visa denial case they can ask the embassy why! but they dont guarntee the visa for u,...

so do ur papers and follow the inusterctions on this helpful site and uscis.gov and there are lotsa people would help if u have any problems in filling papers.. make the laywer ur last choice.
