Well i told the lawyer to NOT reschedule the fingerprints. It is this Thursday. She said then that they would cancel the remainder of the processing because that appt was not kept.

lol no I don't drive for a living, but I've drove that a couple times, once when i moved to texas from california, then with my canadian hubby when we came from newfoundland to california with a stop in austin, and of course cali back to austin. We got a little bit of questioning coming into Texas, at it was late (almost 1am) but husband just said he was canadian, and i thew out the "he has a green card" and he said have a nice night

If you decide to cancel the AOS, I'd make sure to send a notarized withdrawel to USCIS, asking to close the case. Just to be one the safe side.

Interesting dilemma for your lawyer. It's your wife's AOS application so YOU can't legally cancel her biometrics. Yet you are the one paying his fee. What to do what to do.

You can pull the affidavit of support, as that is your affidavit.

I went back over there and we had wedding ceremony in Cagayan de Oro on April 8, 2008. We arrived back to the states on April 15. We were married in U.S. on April 18.

you're in K1 yet you get married in Cagayan de oro phil??? how come??? what church? coz im from cag. de oro myself... was just curios about this whole thing...

Well i have friends who did the same. They got married in the Phils. then applied for a K1 for all they know that its the easy way, then married again here. What they do was, they dont register their marriage cert. to the NSO while the K1 is on process, then the relatives in the Phils. will be the one to do that once they get here.

Chill out man. Withdraw your AOS if that will validate your manhood and move on. Let the woman move on and you should to.

I disagree with you.

If he doesn't withdraw his support, she will have legal status in the US. Basically, she would have married for immigration. She wanted out of her life in the Philippines and married an American, then she left him once she got here.

Its ok to leave him, but she needs to return to her home country, If she doesn't return, then she is showing that being in the US was her main concern, in which case she has basically #######'d her way into this country.

Sorry that sounds harsh, but I am tired of all the third world women just trying to come to the US for a better life. People like the women this post is about is why the K visa process has gotten so scrutinized, forcing us all to wait longer.

We didn't do anything ILLEGAL by having a WEDDING CEREMONY in the Phil. ALL we did was have the ceremony for family members sake there. Had the whole walking down the aisle, cake, dove release, wine, meal, by a preacher from the States that was her sisters pastor in Calif that was there on vacation. The sponsors signed the license, my wife and I signed the license, but the preacher DID NOT. I still have the license here at home. THEN when arrived here in Texas just went to the local court house and did the civil ceremony. So basically we had 2 wedding dates. 1 in Phil for the actual WEDDING CEREMONY, and 1 here in Texas for the legal LICENSE. NOTHING WAS DONE ILLEGALLY. AND I HAVE THE THE ACTUAL PHILIPPINE MARRIAGE LICENSE IN ITS ENTIRETY. ALL PAGES.

I'm just curious about something, although this probably has no bearing on the situation at hand. In your OP you said she was picked up at the border on your way to California. Were you coming from Texas? Why did you go through Mexico?

on I-10 there are two check points (both inside the USA of course). If you're east bound I-10, there is one about an hour outside of El Paso. If you're west bound leaving texas, there is one about 30 mins or so into New Mexico.

I had no idea. Interesting.

we've been waiting for the stupid social security number to arrive so we can file for AOS, and it is running us up against the date her visa expires.

So I guess we will file before her number arrives. I don't want this kind of trouble.

You can do that and when your ssn arrives you can let them know when you got your biometrics appointment. They will update it then.
