FIANCE CAME IN, WE WERE MARRIED, THEN SHE LEFT

yes you are right, I guess I should have put more personal research into the process. But I went to Catholic Services to do that for me. I paid them the fee to do the processing. They would call me and tell me when notices came in and wht I was to do next. After we were married, I called up Catholic Services and advised them that we were married, and the case worker said we had 2 years to process for the next step of Immigrant Resident. I even have a letter sent from them stating that. The lawyer I had to hire to work the deportation case from the summer said that they misled us. I didn't know the steps. Yeah I made a mistake about that. But we were going thru a organization that was supposed to help me do everything that was to be done. I didn't know that they would lead me the wrong way. I paid for a service, and didn't get the right information. Yeah I understand how that can be somewhat my fault but, then again I was paying them to represent me and process the paperwork. When i started all this I didn't know where to begin. I looked on websites, checked USCIS, and Manila Embassy website, but didn't understand what was supposed to be done. So I found Caothlic Services had a service that could help. So I went to them.

I met her in 2004. We talked for about 6 weeks, then we lost contact for 2 years. I didn't have access to the internet at the time, and was working and didn't a computer. I happen to find her on here again in 2006. We officially started sating in May 2006. I went there in January 2007. Spent 2 weeks, came back and began paperwork. Her interview in Manila was in Dec. 2007. I went back over there and we had wedding ceremony in Cagayan de Oro on April 8, 2008. We arrived back to the states on April 15. We were married in U.S. on April 18.

Again I'm sorry for not understanding how to use a message board. and I wouldn't be here if I didn't need some advice. Thew lawyer I have that is working the case now and got it out of deportation court because of the problem we were in, IS ASKING ME HOW I WANT HER TO PROCEED. So I came in here asking for advice. Again sorry, if I upset, offended, or made anyone mad. I received ALOT of GOOD advice and ALOT of good points. I thak everyone for what they had to share. I didn't know what to do or how to proceed with this. But now i do. But PLEASE, understand 1 thing.....I WOULDN'T BE IN HERE IF I DIDN'T NEED THE ADVICE AND HELP. I DON'T HAVE THE TIME TO JUST GET ON HERE AND DREAM UP THINGS OR TO BOTHER OTHER PEOPLE. I HAD A LEGITIMATE QUESTION AND NEEDED THE ADVICE. I SWEAR.

I went back over there and we had wedding ceremony in Cagayan de Oro on April 8, 2008. We arrived back to the states on April 15. We were married in U.S. on April 18.

you're in K1 yet you get married in Cagayan de oro phil??? how come??? what church? coz im from cag. de oro myself... was just curios about this whole thing...

We just had wedding ceremony there. The ceremony took place at Deluxe Hotel.

not being registered right? coz that's visa fraud if you get married and actually registered the marriage to the NSO... yes i know that hotel (somewhere near the market i think)... anyways if this is real i do hope you'll find the answer to this mess... the way you're telling the story, seems like the girl is just screwing you up... not sure about her side of the story though...

i wonder if i know her lol

I'm just curious about something, although this probably has no bearing on the situation at hand. In your OP you said she was picked up at the border on your way to California. Were you coming from Texas? Why did you go through Mexico?

We just had a CEREMONY in CDO. No ACTUAL marriage license was signed. We still have the marriage license from Phil. ACTUAL civil marriage was here in Texas. I don't understand what u mean by NOT BEING REGISTERED?

i just meant if you actually had a formal ceremony where you registered your marriage to the civil registar/NSO (phil govt itself)... its just a party then i guess it wont harm you... is all...

Here we go again. In the summer we went to California from Texas to see her mom and sister. When we were returning we stopped in Arizona to see another sister. After we left Arizona and got back into Texas, we had to go thru a Border Patrol station. It was midnight. We were told by Catholic Services that we had 2 years to process the next step of Immigrant resident. They DID NOT say anything about CONDITIONAL RESIDENT. I have a letter stating that about the 2 years. we were detained at the BP station because there was no case in the system pending. We were there for 13 hours and placed her in deportation proceedings and confiscated their passports. They FINALLY released her and her son to me and we continued on to Texas. When we returned, I was told by Border Patrol case worker to go to Catholic Services to get them to help us get the case transferred to San Antonio. Because they had jurisdiction over where we lived. Catholic Services said that "u got yourself into this you get yourself out of it." I then hired a lawyer to get them out of the deportation proceedings. El Paso didn't want to release the case to San Antonio, finally they did. We had hearing February 2nd and the judge honored the lawyers request to transfer case from deportation court back to USCIS court since we had started the Immigrant Resident application and the AOS. Just last week I got phone call from lawyer saying that her fingerprint notice came in and how do I want her to proceed since she had left. I called my wife and told her then emailed the notice to her. She emailed the lawyer back and told her to reschedule it, but then she continues to say that she is not coming back.

Was actual ceremony with a preacher and sponsors and wedding gowns/barongs and bridesmaids and groomsmen. The whole thing, just KEPT marriage license because it would've voided her visa.

She actually lived in Valencia city. Lived in CDO when she was younger.

i guess what "I" think you should do is tell your lawyer to withdraw or cancel the AOS process and let's see how it goes for her... i think her family is also behind this disappearance of her and probably giving her bad advice knowing she doesnt want to be w/ you anymore even if you want to be w/ her or trying to work it out w/ her... it is what it is. since she doesnt want to be in marriage, then i guess you dont wana be part on her AOS where you have to pay and support for everything! wish u luck :thumbs:

I'm just curious about something, although this probably has no bearing on the situation at hand. In your OP you said she was picked up at the border on your way to California. Were you coming from Texas? Why did you go through Mexico?

on I-10 there are two check points (both inside the USA of course). If you're east bound I-10, there is one about an hour outside of El Paso. If you're west bound leaving texas, there is one about 30 mins or so into New Mexico.

Well i told the lawyer to NOT reschedule the fingerprints. It is this Thursday. She said then that they would cancel the remainder of the processing because that appt was not kept.

Exactly!!!! We got stopped at the 1 going east bound. Sierra Blanca. Do you drive for a living? I do but just here in Texas and Lousiana. Because you knew that 1.
