HELLO

I am the wife of American citizen. I left the US without Advance Parole one week ago- the same day i got a call ( i have very sick mam ). I have been in the proces of Adjustment of Status.

I came on K1 visa , never stayed overtime .

What should I do to dont get my case of Adjustment of Status closed and come back ?

i have the date on finger prints 20.03 - tomorrow !! - Husband send back the letter ( Do they change the date just besed on that ? )

I was thinking, if my husband can apply for an Advance Parole and send it to me .

IS it possible they will not find out that i left and will give it to me ?

Please help me ! I don't want to lose my case , what is the way to come back ??

Did they take your I-94 when you left the country?

Usually leaving without AP means you've abandoned your AOS case. Someone recently here on VJ had to go back to his home country and file a spousal visa because he left without AP. Why didn't you make an infopass appt and get emergency AP due to a sick relative? You're in a very bad situation, I'm afraid. US Customs can deny you entry if you try to come back.

You have to have AP before you leave the country. From what I remember, you will not have to start the process with a K-3. Maybe someone else can give you more information. I am afraid you may be stuck out of the US until they K-3 is approved.

In the worst case scenario i was thinking of CR-1

You have to have AP before you leave the country. From what I remember, you will not have to start the process with a K-3. Maybe someone else can give you more information. I am afraid you may be stuck out of the US until they K-3 is approved.

That will still take a long time and more $$. It's too bad you should have requested emergency AP, that can be issued in the same day.

Well, that is good you have no overstay, you will not trigger an automatic ban when you attempt to come back. Sorry to hear about your sick mom.

You case is considered abandoned since you left without the AP. You will have to re-file again. (and pay again)

You have abandoned your application, you will not get it re-scheduled most likely.

That is illegal. You left the country all ready. Do not pursue this. Also, they have records of your exit from the states.

No - they will know, especially since you are missing your appointments. Again, to do this is illegal, and if your caught, you could be banned for life.

Your case is all ready lost. You will need to heed the advice here on seeking the CR-1/K3 now.

You really should of applied for an emergency AP, but that is in the past now. You will have to move ahead with other options.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I would suggest, strongly, that your husband contact an immigration attorney.

Who will take a bundle of bills and then say the same things that have been said in this thread. Immigration lawyers cannot change (or get their clients around) the law.

To the OP: what's done is done. Don't beat yourself up over it, move on, file the new petition and focus on getting that through.

Good advice here. Don't pay for an attorney. It's sad that you are in this position now, but it can't be reversed. Have your husband begin the process of getting a spousal visa for you. I hope your mother is feeling better now.
