Green card arrived today. Yay!

Congratulations, my card also arrived today!!!!

March 3, 2009: Mailed I-485, I-130, I-765 w/ USPS to Chicago

March 5, 2009: AOS packet received

March 12, 2009: Checks cashed

March 14, 2009: NOA for I-485, I-130 and I-765 received

March 16, 2009: Biometrics received

April 8, 2009: Biometrics appointment

April 27, 2009: EAD card production

May 9, 2009: Interview notice received

June 16, 2009: Interview: Approved!!

We had our Interview yesterday and things did not go as planned.

We were not approved because the officer asked us to write and sign a RECORD OF SWORN STATEMENT IN AFFIDAVIT FORM.

He clearly said to get Legal Representation so we're also looking for recommendations for a good (low-cost if possible) immigration attorney in the SFO Bay Area.

Needless to say, we're very disappointed with the outcome and we hope it's just a small bump on the road to the GC.

PS: the statement is regarding Angela's entry denial 2 years ago due to visa overstay (by 60 days!)

Anyone here has been is the same situation?

I am sooo sorry to hear that. I hope things get better and you can find a good immigration lawyer. I still don't understand why they dennied your visa...it was because of your wife's overstay?? I thought the visa dennial didn't have to do anything with the adjustment of status. Besides, they check that when you got your k1 visa, right?

Well, the bad news is that they did not approve the Green Card, the good news is that they have not denied it. We will fulfill the requirements and go from there.

It's interesting that you say "Besides, they check that when you got your k1 visa, right?" because the Officer in San Jose seemed irritated by the job of the CO in Rio. He asked us many times if the issue was discussed in Rio for the K-1 interview to which I responded that out of the 12mn we stayed in the room at the Consulate, 10mn had been dedicated to that very issue. Yet, they gave Angela the K-1.

Again, they are very inconsistent, and as previously stated by many VJers, the whole decision process is so subjective and so based on the mood of the day of the IO that this thing is just terrible.

Angela wanted to mention that she came back to the US four (4!) times after the visa overstay and no officer at any POE mentioned anything until that young officer in Washington who probably wanted a victim for his own advancement.

I told her to keep quiet and not point out the errs and mistakes of the officers, it would just aggravate things :)

Our Timeline below - CA Service Center - Consulate: Rio de Janeiro - Local Office: San Jose, CA

October 5, 2006: We meet for the first time!

March 8, 2008: I-129F K1-Fiancee Visa Application mailed

October 27, 2008: K1 VISA RECEIVED !! (233 days - 7 MONTHS 19 DAYS)

January 17, 2009: Entry - POE: JFK w/EAD (315 days)

February 6, 2009: WEDDING! (335 days)

March 24, 2009: Sent AOS, EAD, AP package to Chicago Lock box (381 days - 1 YEAR 16 DAYS)

June 30, 2009: Interview in San Jose, CA (479 days) - NOT approved, Sworn statement required

AUGUST 14, 2009: GREEN CARD IN HAND (524 days - 1 YEAR 5 MONTHS 6 DAYS)

May 31, 2011: Sent I-751 Removal of Conditions package (1179 days - 3 YEARS 2 MONTHS 23 DAYS)

January 25, 2012: 10-Year Green Card Received (1418 days - 3 YEARS 10 MONTHS 17 DAYS)

Totally agree. It all depends on the mood of the IO and that is wrong!!. Well I hope you can collect all the evidence you need in order to get the green card...good luck!!!

Case was transfered to CSC today. I'm still not exatly sure if that is good news or not or what it means in regards to time frame but regardless, I am happy things are moving along now. :thumbs:

I would think that's good news and that you won't have an interview. How did you find out? Was it a hard copy notice in the mail? Did you get an email? Have you been able to view your case status online?

I am guessing it's good news too! let's hope... we have been watching our status online from the beginning so that's how we know, it was posted there yesterday. No hard copy yet. No email

That's great! I'm a little frustrated, because we still can't see our case online, and we've seen nothing since the NOA1.

Besides The actual I-864, this years most recent tax info and the accompaning W2, and the birth certificate showing that the joint sponsor is an american citizen, is there anything else that is required? soooo...

1) I-864 form signed and filled out

2) This year tax info and W2

3) Birth certificate proving citizenship

Is anything else required besides the above? It says that you can put in aletter from your employer, but it doesnt say it is required, and the joint sponsor makes more than enough above the 125% poverty line.
