I live in the UK and my OH lives in America so I am going to be applying for a K1 visa to go over there. The way I've read guides and such it seems like the petitioner (which would be my OH) has to complete all the paperwork and compile the evidence to send off. Now my OH, bless him, doesn't really understand all the paperwork and all the processes. I have tried numerous times to explain it to him and have even sent him the link to this site. He understands the evidence stuff but that's about it. Can I fill all the paperwork out etc and just get him to sign the bits he needs to? I've been really swotting up on it and it would be better if I did it all. Thanks.

It doesn't matter who fills it out or gathers the evidence as long as its genuine evidence and he signs the papers. I think the bigger question is....does he really not understand the paperwork, or is he just not ready to make the commitment that paperwork represents? Forgive me, just a question that popped into my head when I read your post.

No handwriting analysis is done. Sure, you can help in any way you wish except to sign his name.

I thought someone might mention tthe commitment. He is commited to me going to the States. I just don't think he understands the paperwork trail, and because he is on 12hr shifts he hasn't the time and is usually too tired to try and digest it. I also think he just thinks since I've done all the research etc it might be better if I did it.

Yes he does read and write English.

This is not unusual - many of us are lazy, many of us don't like reading/writing/arithmetic, many of us hate paperwork of any kind, so you doing it for him is perfectly normal - in any relationship one who likes to do certain things or is good at doing certain things - takes over those things e.g. most men like to grill and do woodwork; most women like to shop and shop :lol: Good Luck

My fiance is also in the US. When we decided to marry he booked an immigration lawyer to help us navigate through the 'petitioning' paperwork. We just didn't want any unnecessary delays. It only cost about $1500. If it's possible, I'd highly recommend it. It took over a year to get the result of the petition but the lawyer kept in touch along the way and was patient with our questions.

In Feb we received the approval notice and a packet from the US embassy came straight afterwards. There were some online forms I needed to complete, online, and forward to the embassy to start the process. Then over the coming months, I gathered the required information: Police Certificate (takes 40 days to obtain); notarised support document (I-134); letter confirming employment details (fiance); tax returns etc. Then I had to arrange the medical.

The medical took place in Knightsbridge and cost one hundred and seventy pounds - I believe the price has been increased. They took bloods, X-rays and there was a physical examination and 'interviewed' by a doctor who filled out a form. All these details are depatched to the embassy.

I had the interview last month and was approved pending notarisation of a document. That's now done and my passport and required document is with the embassy - I'm hoping to receive the visa and passport back within the next two weeks. Then we can start planning the wedding and my flight over to my new home in the US.

ps: Be sure your fiance isn't having 'cold feet', cos I know mine couldn't wait to get hold of forms and engage an attorney to begin the process...This is a big step for you both...be certain about his feelings.

We arn't going to use a lawyer as I've read all the guides so many times I think we'll manage by ourselves. Plus I know someone on this site who used a lawyer and said she would have managed by herself.

I sent my OH a link to the K1 flow chart from VJ and he understands it alot more now. I think he's one of those people, and he agrees, who can't take in a lot of info when written down but can understand it then presented in a form of diagram or chart.

He was getting excited when we made the decision to start the process. We were origianlly going to start it Feb 2009 as thats when he returns to the US from overseas but he said he wanted me over there as soon as I can. So it's def not cold feet!

You'll be fine going it alone. If you are comfortable with the amount of research you'll end up doing!

My hubby is in the same boat as your fiance, that distant glossy look at anything that is hyphenated (G-325a, I-129F, Etc.)

I did all the paperwork for each step of the way. Just make sure you make a nice simple chart with all the info in it so he know what to expect at the interview. I made my hubby a study guide and quized him...hahaha.

Butit was worth it at the interview because we knew how to handle ourelves.

We just competed AOS but if you were to ask him one form I submitted he wouldn't have a clue!

I suggest having your fiance sign SEVERAL copies of each form to send to you, that way you have some back ups if you make a mistake. He'll also need to send you passport photos, copy of birth cert. and such. You can mail the packet from abroad but it just might take a bit more time and money (I highly suggest a carrier like DHL or FedEx).

The forms are available as from fillable .pdf's so you can fill them out, email them to him for review, and have your OH send them back again (to make sure he didn't mess them up too badly ;) ). Our forms went back and and forth (via msn messenger no less) several times before we were done.

I will be seeing him in August so we'll be able to gather the passport photo, birth cert etc, go through all the paperwork together and he can sign where he needs too. It'll just be me attending the interview as I'm the one getting the K1 so he doesn't even have to worry about that.

Before you just get him to sign on the dotted line, I would make sure he at least has a general idea what information is contained in each page, and is the purpose of each form. If there is an issue, or if USCIS needs to be contacted for whatever reason....they will only deal with the USCitizen....so he would have to at least be familiar enough with the petition's contents to make an inquiry should it become necessary. I know its funny that men don't like paperwork....and it may well be true, but petitioning and getting the visa is only half the battle. You still have to adjust status once you've married here in the US...and there will be a whole slew of new paperwork to complete for that process. Some portions of that process require the gathering of evidence that is US based...and you'll need your man to either have that info available (like IRS tax returns) or at least know how to obtain what is needed (like if a new medical is requested of you by USCIS). You will be a new immigrant to this country, and cannot be expected to know all its bureaucratic intricacies.

Immigration is a two way street....and as much as men are reluctant sometime, please try to get him as involved as possible because this process is not as simple as "Here honey, sign here." :) Wishing you a speedy 'journey'.

Hi, although I am just beginning the process myself, I can tell you that it took a few months to make sense of the paperwork. I had been reading directly from the US Immigration website. Then, I found VJ and I think I have finally "got it"! It took several conversations with my Sweetheart in order for the two of us to be on the "same page" about this immigration process. I wouldn't, at all, perceive your beloved's lack of understand as a lack of commitment at all. He may find the flow chart easier to follow, as it is a tad more 'visual' with less verbiage. Immigration is a complex process! I wish you good luck!
