Clarification on IMBRA Recall

I didn't get the impression that they were changing the form.

"If it was through an IMB on March 06, 2006 or after, Immigration may request information about the IMB and proof whether they completed the compliance requirement." Meaning if the petitioner states on the I 129F that they met through an IMB, then they *may* request information and proof about the compliance. I don't see how that 'proof' could be anything contained on an I 129F.

Thank you Tracy for the clarification. Just the thought of the process being delayed anymore gets my blood boiling. :angry:

Even if it's a slight delay, it's still wrong to mess with people like that. Personally, I think the people responsible for this screwup whould have their families taken away and sent to another country until every last person affected by this is reunited.

How valid is this? My receipt date is Jan. 5th and my approval date is March 23rd. So Im okay right? I should call the embassy back and reschedule?

This is valid. I was on the phone with the embassy DIRECTLY, and not the #######

helpine in Scotland.

If your NOA1 is dated March 6th or after, your case is affected by the IMBRA

nonsense.

With a receipt date of January 5th, you'll be fine! Relax!

I think her/his interview was yesterday & was cancelled by USCIS, & no one could understand why..........after reading this it all becomes a bit clearer................so she isnt fine :huh:

What happened with the restraining order placed on implementation of this law? Has it been ruled on? I can't find anything in the news that indicates the retraint has been lifted.

just curious to hear any of your thoughts...

my I-129F was submitted recently (last week), but I provided the same information all of you did, no police records or anything. we didn't meet through an IMB and neither of us have criminial records, so does anyone know how the new regulations will apply to someone who just sent in a petition? any ideas on how long the "additional delays" will be?

September 2005 - we meet while I am living in Florence and spend every single day together :)

January 2006 - we part... I return to the US to finish school

March 2006 - I return to Italy to visit for 2 weeks

May 4th, 2006 - I-129F sent to Vermont Service Center

May 12th, 2006 - NOA1 received

June 19th, 2006 - RFE (IMBRA) received

June 23rd, 2006 - IMBRA RFE returned

June 28th, 2006 - Touched

July 3rd, 2006 - Touched

August 19th - September 5th Vacationing together in Greece!

Well I am all for the Homeland Security stuff, but I sure do not like it when it holds up the approval process for K1 Visas!! I am in the unlucky situation of not getting my NOA1 until the 24th of March. So I guess this means that I will probably be twiddling my thumbs until sometime in June to receive the NOA2 or longer??? Darn, I was just getting excited to because I noticed some people here that had received thier NOA1 in early March and already have the NOA2, I was hoping and praying that I would receive mine by the end of this month and that things would go quickly. So much for thinking that this process would be anything but quick!! :(

3/21/06 I-129F sent to NSC

3/24/06 NOA1

3/28/06 Touched

6/1/06 Case transfered to California Office

6/2/06 Touched

6/3/06 Touched

6/9/06 Received 2nd letter from NSC telling me that my case as been transefered

6/14/06 Received 3 emails today saying that CSC has my application

If anyone decides to contact their Senator(s) and Congressman by writing a protest letter, then be sure you get it delivered via FedEx.

I had a business person who owned their own business state that anything a business person receives via FedEx always is an attention getter. Sorry UPS, you don't rate the same. That's reality.

I'm going to let myself calm down today, but I'll be calling Kennedy's office tomorrow, and following up with a fedex-ed letter if that doesn get me a satifactory answer.

Maybe having a corrupt senator that carees for nothing but staying in power for decade after decade will come in useful.

It's hard to know - but I don't think that USC women who did not meet their fiance through an IMB will be delayed. At least I hope that's the case!

Hopefully someone will be able to make a definitive statement on what WILL happen, not what 'should but doesn't' or 'what shouldn't but has'

I just got off the phone with a very helpful person on the USCIS customer service line.

As far as the USCIS is aware, there hasn't been a mass recall, but they said there have been several reports of this happening, and they expect to have a definitive answer for me tomorrow. She told me to call back around noon tomorrow or watch the website for updates as they finish looking into the reports.

If I get any more definitive answers tomorrow, I'll post them here ASAP.
