Does Congressman help us?? In Japan they don't help citizens directly so it sounds very weird :blink: I searched for Congressman and found him. Can you give me more details about what Congressman does for us???

Ravichan, honey, what do you want these people to do for you? I dont' think you will get your K-3 visa intantly, and you don't need a visa to visit the US--you can come on VWP, right?

Your visa paperwork and your usual ties to home, plus the information about your husband's medical emergency should help you get through the POE---I do not htink you need a special medical emergency visa (that would be for YOUR emergency).

Have you looked to see if you can get an airline ticket?

Ravichan, as someone who travels constantly between the US and Japan, I do not think you will have any difficulty entering the US. Do you know how many people entered here on the VWP for holiday during Golden Week? I think that if you came here for a 1 week holiday with a return ticket you would have absolutely no problem at POE. You would not even have to mention your husband's situation (which would probably not work in your favor). Please understand that I am not an expert but I see this as a simple way to handle your situation. If I were in the same situation I would surely gamble the price of an airline ticket for the chance to be with my spouse at such a time. Good Luck!

I am deeply sorry for the situation you are facing now ..but I have advice to you why don't you go and meet someone i mean the consular himself in the American Embassy and talk to him and take with you the papers that prove your husband is in the hospital and all what you may need to prove that you will come back, let his family contact a senator or congressman ..that can help.. Calling the Embassy won't help GO TO the Embassy and talk to them they may listen to you

Ravichan, first of all I am so sorry as it sounds serious if his family say you must come here. I am also in Oklahoma (F)

I think you have been given 2 good pieces of advice here from Salwapasserby about going the US embassy and talking to them with all your evidence. Also Yodrak is another good advisor if this is not possible, I would try the VWP in your shoes, but heed what he says about evidence of a return to Japan.

I hope you find a good resolution.

Jim, what you mean by people is the people who are not applying for an immigrant visa right? I understand that normally Japanese people can visit the U.S. for vacation without any visas, but we have filed for a K3... I heard that when officers scan our passports, they can know if we are applying for any immigrant visas. Is it true?? In that case, it is possible that they will deny my entry right?

Also, on a Japanese forum, I saw a few people weren't allowed to enter the U.S. while they are applying for a green card. One of them even had an employment letter... That is why I am really worried. This is not just a visiting for fun, so I really wanna prepare as much as possible if I leave for the U.S.

I wish I could go to the embassy, but I doubt that they will let me in without an appointment... Also, I live far from Tokyo and I will need to go there by airplane ;) I don't know about other countries, but in Japan you will have to pay to ask the embassy questions regarding visas. $15 for 15 mins I think, so they should give me good services :angry: but by how the person answered last night, I am not expecting too much :(

Hi Ravichan....Yes, I guess it is possible they could scan your passport at POE and see that you have applied for a visa. However, in reading VJ for the last 4-5 months, I have seen so many cases of people living in VWP countries that enter the US without any problem while waiting on their visa. Most of them have given the advice that you should not offer any information to the POE officer unless asked. If you do decide to try this approach and come here as a tourist for a short stay (with return airline ticket) it is a gamble. And only you can decide if you want to risk the possible $ loss if they turn you away. I am sorry I can not offer more to you. By the way....the employment letter (that you mentioned above) without an H1B is like an advertisement for the officer to turn you away. I am truly sorry for your situation and that of your husband. My best wishes to you both.

I called them again, and they gave me a different phone number and I called 7 other places after all. Most of them were unnice and all the reps gave me different answers, and the last person I talked to clearly said that there is no way I can visit the U.S. until I get a K3 visa even my husband is in hospital! I didn't think it was right so I kept on asking and she just said have a nice day and hung up on me :angry: I knew they BS a lot but I am really mad this time...

Tomorrow morning I will call the embassy again. Hope someone nice will answer next time. I live far from Tokyo so if I can just fax them, that would be great.

Many of us here live very far from someone we love. It's really tough, isn't it?

I can attest to and vouch for the fact that speaking to anyone involved with the US immigration system, State Department , etc......is a lesson in frustration. Believe me.....I can relate. :wacko:

As one person said, it is a tricky situation and basically, were it my wife in your situation, it would come down to a decision whether to "gamble" and have her come visit me if it were me in the hospital. Were it serious enough, there is almost no doubt I'd have her take that risk.

I also wanted to mention, that even though there are people who work in congressional offices whom the family could contact and try to get help with this sort of thing, based on my own experiences with such a thing, I have not been too impressed with their ability to help. I have found that most times, when I need to get something done, I have been better off doing things myself.

Which leads to the next thing, that you could "try" to speak to the embassy. When I have done such a thing, I have found the people at the embassies to be much more accomodating and willing to listen when I go in person, than when I just call or send them an email. In those cases, such as email...I am often ignored...and in the other..by phone, I find that they are much less willing to go out of their way to help and act like they could care less.

But, when I have made visits in person, the experience has been much different, and I have gotten much farther, and received much more help.

It is too bad that no one is able to come with you to the embassy (an American citizen). Unfortunately, from what I see when I am there, the treatment, I as a US citizen is given, as opposed to a foriegner, is very different.

I can only suggest that if you try to go to the embassy in person, be persisitant.........

And if you try to chance a flight to visit your husband.......well...I was nervous about my wife coming to visit me, and she has done so twice...with almost no questions asked. Be picky about the airports you enter. The smaller ones, have too much time on their hands, and may just question you more just because they have little else to do. The bigger international airports are more busy, and they don't have the time to nitpick like the smaller airports do. They are just too busy. So my advice if you try to fly on the "visa waiver program".........choose a larger international airport as your point of entry.

And if you do try this, as stressful and important a time as this is for you, try to look as relaxed as possible when you enter, because if you worry too much and look nervous, that may make them question you more. Also.....finally...as everyone else has said, bring proof of ties....employment letter...etc.

April 20, 2007 Wife enters through JFK. The days of grabbing my dinners at the WalMart deli....are now officially over!!!

I just got done talking to the embassy and the rep on the charged call was really nice :D She said that I should be able to enter the U.S. without any problems with VWP even though I have filed for a K3. She said that having a round ticket from the U.S. to Japan is considered as you have a will to go back to your country and it's even better if I have a doctor statement, so currently his sister is getting it for me.

"Due to security considerations, there is no longer an information window for walk-in visitors."

That is what the embassy website states :(

Anyway, I am hoping that I will have no problems to enter. I think you are right. If I act too worried, they might think I am suspicious. I am not doing anything bad, so I will just act normal :D Now I need to contact my work. I hope they are understandable. There is another problem since some workers are unnice ;)

I'm sorry about your husband, maybe if you show your ties to Japan and intend on coming back to get your visa, and then show them the invitation letter and medical emergency papers... it may work.. hope everything works out for you

Yes don't try and mislead the POE Officer - hopefully you have your letter from the doctor or hospital you can show if needs be and your return ticket (and whatever else you brought showing ties to and intent to return to Japan)- and don't forget one of the main reasons for you to return to Japan is that you have an interview for your K3 in the not too distant future.
