K3 No longer a valid visa!!!!!!

They have been pairing applications going back to at least the March filers, so this is not something new and it has always delayed the dual-approvals by a small amount compared to the stand-alone I130 approvals. Neither of those 2 things are new pieces of information.

The problem is that USCIS have not made any official statement on changing their processes to "ignore the K3". Such a vital change needs to be addressed (if indeed it is true). If they are going to change the process, then they need to let people know. If they are going to cancel the I129F anyway, why go through the effort of pairing them up?

It has been proven time and time again that USCIS do not follow their own procedures and do things on a whim. Until we see something concrete (not just through the mis-information line) a lot of people who have been on this site for a while will continue to be skeptical. A prime example of this process not working is VJer Divine Mercy, she was told that the I129F petition was cancelled by USCIS in November, because her I130 was approved separately. She then received an approval on her I129F this month.

Well I don't knoww how things like this work in the US, but here in Brazil, if they decide to inactivate something, they can't cancel petitions that were filed prior to the cancel date

I mean, they can say "starting today, we are no longer receiving k-3 petitions", but they can't cancel the ones which were already sent, as they were send while it still applied

I can't believe that they can just choose to cancel your petition and you just have to accept it... this is not right! It is not honest!!

The USCIS 800 number is called the mis-information line by many on this site for a reason.

In fact it is the other way around, if an I-129f is submitted for K-3, the USCIS will hold the I-130 and just send off the I-129F for K-3 visa, they do not send off the I-130 for CR-1.

Both my I-130 and I-129F ..........are moving forward. I'm going to cancel my K3 now. I doubt they're going to hold my I-130 once it reach to NVC.

Many have tried that only to get both I-130 and I-129F canceled, the cases are linked, and only way to keep the I-130 moving on to NVC is by filing I-824 requesting the I-130 be sent on to NVC for counselor processing into the CR-1 visa.

The decision must be made if you want CR-1 or K-3 BEFORE you send in the I-129F.

I can't believe we are being penalized for sending in the I-129F. this is frustrating enough without doing this to us. I hope they cancel these I-129Fs soon so we can get on with the already too long process

My husband filed K3 last October 2006 and last February 2007 he filed iancee visa visa for me.... K3 visa was aprroved October 2007 and fiancee visa was approved November 2007. hence my K3 visa was approved first and NVC sent me an schedule for medical Test and US Embassy Interview so my fiancee visa was ignore. So i think K3 visa was still okey. I don't know? But just hoping everything will be okey...

Is there a phone number that we can call to find out, and preferably speak to a real human?

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!

What I am reading in this tread does make scense. For some odd reason my I-130 and i-129f were not paird together. I am a late July (I-130) filer and early Aug (I-129f) filer. So I only paid the $199 for both applications. Which to me never seemed write, but I wasn't to complain. My I-130 was approve some what early. I'm thinking now if the two were paired, then I would still be waiting for an approval.

FruitBodyWash, my husband called CSC using the RFE line, so he didn't call the regular customer service 800 number. Firstenburg also used the RFE line, where he got this information.

Like I mention in a different thread, I think the problem will be for filers who "got away" with filing the I130 with the old fee, and then I129F with no fee. It also seemed to me that it was too good to be true.

By the way, BOTH our files were touched AGAIN today...maybe they were really confused with all of my husband's questions after the lady said they would just cancel our I-129F. OR they are blacklisting us...one or the other. :wacko:

Summer 2004: Met while on J1 visa; J1 internship was 3 months (subject to 2yr-HRR)

I also want to chime in to remind everyone that the USCIS officially states that the correct filing procedure is to send the I-130 in and wait for the NOA1 (and transfer notice if you filed at the new Chicago lockbox per their updated filing location instructions). Once you have the NOA1 then you should file the I-129F at the Service Center the underlying I-130 is being processed at (as listed on the transfer notice / NOA1). I see many people filed them together to the lockbox but I am just citing what they say on the official USCIS instructions.

Well we did it the way USCIS stated because I submitted our I-130 back in November of 2006, then once I became a US citizen I filed the I-129F and upgraded my I-130 and they still cancelled my K-3!!!!! This is Extremely :crying: emotionally draining on my part and very emotionally Hard on my husband!!! I can't even go see my husband now, I had to cancelled my trip that I had planned on 1/31 to lebanon because of Life threatening unsafe surroundings throughout the country :crying::crying::crying: I am going to write to EVERYTHING in the US GOVERNMENT!!!!!! I can't take it anymore!!!

If you go through the USCIS number of 1-800-375-5283, it then gives you options, and you press the option that gives you the RFE ext. from there you get a person quicker then the other options, even if you don't have any RFE. This is where I got my last information

Ok, i think you misunderstood whats going on. My husband just called Immigration to ask about this, he even escalated the call to a Supervisor to make sure. The K3 visa is here to stay, its part of the new Visa process and it isn't going anywhere. The Supervisor was actually very confused as to exactly what in heck my husband was talking about when he asked.

Our k3/k4 already set or have medical/interview appointment schedule this coming march. We we're planning to ignore K3/K4 interview since our CR1/IR1

already have a case# assign at NVC. paid AOS and sent DS3032 (choice of agent) as what I stated on my signature. Are you sayin' EVEN my I-130 case at NVC they are still goin' to hold it?

Now am a bit worry, I guess I have to prepare all necessary documents needed for k3/k4 interview as fast as I can. and go for both visa if they won't hold my I-130 at NVC.
