POE allow 90 days Employment authorization?

is there any Point of Entry allow 90 days Employment authorization?I heard JFK allows that?Is that true?Thanks VJ's :)

Mar. 11, 2008- ARRIVED US

Mar. 12, 2008- got married

00-00-0000-Temple wedding-Mormon church

Mar.13, 2008-completed vaccinations-I693A supplement from CS

Mar. 18, 2008- sent the AOS package(I-485 and EAD)..applied for SSN..

Mar.19, 2008-Delivered. signed for by V Bustamante-took and passed written driving test

Mar.25, 2008-Check cashed-Received SSN

Mar.27,2008-Received NOA's in mail-Case available online

Mar.28, 2008-Received Biometrics appointment in mail-04/08/08

Apr.08,2008-Biometrics DONE

Apr.08-09,2008-TOUCHED

Apr.14,2008-Transfer Notice date to California(I-485)

Apr.17,2008-Received Notice in the mail about the transfer

Apr.20 and 22,2008-I-485 TOUCHED..No touch on EAD

JFK gives it but it's kind of pointless because after the 90 days are up you have to wait for your EAD that you file along with your AOS after you get married.

So unless you can get someone to employ you for only 90 days, it's pretty useless.

And they are not obligated to provide the stamp and can discontinue at any time.

Keep in mind K-1 is not a work visa it is a marriage visa.

K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not. So if trying to get SSN after marriage using only the K-1 and marriage cert, you may run into some resistance at the SSA office.

If you want guaranteed work authorization upon entry to the USA you need to marry first and apply for a true immigrant visa (CR-1), that visa generates a temp green-card immediately upon entry to the USA

Ok Thanks! We plan to get married the next day he gets here then apply for SSN then apply for AOS and Employment Authorization at the same time..Thanks for all responses :thumbs: ..I'm just curios about what I heard, but no plan my SO do the POE in JFK..I just want to be with him, nothing more, nothing less..

Okaaayyy.... I have read conflicting posts and info on this.

Some of the things I've read:

1) JFK is the only POE that gives the 90-day stamp at the airport

2) you need to ASK the JFK officer for the stamp

3) JFK USED to give the stamp but now RARELY does

4) JFK USED to give the stamp but now NEVER does

5) no one gets the stamp AT ALL EVER now

6) the stamp has been reduced to almost and urban myth

Does ANYONE know for sure?? :blink:

It would put my mind at ease and help us to know what to expect and plan accordingly.

I have heard of people recently getting temp EAD through JFK (shoot me - I can't remember who or which post and my memory is so bad it's a miracle I remembered this!) but that is the only POE that will do it. I have also heard (same as above - was the same post as well) that someone got a 180 day EAD stamp - this might have been a mistake on the part of JFK but was seen by the poster first hand.

Thing is if USCIS is to be believed they are now citing 12-18 months for AOS etc and with that I am guessing EAD/AP will also be delayed so 90 days might not be enough to actually get you to EAD... unless you start working a month after you apply or something - who knows?! Someone else also speculated that employers might not actually check your temporary EAD after the 90 days... :whistle:

I bet the confusions comes from people who don't realize JFK is the POE you need to arrive through. Luckily, since we live in NJ, JFK is the airport he usually comes into anyways.

My SO is the type of guy who doesn't like to be dependent upon anyone, and has worked every day of his life. He's afraid that once he comes over and is waiting for his EAD, my family will see him as bum who came to mooch off their daughter. I assusred him that of course everyone will understand it's part of the process. But he was still hoping to at least get a disposable little job in those first 90 days. If he gets the stamp, I guess that's possible.

So all you need is the stamp to work, not a SS# at first? Or does he need to get an actual SS# before working?

This is really good to know; I was wondering how the work status authorization would work out, since he's hoping to transfer to an American office of where he works now. Hopefully, that will be possible.

He was hoping to fly into the US in June, but we're not getting married until August. I'll make sure my fiance flies into JFK even though I live in Boston (maybe we'll stay overnight in the city).

So what is the point in having an EAD stamp with no SSN?

Since nothing can be done until arrival and since they have no idea when you are arriving, you must go to the SSA office after arrival and simply apply for one...
