When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I, USC, and husband, Chinese, have 3 kids together. We have been in China for 8 years and my family would like us to move to the US asap.
They would like to hire me as a live-in caregiver for my soon to be 90 year old grandma.
1) Could a lawyer issue me a job contract on behalf of my gma's estates?
2) Does it matter what company issues the job contract?
3) What information must be included in the contract?

when we got approved for marriage based green card we were married less then two years . But he enter US after two year marriage.I m a bit confused and need clarification.
Last year, my husband entered the U.S. after we had already been married for over two years. We got married in South Africa. When he arrived, he was mistakenly issued a two-year green card instead of a ten-year one. We filed an I-90 to correct the error, and it was approved the card was updated to a 10-year green card.
However, this past weekend we received a Notice of Removal of Conditions, which shouldn t apply to us. I ve called USCIS several times one representative said those letters can be auto-generated because the system might still be referencing the original two-year card, while others sounded unsure since I provided two different receipt numbers (one for the old card and one for the corrected one).
I told them I wanted to schedule an in-person appointment to clear this up, and they said someone would call within 72 hours to confirm the request, but it could take up to 30 days to actually schedule the appointment.
My concern is that if their system is still tied to the old card, it shows an expiration date of 02/2026. We don t want to risk traveling and having my husband s card flagged due to a USCIS error.
Some people are advising us to file another I-90, while others say to wait for the appointment.
I just called USCIS again after work, and they told me they canceled my appointment request because it doesn t fall under one of the reasons they normally schedule appointments for. They advised me to write a letter to the address listed on the notice explaining the situation in detail. I guess at this point, I have no choice but to do that and hope it clears things up.
A year later getting conflicted information. Even an online lawyer saying hes not sure . We decided to be safe going to file to remove conditions. Because sending a letter will take time for usics to respond.

11 RepliesSo because we are down to the wire and bc of a miscommunication with our joint sponsor, we may not have the joint sponsor documents in time to meet the 90 day deadline.
My brother is out of the country and won't be back until the 17th. Our 90 day mark is 10/16? Maybe 10/13 actually bc he came into the country 7/16.
In any case, unless my brother gets back too late.It's my fault. I didn't fully understand the different deadlines bc I've been running around for school, work and getting all the appointments set up.
We got the SSN for him and opened them both bank accounts but this...
So, please don't berate me. Trust me I know. I'm sick with it.
I know you all get asked stuff like this all the time by idiots like me but what do I do if I'm filing a little late? (like days late)
Is there any way to get an extension?
I don't meet the financial requirements without the joint sponsor so I'm not sure if filing without his stuff would do any good.

2 RepliesHi guys! Through public inquiry we found out that our case was sent to the US embassy in Montreal since 9/17 but we haven t received further instructions. I found the registration link but says that we need to have a letter first? I m just confused because some say that K1 visa applicants don t receive welcome letters? Can anyone advise? Thank you!!!

7 RepliesBefore I get started thanks ahead of time for any help I get. I have a few questions regarding filling out the I129f, is it ok to use another pdf reader than Adobe acrobat like pdfx. I ask because I got the form to work correctly with Adobe Acrobat but is very specific about what charecters I can use in certain fields. Like I can't use slashes to to type N/A in fields that don't apply to me. I also can't use hypens in part 8 item number. (Pdfx does allow it) Which is another question do I need to reference all item numbers for continuation or i.e.( place I've lived since 18 I have 4 total states i can only write 50.a in the item number box is that acceptable or do I need to hypen and compass all item numbers being referenced.) And can I put other other 2 states in one part 8 box or one state per box. Or would it just be easier to print and write the application by hand. Can you get rejected for using other pdf fillers besides Adobe Acrobat. Sorry I know this is alot.
