How long to I have to act after receiving NOA2..is it too risky to stay out of the country?

Hi everyone! 

 

I submitted my I-130 at the end of January. I received my NOA1 around 2/5. I will be going to Italy in 4 weeks and staying until the end of June.

I was thinking of extending my ticket to stay for an extra month. I would really like to do this, however, I am afraid of getting an RFE while I am gone or getting my NOA2 and not acting upon it immediately.

 

If I am out of the country, how long would I have to 1) respond to an RFE (if I am unfortunate enough to get one) OR 2) take action and move forward after receiving NOA2.

 

I know the next step after NOA2 is the NVC stage, but I am not even fully sure what that constitutes to or how much effort is involved in that stage. 

 

My timeline is saying my case likely would be adjudicated around the time of July 28, but you just never know. As much as I want to stay with my husband for longer, I don't want to have anything happen with the Visa that I am not here to address.

Submitted everything to NVC: 9/16/2018

NVC Case Completed: 10/2/2018 

  • Received approval for all AOS and IV documents BUT had to rotate and re-upload husband's passport biographic info page: 9/20/2018

Interview: 11/13/2018 (Naples, Italy)

 🇺🇸 APPROVED! 🇺🇸

Immigration day: 12/13/2018

Timeline

I believe the response time for an RFE is 12 weeks or 84 days. Of course, the more prompt the response the better to move your case along.

 

From NOA2 to NVC, users on VJ are reporting long wait times right now. Several are well over the 2 month mark and NVC hasn't even entered their case in the system yet.

So after I receive the NOA2, there is really nothing I would have to immediately do?

Correct, the first step is to wait (we're all used to that by now). Of course, you can always start prepping by gathering tax documents, etc., for the affidavit of support that will eventually come. But until NVC enters your case into the system you can't actually do anything (except the aforementioned prep work on your part).

You will know from their email either RFE or approval that if you provided G-1145 notification. Sometimes RFE response is shorter than 12 weeks depending on what case if it's a little thing. NVC is rolling much faster than USCIS so you better prepare for this.

Once your case gets to NVC, you have up to one whole year to deal with them :D So you can move as fast as you want, or as slow as you want!

I strongly suggest that you start studying very well what the NVC stage involves if you want your case to move along without hiccups at the NVC stage. I stalked this forum for months and read the NVC Wiki inside out, read all the threads on process and procedures, looked up common reasons for checklists etc. Depending on your circumstances, there may be papers that you will need time to obtain as well.

I suggest you study the process in advance and star collecting what you need.  There are steps involved, and documents to obtain.  Any RFE (checklist) given at the NVC stage will reset the clock and delay your case....good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

G-1145 provides no further notifications after the petition is received as that form’s one purpose is to provide electronic notification of receipt, not status updates.  If one wants to receive any status updates, they’ll need to provide contact information to the USCIS website.
