This needs to be clarified - the law permits AOS from all kinds of visas. Laws can't be changed by an internal notice of policy change. I'd like to know more about this.

Just tread the NY Times longer version - it's for "at least 3 moths" - so basicially ESTA.

the law is not being changed it will still be possible to aos from vwp but instead of uscis assuming it was a change of heart they will have to be convinced it is genuine and not just someone trying to jump the line.

Meaning for other visas - tourist, student etc.

Except VWP countries aren't included. I don't really think it is such a big change in practicality.. They weren't assumed to be lying b4 but they were certainly scrutinized harder still. A marriage needs to always be proven.

 

The first shorter article was ambiguous. I really don't like when articles are written just to make ppl scared.

VWP entrants are excluded from this.

This only affects visas as this is a DOS change. AOS is a USCIS process, which has not adopted this policy (and past rulings on the law cannot be overruled with policy changes).

I read the NY Times and the Hill. The latter is alarmist. Also, the filing of this article in K1 does not apply as the K1 is a non-Immigrant Visa WITH Immigrant Intent. Confusing but the 90 day rule does not apply here.

 

FAIR supported the ruling which is fair but the Lawyers Association predictably did not..calling it draconian...

What I find racist is why it doesn't apply to the Visa Waiver Treaty Countries....it should!! 

 

Ever take a look at Visa stickers from other countries? They state very clearly..Change of Purpose is not allowed. Time we did that here too!!
