Yes, it is a ban on physically entering the US on any visa. They really don't mess around with visa fraud. Waivers can "waive" the ban but it's expensive to file (in addition to the fees for K1), and you should probably get a lawyer.

If you're successful with the K1, don't forget that she can't legally work until she gets her EAD. I wouldn't tempt fate twice.

People don't read enough, they don't pay attention & they believe once

they get a visa they are in...I have said it here B4 its a good idea to clear texts

from phones, If traveling with a laptop careful what you have on facebook,

or in email. You can be asked to go to either in secondary, anything you claim

is locked or you cant remember pwd can cause a denial of entry.

She will need waivers @ $585 each after you petition her & she interviews, its

best to consult with a waiver atty, she has misrep & deportation.

Yes, they can do that to anyone entering the USA, but thousands upon thousands of foreigners enter the US every year with a tourist visa with no problem whatsoever. Something has to raise a red flag with a tourist before they'll take the time for that much investigating at the port of entry. Apparently whatever it was that raised a red flag, the officers were wise to take the time to go through her phone. Coming into the USA under the pretense of tourism, with intentions of living and working here is in fact a crime. People like this make coming to the USA harder for honest people.

Yes, a mistake was made but now you'll has to find a way to get beyond it. If you now wish to petition her for an immigrant visa, you will need to follow that path. A visitor visa is for visiting and it is titled in a non-immigrant category.

People must learn to respect the laws of the country they are trying to visit or trying to live in. Ignorant of the law doesn't make you exempt from it.

B-2 visa is for pleasure. Not for other things. I bet people are now start screaming and started a petition to let B-2 visa holders to get a job in the U.S.

Case like this is the reason why many people got refused for B-2 visa from developing countries. Go figure!

They wouldn't use those for the kind of searches I think you're thinking about. That would be done at a hospital. Would be surprised if they were even allowed to do those kind of searches at an airport.

None. If she has a ban the visa will be denied at the interview. Then you may file a waiver. This will be judged based the merits of your hardships.
