How easy is it to be approved after a 221g denial?

If you already have the answer to your question why are you posting in the forums? 100% of the knowledgeable members on VJ will tell you never to set a fixed date, buy plane tickets, etc. until you have the visa in your hand. Even the US Embassy says the same thing. Apparently your opinion holds more weight than the embassy, thus go ahead and send out wedding invitations. If you are sent to AP like another poster said, you will remember this conversation vividly. Based on your post you haven't even sent the documents, yet you are ready to send wedding invitations? good luck.

Do you people honeslty think I can expect my family to come to our wedding if it is short notice? My family is important to me and I WANT THÊM AT MY WEDDİNG. But like most normal people THEY MAKE PLANS! I have to notify them well in advance if they actually plan on showing up. And my opinion is the best one, I actually use common sense. WHY THE HECK WOULD ı GET SENT TO AP? I was just told to send in his clean police report and passport. I get it people here are bitter, judgemental and pessimistic, but don't let that cloud your logic.

You're most likely right, but you have way too much confidence in government functions. Anything BUT common sense dictates how it works. Never know what could happen...

Honestly we dont have time to set up a wedding. After we go home to Minnesota in the summer we have to be in New York in the end of August so I can start grad school. We already paid the deposit on an apartment. the wedding has to be in August if I want all of my relatives to attend.

And none of the rest of us have families, that are important to us? Wanted them at our weddings? Sometimes, that isn't what happens, in spite of what we want. The Immigration process doesn't give a fiddlers what you want, what you've planned, and they are in no way obliged to meet your timetable. If they decide he is going into AP, that that is where he goes.

You have to try and understand, people here are trying to help you avoid a very costly mistake. If you prefer to believe there is anything whatsoever logical about this process, or that in any form common sense is involved, then off you go.

Sometimes people do not get the answers they want on VJ. Sometimes people are told the correct answers to their question, and that is not what the want to hear, or choose to believe. When that happens they lash out at the very people who are trying to help them. Good luck to you.

And no, if he goes into AP, there is no congressman aid for that, no lawyer can assist, no way to expedite.

221g is not exactly a denial is just to let you know that you need to give them more information. It doesn't mean additional consequences more than the time youhave to wait.

I know the 221g was just asking for extra documents. In our case it was just his police report that came back completely clean, it just was delayed for some odd reason. I understand if they would give us AP if there was a crime on his record but his was completely clean so it looks like they were making sure he didnt commit a crime.

It's all well and good saying you want you your family there, you want to give a lot of notice, you need it for school and so on and so forth. That doesn't change the fact that nothing is set in stone. Likelihood of him going into AP, probably isn't very strong. However that doesn't give you the right to just go off on members who are here to try and help. Understandable if somebody was rude but nobody was. You may not like/agree with the answers you get, you just need to realise that theses members are just trying to prevent you from setting yourself up for a fall!!

This is the first very small step in the K1 journey. Let's just hope that from here on out you're able to do this process all but yourself and you do not have any questions. With this attitude there aren't gonna be many that would help. Yelling at people and acting as if you're the only person who wants their family to be at their wedding is not the way to go.

Don't listen to anybody's opinion on here, like you said, your opinion is the best one. How about just listening to the U.S. Embassy, they tell you not to make any wedding plans or non refundable travel plans until you get your visa in hand.

But hey, you know best! Your opinion is best.

Sometimes we can't always get what we want though and that sucks.

In my case, it's possible that my fiance could be approved before September, but he actually can't come here til Oct or Nov. Why? Because he has to attend his brothers wedding and he can't just leave and go back and then come back here. So we get to have our wedding much later, oh and we also have to plan around our family so our own wedding might be even later. We want an outside wedding, that might not happen in the winter. We can't always get what we want, and that's okay just be happy that it all worked out.

Seriously if anyone is wanting more than this working out then they don't appreciate the system themselves.

Most people just want to be approved/see their family member approved, anything more than that (plans, the wedding itself, work, school, etc) is just icing on the cake.

That said, you seemed to have made A LOT of plans based around a system that could literally take anywhere from four months to years. Your plans should have never been anything more than: Once my visa is approved, when ever that is, THIS is what we will do. Anything more than that can just set you up for failure you could have avoided.

I have been living in Turkey near my fiance. I basically was working for 2 years and now due to the changing political situation and new laws, I ended up losing my job because I don't meet the new educational requirements. I feel horrible not being able to work for a year and am only doing freelance that pays badly and I want to be able to do something better with my life so I decided to apply to grad school so I can start supporting my fiance and I until we marry and until he is able to work. I am stuck in Turkey basically sitting on my butt and I want to do something productive with my life and working legally there as a foreigner is becoming more and more complicated. We started the process in September and got interviewed last month, it has been going really quickly according our lawyer. Our 129-F was one of the fastest approved petitions they had ever seen. Our biggest problem has been the delayed police report. Hopefully it will keep going as is and we can get to the states this summer. We have to make plans. I need a place to live in NY and I want it to be with him and the fact we got family housing is good.

The fact we made concrete plans and told the embassy about them I think has helped our case. I got accepted into one of the top schools in the country which helps a lot and it shows them we have plans and are serious about starting our lives together in the US.
