Is it possible to start the k1 process if you don't live in the USA or in your SO's home country?

Hey everybody,

Just found out about this website and so far just reading has been super helpful, great community!

My girlfriend and I have been living in Prague, Czech Republic for the past 4 years together. We both want to move to the USA in the next 2 years. We have decided the K1 visa route seems like the best way to go. So my question is this, is it possible to do this process if we both do not live in our home countries? Can we do everything needed here in Prague or will we have to go to France(her home country)for some stuff?

Also, we have no idea where we want to live in the USA, will this matter? I work in IT so I'm hoping it won't be so difficult for me to find work regardless of where we go.

Or you will get placed in AP until she can provide this proof.

The issue with the US citizen is that they have a standard of proof of "intent to re-establish domicile".

This can be established in a number of ways, not just getting a lease. Some embassies are tougher than others when it comes to this. A forum search will bring up lots of information on this.

The second issue, is the need for a co-sponsor to meet the financial obligations via income or assets. Whether OP has someone in America that would be willing, has the assets, or needs to seek employment that will be continuable once they move there is probably the more pressing concern.

OP, you will have to get criminal checks from each country you've lived in as part of the K1 process, so you would have to apply to France for this. No big deal usually just a little more legwork on your behalf.

(For my journey I was living in Cambodia, but I'm from Australia).

A better option than K1 in my opinion is CR1/IR1. Then Just get marry in Praga additionally in Praga you can file via DCF as a married couple and 3 month later get her new Migratory status.

Please don't give incorrect advice. There is no USCIS field office in the Czech Republic and hence no standard DCF allowed there.

Perhaps outdated. DCF was done away with several years ago for anyone not living in a country with a USCIS field office and who wasn't experiencing an emergent situation.

It is a complex issue that I suggest you read up on before posting about again because you could really mess up someone's timeline and life by giving incorrect info.
