Regarding sending I131 application while I485 is pending

Hi,

I know that the fee for the I131 Application for Travel Document is waived if it is sent along with the I485 application. I sent out my I485 in Dec (came to the USA on a K1) but I did not send the I131 application along with that because I didn't think I would need to travel before my GC comes in.

Considering the current processing time for I485, it seems like it will be a long wait before I get my GC. I might have to travel to India before that, around June/July for a family function. Also, since most of my family is in India, I want to make sure I have my travel option open in case any emergency travel arises. So I have decided to send in my I131 application for a multiple entry Advance Parole.

I am a little confused about the fee though. When I tried filling the online form, it asked me for a fee of $360 and did not give me an option to get that fee waived for having a pending I485 in process (fingerprints done as of now). I'm thinking I could send the paper application attaching my I485 NOA1 copy, is that good enough for a fee waiver?

You cannot e-file an I-131 if filing based on a pending adjustment of status application.

Mail in a completed I-131, together with its required supporting documents and a copy of your I-485 NOA, and there will be no fee.

Oh I had already sent out the I765 with the initial I485 application. In fact I got an update four days ago that my card is in production. Yay!

Then you'll likely receive a paper AP, and it won't be attached to your EAD as most people's are.

It makes no difference, as both the paper and plastic versions hold the same weight.

I am in same boat as you. My i485 form is still pending. Received my EAD card. Also received a letter about interview waiver letter.

I am in the process of filing for AP. Do i need to put a specific travel date, reason, lenght of time? Can i leave it all blank?

Theses are the supporting docs that i am submitting:

Receipt of I485 form(NOA1)

Interview waiver letter

Copy of EAD card

Need some help with questions #14 and #15 of the I-765 form. My wife has been using her EAD/AP to travel in and out of the country every weekend and we now need to renew her EAD/AP since we got the dreaded Notice of Potential Interview Waiver letter and are still waiting. So for #14 would she be Parolee and Adjustment of Status for #15? Thanks for your help!

Leave the length and date blank, then hand-write Unknown for those after printing out the form. No need to ever give a reason for wanting/needing AP as an adjustment applicant.

For #14 you can put 'Advance Parole' as your manner of last entry, and #15 you can put 'K-1 - Adjustment Applicant'.
