    In MENA countries it does. CO looks at what is customary for a specific country and what is not. Things are complicated by the fact that there is a huge number of fraudulent marriages where younger men from MENA marry older women from US to get visa either through paying to these women or through lying about relationship. It affects other people that are true.

    There are a lot of costs associated with bringing foreigner to this country, even if the foreigner has college degree. I am exactly 1000% above the poverty line but considering that my wife does not work it does put some financial strain on my lifestyle that I am used to. Recently I have seen the thread where OP was asking if she can apply for food stamps once her fiance arrives. This is absolutely ridiculous. You may be barely above 125% line but have to apply for food stamps right after arrival of the foreign spouse. This is crazy. While love and happiness is basic, it should not be at the expense of other tax payers. Personally I make $180,000 annually and pay a lot in state and federal taxes. I do not feel like paying for food stamps of the USC that cannot sustain his/her household only because his/her spouse arrived from another country.

    Sorry about your situation, but the I-864 is not just another piece of paper. It is analogous to co-signing a loan - a potentially unlimited amount that the Joint Sponsor would be on the hook for. Look up all the horror stories on this forum from people who regret signing the I-864. If your wife's son receives any means tested benefits, your Joint Sponsor would be on the hook for paying it back. If your brother married a foreign woman, would you want to sign the I-864 and be responsible for paying back those benefits? What if he receives Medicaid and it is for $100,000. Would you be okay with signing the I-864 and treat it as just a piece of paper?
    What is the family relationship between your brother's family and this child? He's not your son. He is not related to them at all. Just because your wife married you, it doesn't mean your brother and his family have to put themselves at financial risk to help her - a stranger to them.
    If my brother wants to bring his wife and her child to the US, I would give them money and food. But I would not put the financial future of my wife and kids at risk for them by signing the I-864 because I have no control over this child. If my brother got divorced, I would still be on the hook. If this child runs up the bills by using means tested benefits, I have no idea how deep a financial hole I will be in. I bet if he needed medical attention - my brother and his wife would not hesitate to think about paying the bills as long as he got the medical attention he needed. If they can't pay the bills, guess who the US government can come after? That's right the I-864 Joint Sponsor.
    I think you and your wife needs to look at things from your brother and his wife's perspective. Why should they put their financial lives at risk for a child they don't know?
    If you and your wife ask them to sign the I-864, then they can accept or decline. If you and your wife expects them to sign it, then you are demanding that they sign it. It's not asking - it's telling them what to do.

    Harpa is absolutely right. You will not shave off anything. There are so many possibilities it is like trying to guess someone's pincode on the ATM card. If you want to waste your energy by chasing various possibilities it is up to you. All it does is make you nervous. Wait for RFE. You cannot respond to RFE until you receive it any way. Usually, it takes 1-2 days to satisfy RFE and send it back...

And as for the assumptions and incorrect statements that Tim/Mav keeps spouting, that's got to stop. People come here for accurate advice, not ill advised opinions and guess work.

    While San Diego certainly was harsh, he (or she?) does represent a substantial portion of the populace who sees immigrants as a drain on the system, and questions like this don't help. If a USC can't afford to support his or her spouse--knowing that said spouse won't be able to work for some time after arrival--maybe immigration should wait until a better financial situation is achieved? Even if the LPR doesn't qualify, it seems likely in some of these situations that the USC could have supported (and was supporting) him/herself without any government assistance, but having added another person to support into the equation means they now need food stamps. So while the food stamps are in the USC's name, they wouldn't have been paid out unless someone else came along to further stretch an already-limited budget. I can understand the frustration. I don't necessarily agree, but I can see that POV.

    I agree with Jim. It may play against you. This is a risk. Yes, there is a chance you may get approved for expedited processing AND you will not be delayed due to insufficient income/child citizenship issues etc. HOWEVER, my opinion has always been that it is better to wait extra 3-4 months and get K1 for sure then risk of not getting it at all...

    If you were here on tourist visa without K1 application and without intent to immigrate, I would say: go ahead, get married, adjust the status. In this case there is 99% chance that you would get approved. However, given that you applied for K1 and shown intent to immigrate BEFORE entering on tourist visa, if you get married and try AOS there is 70% chance that you get denied. If you do, they will also deny your K1 visa. I do not feel it is worth the risk. Just return to your country and wait for K1 approval. You will get one for sure.

    It is hard to be tolerant when muslims denounce any othre religion. It is hard to be tolerant when they destroy buddha statue and yet demand respect to their religion not respecting other religions. It is hard to be tolerant when they blow up buildings in US, buses with children in Israel and trains with peaceful people in Spain, and all in the name of the Allah. Why it is especially hard to be tolerant is while minority actually do terrorist acts, majority condone it and cheer. It is hard to tolerate palestinians that cheered on the streets when 9/11 happened. We were tolerant for waaay too long. We refuse to be tr4eated like ####### while treating the ones that treat us like this with respect. I do believe that there are nice muslims. They are just in minority and this is the fact.

    Pretty clear... They tried to get him here to use the loophole of AOS. Let's all be honest with each other and call everything what it is. COs are not stupid. You tried to get him here on student visa, get married, and apply for AOS exploring loophole in the law. They caught it and now you have a problem. You need to be upfront for anyone to give you advice. From your timeline it is clear that you applied for visa knowing that you will get married, right? Why student visa then? This is pretty obvious.
