    I do not understand this. You spent well over $2000 to get this far and you are worried about a $9 passport photo you can get at any Walgreens or FedEx Kinkos? I guess if the photo still looks like you and your appearance has not changed significantly you can still use it ,but if you are questioning it why would you risk not getting the passport over a $9 photo? It is like those people that pay to have the passport expedited at the passport office, but only pay for priority mail because express mail costs $20 more. It is up to you if you want to use the older photo, but IMHO I would not risk it (There is no way they will know how old the photo is unless your appearance has changed).

    You know, I usually give good advice. I recommended you to meet your fiancee in Mexico. Just like I did for 3 months (even though I met her before 5-6 times in Europe). Never in these 3 months I had glimpse of idea to bring her to US.. Our apartment was 3 miles from the border for me being able to easily cross the border to go to work every day. NOW, aside from the fact that you shouldn't of done it (what is done is done) my recommendation is:
    1) Don't listen to anyone here. Advices here are good under normal circumstances. Under your circumstances you need a GOOD attorney. Proceed with caution. Don't do anything else without the attorney. You done already enough.
    2) Get a really good attorney with track record. If you do the right thing, attorney writes full explanation of what happened in the waiver, all documentation is good anf correct, you should BE FINE. The way attorney explains things and how he/she files documentation and timeliness of it is absolutely crucial. Just do it.
    3) Let me know if you need a good attorney, I have one in San Diego that I can recommend. If you need info let me know.

    Crossing a border has to do with immigration. Crossing a border has nothing to do with shopping. The purpose to go shopping in the US is irrelevant. A lawyer would have told you that.
    If you want to educate yourself to do it, then don't just rely on a hotel manager to give you advice on crossing the border. You didn't educate yourself and your fiancée got a 5 years ban. If you had bother to check, it would be clear that a person who has been denied a tourist visa should not attempt to enter the US at a US border checkpoint. Once you're in a car heading into the US, you don't have the option of a u-turn.
    You will not find a single person on this forum who thinks that's its okay to attempt a day crossing after a visitor visa denial. To be blunt, that is just stupid.

    Anti-Semitic attacks in France consist mostly of neo-nazi or anti-Israel punks defacing synagogues with swastikas or arson. This is not the pogroms!! It is not grounds for asylum nor SHOULD it be. Honestly this whole post is ridiculous and makes zero sense. If you aren't trolling and really do have a fiancee in this situation my advice if she doesn't want to go back to France she should go to Israel where they love frivolous asylum claims as long as it's being made by an Ashkenazi.

    Ok, so entered, got married, entered with intent to adjust, attempted to adjust, got lazy and couldn't even go to her own immigration appointment and was presumably denied.
    It doesn't seem as though your fiance has ever paid any attention to immigration before, why now?

    I don't think you should even have a green card. You do not live with him, you are living in your home Country,the only connection here is that he is sending you money, and you want to pretend to Uscis you are a happily married couple, seriously???.We need better people living in this Country.

    As you may or may not know, California is officially the Golden State. As such California has attracted gold diggers for way over a Century. You'll feel right at home here. Weather is nice too.

    I guess my question is how many US post offices or UPS stores will you drive past in that one hour drive to a building that may or maynot accept mail at their door. Since 9/11 most US government offices do not accept mail delivery to their offices unless it is delivered by a reliable agency.
    BTW both of these agencies the USPS or the UPS delivery mail next day guarantee delivery.

    Did you send 2"x2" passport photos? I know that in many countries passport photos have a different format. In Italy they are different, and if you want them "American size", you have to ask.

    Not really. Tourists marry in the US all the time (think of famous destinations like Vegas or the Hawaii). Entering on a tourist visa (or the VWP) with the preconceived intent to marry, adjust status and stay is considered visa fraud. Also, for it to be illegal you should have in fact entered, married and filed for AOS. You didn't do any of the above, therefore you are fine.

    So he committed visa fraud by entering on a visitor visa with intent to stay and now he wants to be able to stay? Not many options there.
    His wife did not "bring him there", he is an adult with his own mind who came of his own free will.

    It's just a matter of waiting for what, 6 weeks? This process is very long and frustrating, and the last thing you want is to be rejected 6 months from now because you were not free to marry at the time you applied. Prepare all the documents and forms, double-check that everything is fine, and then on February 7th send everything out first thing in the morning. This is what I would do.

    Not encouraging. Just stating my experience of no RFE. Vanessa only stated her same experience. The OP gets to read all the opinions and decide. I actually never read of anybody doing just first page when I did it a couple of years ago. It just seemed logical in my mind that page 1 gave them enough info. Same with tax transcripts. The point is is not proving income like an affidavit of support, so page 1 tells them I filed married jointly with my husband and thus another way we co-mingle our finances. Just my logic and opinion and not intended to strong-arm the OP in any manner.
