    Change her visa? To what?
    She can try to change to a tourist visa but that might be difficult for a single (assuming) PI woman who is already in the US and is clearly looking to stay (as in not just visit)
    Why does she want to stay in the US? To look for more work? A boyfriend?

    Keep in mind that a waiver is costly and takes much time- time you could spend being together if you just go to meet eachother instead, plus it would make visa approval more likely too. I have only seen two cases approved where petitioner and beneficiary never met. One was where the petitioner was bed ridden and could not travel at all, not even out of state, and the beneficiary tried to get a tourist visa several times and failed. The other is where their religion expressedly forbid SEEING eachother, even with family/ chaperone present. It was an obscure African sect and they had a ton of evidence of this long held religious practise. Islam does allow meeting your intended, as long as it is done with chaperones, so like the others said, it is almsot certain you will be denied a meeting waiver.
    Travel to a third country, such as Dubai or somewhere in Europe. Both of you can bring a chaperone along.

    Fiance is already in the country and didn't enter with intent to immigrate on that visa, so I don't think it would be fraud as long as she planned to go back before you received the denial

    My wife passed her interview today morning at the Raleigh/Durham, NC office.
    We were in and out in about 55 minutes: arrived 15 minutes early, but then waited almost 35 minutes to be called.
    Interview itself took 15-17 minutes. She's got N-652 form with "Congratulations! Your application has been recommended for approval" checked.
    According to the IO, she should get her oath letter in 2-3 weeks with oath date no later than late August. We'll see.
    The only document the IO requested during the interview was 2012 tax return (she has not submitted it with her form because we have not filed taxes at the time of N-400 submission yet).
    My wife gave him 2012 tax transcript to keep and that was sufficient.

    Any crime that would make him inadmissible if he were applying for a visa would ALSO make him deportable. Simple assault is not classified as a crime involving moral turpitude, and he would not be deported for it. Assault with intent to kill, commit rape, commit robbery, commit serious bodily harm, or with a dangerous or deadly weapon IS classified as a crime involving moral turpitude, and he COULD be deported if convicted.
    Unfortunately, people frequently get convicted in court not on the basis of what actually happened, but rather on the basis of what someone else said.
    I don't doubt that he'll man up and defend you if he's put in that position, but it would be best if you could avoid situations where he might be put in that position. If you go places where people are going to be drinking then go in a group with other friends. You're less likely to be harassed if you're with a group of friends, and he's less likely to end up in a fight if he's not the only person in the group who can defend you. I know it might not seem fair that you should have to change your behavior like that, but the reality is that he will want to keep his record squeeky clean in order to keep things smooth with immigration authorities, and you have an obligation to help him with that.

    I am not attacking you at all. Just curious how this happens all the time. I have advised my friends to keep themselves in positions of power so they don't get in compromising positions, because I learned it wasn't obvious to them. You seem proud of it though... saying "don't mess with me."

    To become a citizen you will need a good grasp of English - be able to read and write in English and also to carry on a conversation in English.

    Brsko - the immigrant from the Philippines comment was not necessary and highly insulting to a Filipina like me. It is not a matter of fortune to marry an American citizen. It just happens that the man I want to spend the rest of my life with is an American. I didn't dream - even once - and aspire to be here. Things just happen. I find the comment about illegals unfortunately agreeable - maybe not put in the most sensitive and appropriate manner but true. I work hard, pay my share of the taxes and I see people I would love to help still having a hard time because the taxes I paid is given out to people who rely on welfare. I entered here legally and feel like I am treated second class when I need to deal with immigrations and savings bled dry. No, it is not fair. I understand her sentiments. I am not trying to start a fight but we all should rethink statements before we make them.

    That's what I noticed at USCIS in SFO. They are not friendly at all. During my AOS interview the officer was sooo serious and not friendly. He told me that he can arrest me if i will not have my green card with me all time. Really????? If only I can talk back to him, I will ask him why they couldn't arrest these illegal immigrants that are walking around specially outside Home Depot looking for under the table jobs and govt even provided them with free food and medical. Seriously? He had the gutts to tell me that he can arrest me if i dont have the gc with me. LOL

    Are you sure? Affidavit of support doesn't come in to the picture until later....
    And they don't actually ask for pictures.... have you seem eachother in the last 2 years?
    Basically, you guys did not do your initial packet correctly, and you get a RFE for missing things, and your reply was not correct either. It would be a good idea to figure out exactly what went wrong so you can be successful next time.

    Conviction on a domestic charge can get an immigrant deported. Its the law, and a good one for the most part.
    You give nothing in the way of details on her immigration status at the time, the charges and obvious conviction, or what you did to fight those charges. All I see is complaints about the police report and evidence and how you're upset your wife may now be deported. Actually you haven't even given the grounds she's being deported under.
    She arrived in June, 2011, did she ever adjust status?
    What was she convicted of?
    Who called the police?
    Did you have physical injuries or scratches?
    Did you hire a good lawyer to fight the charges?
    Has she been called into an immigration hearing?
    Grabbing a knife and threatening physical harm is a serious crime. Removing criminals from our country protects not just you, but other citizens. I can see the point of view of the prosecutor given the little information you've given about how the police reported the incident. I can understand you love your wife, if you felt the police report was incorrect, you needed to fight this as strongly as you could before she got convicted. Now that she is convicted, which I'm assuming since you say you're awaiting her removal, you need to appeal the conviction as vigorously as you can. This isn't about people's freedom, you're not free to bring dangerous individuals into the country just because you love them, this is about the law and how no one is above it. Had such a conviction existed on her record before she got the K-1, she never would have been allowed to enter in the first place. So if you want to keep her here, you need to act to prove the conviction was wrong and get it removed from her record. If she's already been given the deportation order, then you're probably too late.

    Coming to the US on a tourist visa with intentions of marrying and adjusting status is visa fraud, it can carry a lifetime ban from the US.
    The K-1 will not likely take years if your case is straight forwards, which yours seems to be.
    She can come to the US, marry, and then leave. You'd file for the Cr-1 spousal visa in that case, the K-3 is a dead visa.

    When she is this close to her goal why demand the wedding all of a sudden ? That does not make sense to me at all . Why cause problems if she was really scamming you for a green card . Are you sure this is a scam ? I would make really sure before you open up pandora's box . What country is she from ?

    If you truly feel you have been scammed report it. To USCIS and to the US embassy where she obtained the visa. Make sure to give them proof. Cover all bases.

    Dwheels, you are almost on track but the OP must also file I-130 because that establishes a marital relationship. What you quoted is only for people on K visas who already submitted a petition proving a familial relationship.
    So for the OP AOS is $420 for the I-130 plus $1070 for the I-485. Usually this is done at the same time. Unclear why the OP did it separately.

    I do understand where you're coming from, we all do, but I don't think amending this particular law is the way to go.
    Personally I believe the ability to AOS within the US should be removed. There is no immigrant risk if you can't adjust status while in the US. There is always going to be the risk that someone will overstay and try and live here illegally.
    Tracking system of entry and exit is pointless. They've (illegals) already found ways around that system.
    Honestly I would write to your congressman/senator about help getting a visitor visa for your in-laws, rather than trying to amend the law. But, how do you prove they don't have immigrant intent? You can't. Their child is in the US, their grandchild is in the US.
    It might be simpler for her to become a citizen and file for her parents. Once her parents are here then they can return and give up their GC's in favour of visitor visas. This shows they don't have intent and I believe many people had been forced to go this path to prove that there is no immigrant intent, after all, why would someone give up a GC if they had immigrant intent?

    How would you like to pay for this system?
    Wouldn't it be cheaper to stop visa abusers from getting them in rhe first place and keep them out of the US rather than let everyone in and then spend tons of money on tracking down the abusers, building new facilities to process and pay to deport (fly) them back home?
    I mean a thousand visa denials (the cost of a 1000 rejection notices a) is vastly cheaper than teaching down one visa abusers from your track and deport system.
    Also, the current track and deport system doesn't exactly catch all those here illegally. All 11,000,000 people.
    What you are proposing is too costly and doesn't work.
    Sorry, but I can't support your petition/idea because I reapectfully disagree.

    If this is the case, I suggest his wife try and contact the embassy/consulate/NVC whatever it is that she contacted and try to explain her mistake.
    Regardless of the fact that they won't re-issue the visa, the least she could do is try to undo the allegations against him.
    OP, honestly, I don't think being in a relationship with someone that accuses you of such a thing, and then slanders you is a good thing, but that's your decision to make.
    This wasn't just a rash decision, it was an INSANE decision.
    Make sure you two both spend some time together and talk about this and work through your issues before you try to move forward filing again.
    You don't want to go through that happening a second time, it would DEFINITELY be a no forever if it happened again.

    Visas are for purpose of getting into the US. Since you're already here, you don't need any visa to get married.
    After marriage you will be eligible to file for Adjustment of Status based on your marriage to US Citizen.
