General Question about work visa's

Hi...

I am looking for some information for a friend...

She is a filipino who came to the us on a work visa.. however last year her work visa expired and her employer had decided not to renew it.. my questions are

How can she stay in the united states.

does she have to return home

can she file a ajustment of status to change her visa

and generaly what are her options

If you can help with any advise it would be greatful

Generally, she has 30 days to return home if the visa gets cancelled/ not renewed. Some visas would allow her to "transfer" to a different employer- what kind of visa does she have?

Adjustment of status to a greencard is unlikely, unless she has close family here?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Change her visa? To what?

She can try to change to a tourist visa but that might be difficult for a single (assuming) PI woman who is already in the US and is clearly looking to stay (as in not just visit)

Why does she want to stay in the US? To look for more work? A boyfriend?

First what work visa is she on?

If the visa expired last year, how was she in the country until now?

There is no Adjustment status for her, the only thing she can do is apply for tourist visa and if that gets approved max she can extend her stay by 6 months.

Your friend has overstay her work visa, so her chances of getting a visitor visa or any other visa is zero.

Her only way to become legal is marriage to a US citizen.

If she had left after her visa expired, she would have the other options to be legal in the US. Once she violated the terms of her visa/last admission, she pretty much screwed.
