She will need to be domiciled in the US, and it seems she has not got a US Domicile, the only thing you mention is a US Passport. I remember at a young age I was able to be added to my Mother's passport and travelled that way so it sounds logical.

That is quite interesting, I had not thought of the Insurance aspect, I think I had assumed that due to the nature of the incident it was not an Insurance issue. Seems 4 of their insurers are taking the same view, one decided to pay $1m and walk away. It was a deliberate act, intentional act, repeated by their Management. If the issue had been covered then the Punitive Damages would have been, which is unusual I thought. I can only imagine the difficulty their Broker had finding markets for their cover and the cost.. I doubt any of their then Insurers are still on board. Any Underwriter in this market is going to know about this case and it will be a long time before that goes away.

To immigrate will take longer than 7 years, for those entering now it 8 years and the wait is only going up. She could try for a visitor visa but that may be a long shot.
