Well they will both be Visiting, I am not sure how a Court will deem that they can claim Georgia Jurisdiction, now if somebody for example entered the US as a tourist and decided to stay then at some point they are resident for State issues, not sure when that is. If it was that easy well lots of people would do it, get those US Court settlements!

I can think of cases where there will be proofs, for example you are going for Medical treatment and need to show the medical documents and evidence you can pay for treatment. Business trip maybe might have specific documents. They do not ask for documents at the time of the interview usually as they are not relevant and/or impossible to substantiate in the context of a B interview. If there was some magic additional information the sensible place to ask for it is in the DS 160.
