    I had my interview today and 30 min beforehand I got a call from DHS telling me they don't have my I-751 decision so we cannot proceed. I said I was on my way and had the approval notice and 10 year green hard in hand (received approx 6 months ago). They said ok in that case I can do the interview. I passed my civics exam but they said they cannot approve my application until they receive the official paperwork that my I-751 was approved (I even brought screenshots of my USCIS account where it says my I-751 was approved in December and the card was mailed to me). The officer said he couldn't give me a timeline on when this might get resolved and to just be patient. Has anyone heard of something like this? I've never read of a similar case...

    I should have interview today in Chicago office. Got a call this morning from them, saying that  it is canceled and the building is closed - water and electricity issues.
    Didn’t believe it, so went there to check it. Yes, it is canceled 😕

    Got my Interview Notice "On March 24, 2022, we scheduled an interview..." on May 10, 2020. 😀

    I also went and looked back in the post history and something isn't quite right. In 2019 you posted that you were the immigrant and Deb was going to be filing either the K or CR. Now you and Deb have a duck farm and she is in a detention center and you are the USC who can rescue her by a quick zoom marriage but the problem is the ducks. They will have to be sold to free your love from jail. Umm. Any thoughts from the mods?

    I try to show as much empathy as possible since being on this board and with the entire COVID situation.  However, for some reason, I dont have any empathy at all for the OP.  As far as I understand from the quick read of the thread, the OP's fiance or gf has overstayed for 2 years, which would be the entire length of this pandemic.  Canada has not been closed.  For the longest of time, you could have flown into the country but not crossed overland.  There were ways to get back.  Im mainly in the Philippines section and those couples (especially K1s) are going through pure h$ll.  Many of those couples have not seen their significant other for 16+ months, many others are over the two year mark now.  They have followed the rules, they have put their relationships on the line with the distance, the inability to even see each other with that country basically closed off to most foreigners.  I converted to Buddhism about 25 years ago and that red light to me is called karma.  Hopefully, though, things will eventually work out for the OP.

    They divide parents and children.  They aren’t going to think twice about you getting married after y’all got caught.  Way it is.  
     
    You pay attention to that lawyer and what he/she has to say.

    Red light didnt ruin your life.  Choices did.
     
    Catch your snap.  You need to sit down with an immigration attorney, a good one, and listen to him or her read from the book.  You got a long road coming up and you got to pony up for both of you.  Big chance that road is a dead end.
     
    Marrying before you’re caught puts you on a path to a waiver.  Marrying just after?  Man that looks bad.  That looks like marrying for immigration benefits.  This is a deeper hole than most of us can help you out of.  I hope y’all work out.

    Actions have consequences, and getting married won’t escape these.  Proving “extreme hardship” for a waiver isn’t easy and it isn’t quick.  Sorry bro.  Tough break.
     
    There IS a waiver process but it’ll take awhile.

    It’s better to do things the right way, even if it means temporarily being part.   Most of us here have had to do that.

    A person who has been banned from the US for 10 years can not renter the US until either the ban has expired or he/she obtains a waiver approval.  Marriage, in itself, does not confer any immigration rights.

    Unfortunate choices were made.   You might have to petition her for a visa and wait your turn, just like the rest of us.
     
    Funny how the party line on VJ is that overstay is without consequences.   Until it isn’t.
    You ‘feel’ like that, and yet US immigration law clearly says otherwise.

    Nope, marriage by itself to a US citizen does not automatically provide any immigration benefits whatsoever. The fact is that she was here illegally. She became deportable the second ber overstay started. She could have filed for an extension to buy a little time or married you and filed the green card papers or gone back to Canada and just deal with the separation time like many people had to. It is what it is though. Consult a lawyer ASAP. If this path doesn't pan out, then your only choice is to move to Canada to be with her.

    Wow you must not know much about immigration if you think they will be on welfare system. Family based visas have a huge support system and have to prove that will not be on welfare to get admitted.

    My wife suggests creating bullet points beginning with action verbs to show achievements or even responsibilities.
    Even if your only experience was at Starbucks, action verb it—
    Provided excellent customer service by learning customer names and favorite orders. Supervised a shift of three to seven employees per day. Organized stockroom supplies to facilitate maximum work flow. Trained new employees  Maintained health, safety, and sanitation standards by.... Google “action verbs in resume” to find many examples. 
     
    Don’t include what I have seen on UK CVs—-
    Hobbies and interests- knitting, long walks in the woods, poetry writing, rock concerts

    People, it is irrelevant what "he should of", "would of" "ethical" "unethical". What matters what can he do know? It is pointless to go the the attorney. Medicaid will never let you get away without paying even if it was their fault. And the reason for it is that they would never want to set precedent that they let someone (anyone) slide. If you are ineligible they will make you pay back. Period. Bankruptcy will not help because this is now federal debt. The best thing you can is work-out most favorable payment schedule and start paying back. And it does not matter who is right or who is wrong. Life is unfair and you have to deal with that. Federal government can truly turn your life into the nightmare if you don't: they will follow you, harass you, follow you paychecks, you name it. They will collect their money, o just do what people advising you.

    Hatem - not knowing the rules is not an excuse.... what the person said is fact, you came here for the opinion and answer and thats what he said.
    You were not eligible for the service, you should have known that... thats your responsibility.
    You received the service and now you are responsible to pay it back.

    That's the thing. There a lot of people who sign the AOS but don't read the conditions or they read & comprehend but say 'Pssh'. These same people either end up on the book for thousands of dollars or know with some pinching they can avoid means tested benefits but don't because it's Freeeeeeee.
    Anyway Mr 'in a bit of trouble' just save whatever evidence you have that you in fact didn't claim your LPR wife is a USC so that you can more easily resolve your Medicaid issues and in the long run have her still be illegible for Citizenship. As mentioned before a guy claimed citizenship on a federal job app after he passed the test but before his Oath ceremony and now the sh*t is up to his eyeballs. You don't want this problem.

    I don't think this person was judging you at all. This person was simply stating what others have said: Apparently you should've not applied for Medicaid in the first place. Your wife is not eligible and you signed an affidavit of support with a garantee she won't become public charge (within the alloted time). The most important issue this poster pointed out is the misrepresentation. Again, this is not a judgment. It is the truth. It is great advice you should follow meticulously. If this worker made that mistake, what else this worker did? I'm on your side, you're a victim of the stupidity of an inept worker. That said, if your wife decides to become a citizen and this comes out to bite you in the butt, she could be deportable for misrepresentation.
    I saw a case here of someone that marked 'yes' as being a US Citizen in a job application. That was the day BEFORE his oath ceremony. Poor man is going through deportation procedures. It is horrid and just cruel, but the law is the law... unfortunately. Follow up and save every piece of document regarding this case. And yes, call and schedule a payment plan. Make sure your co-sponsor- if you had any- isn't liable for this bill.

    I know this isn't going to be a popular point of view but I'm not sure if you can appeal. The I-864 that you signed says that you are liable if your wife goes on public aid. I think this is the sort of thing that the government is protected against. I'm sure that someone with more experience can offer better info and perhaps some options.
