    not sure why you think I was attacking her. We went through the i130 process together. It wasn't an attack. Not cool! I was actually agreeing with her. She took a beating from the nvc . I know her story. Smh

    Nobody said congress created the one year extension letter. More than likely it was created internally to deal with the overflow of ROC apps. Just like how they start transferring workloads to different service centers to balance it out. It is a patch. When Obama passed DACA, the processing of the i130 petitions went to a crawl so they could focus on the illegals. A huge amount of VJ members tried to draw attention to the issue. Nothing helped. Our I130 took 11 months because of DACA. Contacting my senator did nothing. I sent numerous letters to the USCIS. Their focus was DACA. It was a slap in the face but they didn't care. I personally don't care how long my husband's ROC takes. He has a license but can walk to work.. His job will not be impacted and if it does....I don't care. I know that trying to change the broken immigration system to suit my needs will never happen.

    I love this. Couldn't agree more. I have always thought that if you get a greencard based on marriage, and the marriage fails then your greencard expires on the final divorce date. And no exceptions and no waivers. That will do away with marriage fraud.

    There really isn't a current thread for progress updates for the I-601 waivers. I wanted to start a thread where everyone can just post their progress. If everyone could create a timeline and put it in their signature it would really be helpful. It doesn't matter when you filed. Any reported progress really helps everyone along the journey !!

    They send a letter extending your greencard while it's being processed. Once they process your paperwork, you'll get the 10 year greencard. May I suggest reading some threads and doing a few searches on vj.

    Anytime somebody adds to your electronic file the date will update. That's a good sign. It means it's being reviewed. If the status says ready then I'm sure you will be notified when everyone gets back from the holiday. Ready means they can print your visa. They kept your passport so they can put the visa in it. If they weren't planning on approving you, they would have returned your passport to you. Good luck and happy new year

    My husband is here. He didn't have any issues at POE. He was actually outside waiting for me at the airport. I can happily say our long journey is over. Good luck to all who are still waiting. I definitely know how you feel.

    When I said could be deported I meant from the banks view point. It doesn't matter what the real truth is, it's the banks perception. They don't know immigration.

    It has nothing to do with immigration. It has to do with financing. They want to verify your income. If you don't have a valid greencard, you could be deported and they run the risk of never getting paid...and then you are buying a high prices luxury vehicle which probably has other guidelines they need to follow. They also don't have to accept a stamp. They make their own rules. If you want the car then you have to follow.

    Yep...impersonating a USC is a lifetime ban. I don't think there is a waiver for that. How has he been paying/filing taxes? With his friends social security number? Filing jointly with his wife?

    my husband just immigrated this past January. The embassy told him that he MUST live in the US for at least 7 months out of the year to keep his green card valid. If you stay outside of the US for more than 4-6 months , they will assume you have abandoned your green card. I am not sure what happens after that.
    Also, you mentioned you make $3000/ month over there. You would still need a co-sponsor because the USCIS requires US income.
    IMO, if you show leases and employment letters to the embassy, I would think that would be enough to show she has strong ties in Vietnam and only want to visit. If you get the B2, then you can travel back and forth to visit for 10 years as long as she doesn't overstay.

    the 10 year ban will start as soon as you leave the US. Your Visa will be cancelled. . You will need a waiver to return or wait out the 10 years and re-apply for a tourist visa. You cannot petition for family members when you are in the US on a B2 visa. Its a tourist Visa. You get to visit the US... that's it.. its not a free-for-all to bring family members here.
    No sympathy from me either btw. You overstayed, you have to go home. I don't understand staying 7 years and now wanting to find a way to stay AND bring your family too? NO NO NO
    My husband overstayed his B2 visa. He had a 10 year ban. We had to fie an I-601 waiver so he could come back. It was expensive and it took a while. I don't see any options for you to even get a waiver as you aren't even married to a USC.

    That is why I suggested notifying the uscis that she no longer lives in the US. You are obligated whether you are married or divorced. She has to surrender her greencard or become a USC or complete 40 quarters.

    Just inform the USCIS that she has moved back to her country and has no desire to have the green card. They will assume she abandoned her residency. Put it in writing and call. That will also remove your affidavit of support obligation.

    Still need waivers. And the arrests will still show up in the background check. You kind of shot yourself in the foot by running off to live in Brazil. It doesn't really look like a hardship . do you work in Brazil? Do you speak Portuguese?
