We have had the same situation except we received a second NOA1 before this status change as we (rightly) assumed the first one got lost in the post after not seeing it after over 30 days of waiting so we really didn't need this...

We have now had to call UCSIS about this as we have also been told our application will be cancelled in April if we don't do anything.

There are ALOT more people than you think with this kind of status change so don't panic.

We are currently waiting on some correspondence and our issue has been assigned to an officer as the form has been filled out twice by USCIS agents on the phone but nothing come through and we know for a fact it isn't our address. We just want our status changed back since we have a copy of the NOA1 already.

Just call every 30 days like they ask you to. I am sure it will be changed back to 'case received' in time. If they do cancel despite you following instructions, it's not your fault it will purely be theirs and I am sure that will be grounds to expedite a new i-129f...

The right thing to do is to follow their instructions.  But if you use the uscis online chat or call USCIS (ask for infopass to talk to a rep), although they will not tell you the address on file, you can give them your name and address and they will verify if it matches. This might give you a clue as to what might have happened.

Did you move and not update your address. How long ago did you submit application. Usually comes in 30 days.

I don’t think you have to be concerned. You have a case number and that’s really the important part.

@Mike E is correct, if the Filipina mother is single, she has full custody of her child and the biological father has no say if she can or cannot take the child to immigrate to the US.

On the desktop site, scroll down, down, down and you'll find the Philippines forum.

After the visas are granted, the mother and child will also need CFO stickers/certificates (Commission on Filipinos Overseas). Without the CFO clearance, they will be blocked by PH exit immigration from leaving the country. You can find plenty of information on the CFO in the Philippines regional forum

Pretty sure that in PH, a biological father of a child born out of wedlock has no rights. The Philippines  forum on visajourney will know for sure.

After their 2 year green cards are issued,  ideally the “resident since” dates on both cards are the same or if not, the kid’s date is 1-90 days newer than mom’s. If so file a single I-751 for mom, 90 days before her gc expires and note that the kid is removing conditions with mom.

If the kid’s resident since date is before mom’s this is a cluster, and not DIY.

If the kid’s resident since date is 91 or more days after mom’s, a separate I-751 is required. While this is can be DIY, mistakes can put the child in deep peril. So deep that child will be faced with removal. Legal representation is in the interest of the child. K-2 is the most dangerous visa for child.

Well I appreciate it. Kind of my only option right now. I am not made of money. I understand what you're saying, that the process is actually far easier and cheaper, and probably takes less time now, that's not what I was inittially told. So that's why we have started the K-1 route and we're about elbows deep in it. Just waiting to get her daughter's passport and I was going to file. Simple citizen has been pretty good so far.

Yeah I just found this website and sent it to her. You guys are pretty awesome so far and has actually given me a little hope back. Why the does this site not come up on any search engines? got this from a reddit post since I wasn't having any luck on facebook groups, youtube and searches. Forgive me, I'm not the best on forums, I actually hate them lol. Thank you guys again for your fast replies. I have had a horrible morning.

Kind of where we're at right now. no other option. We're actually using simple citizen to go over everything for us. We have so many question on the k-1 process it's not even funny. Basically I understand I have to file my i-29F, but after that I'm completely lost. We don't know anyone that has been through this to ask any questions too, so here I am.

if we state the purpose of her trip is specifically to see me and for evidence for the k-1 fiancé visa, is that acceptable? I know that is a crazy questions, but it's kind of the purpose of the trip.

So does the fact that she has a daughter/sisters/parents back home, does this not qualify for return?
If we have a bank account with money in it, would that help? I know her having a bank account is required.

Given your travel situation, I would say just got for K1. You already have the necessary evidence to file right now.
I understand that people are saying that spousal is better than K1 and while that is true because of skipping some immigration steps which saves money and time, these benefits might not be good for you because 1) you have to fly back in to the Philippines to get married, which you are not keen on doing; 2) I doubt if not being able to work right away matters to you guys because you are already supporting her now, there's no rush to get a job after entering the U.S.; 3) The time of not being able to do anything on K1 because of lack of AP and EAD can be used to adjust to the U.S. and gather all the other docs as well. I know that they say that sometimes, there are problems with getting any done when one entered in K1 but some people was able to do things without any issues (like me).

Forget about the tourist visa. She has very slim chance of getting approved. It's going to be a waste of money and time waiting.

So yeah, just start the K1 now
