Exactly correct.  Ignore that message, in your situation.

Thanks for the responses everyone. Luckily ID.me support got back and verified my account after 2 weeks of waiting, so was able to get my transcripts. Issue solved.

Note for other readers: Don't use a VPN when verifying with ID.me. They will suspend your account.

You can also get your return transcript by paper letter in the mail without using ID.me at https://sa1.www4.irs.gov/irfof-tra/start.do .

Do your best to obtain a proper copy of IRS tax return transcript from IRS website.

You can submit Turbotax return transcript, but don't.get suprized if you get an RFE down the line.

What's the problem with id.me? It doesn't verify you? You may need to speak to their support. I had some issues getting verified, it was annoying for sure.

The instructions and anecdotal evidence are both very clear, that a complete copy including W2 and applicable 1099 forms are acceptable......OR, the tax return Transcript.  If you want belt and suspenders, request the transcript by another method and have it ready at interview time.  NVC will NOT send an RFE for a Tax Return Transcript.....IF....they have the other option already.  A Consular Officer MIGHT, but not NVC when done correctly.

Definitely not required to attend the interview.  Manila used to allow it, but I don't think they do anymore.  The time you've spent living together in the Philippines is going to trump any other relationship concerns.

For other readers, it is quite uncommon for the US Citizen to even be in the same area of the building as the location of interviews, mostly because there isn't enough space.  It's the applicant's interview.  In most cases, the petitioner is not even in country.

Yes, you qualify.  In the tax section, enter the total income figure from the tax returns.  State your current income as the same as your offer/transfer letter from your employer.  One current pay stub is sufficient, as it will show your year to date income anyway. That your father owns the business is not relevant, as long as all is true.  The offer letter is all the domicile evidence you'll need.

Officers, often forget or are simply not aware of changes in requirements.  We see requests for things from both USCIS and NVC, that are definitely not required, like signatures on I-130a forms from USCIS, or W2 forms to go with tax return transcripts.  Still low reward, and high risk, in my opinion.

No longer supposed to be required, does not mean you won't face delays because of government employee mistakes.  It is always my advice to make it as difficult as possible for the employee to screw up.

Update: I researched more and found this announcement:

    https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/visas-news-archive/20161228_ink-signature-no-longer-required-on-affidavits-of-support.html

It looks like wet ink is no longer enforced and wouldn't result in rejection.

    Taking my words back @BLC!

    Please read instructions:

    https://www.uscis.gov/forms/all-forms/tips-for-filing-form-i-864-affidavit-of-support-under-section-213a-of-the-ina

"6a-b.You must sign and date the form in black ink. The signature needs to be original (not a photocopy)."

Essentially, you did not follow the instructions. You got lucky nobody at NVC flagged it. Technically, anybody signing with stylus / digitally is violating instructions, which can result in form being rejected. I wouldn't risk it for such a low reward (2 mins to print, sign with black ink and scan the document).

You will be fine signing electronically. We didn’t print and sign ours, just signed electronically like you mentioned..I actually did it with my finger, not even a stylus, with adobe sign …we didn’t have any problems and it was accepted on the first submittal. DQ back in end of August this year, visa issued last month.

I sent an email to the Embassy attached with a letter from my employer. They gave me a cookie cutter answer that DCF was only for exceptional circumstances (even though mine fell under the definition of that on their site?). So we ended up filing through USCIS. This is with the US Embassy in the Philippines. Other Embassies may be different.

If the ITIN is issued, that is a positive sign since the return can be filed by the IRS after that. In my experience we got no further notification after receiving the ITIN letter and returned original documents in the mail. Although we were owed a refund, the "Where's my Refund?" page did not show anything until right before the refund arrived, ˜9 months after getting the ITIN.

However, the IRS was working through a significant backlog at the time that may (?) be slightly better now.

There may be a way to call to check the status of the return, but the only call I made at the time was to check the status of the ITIN once it was past the published processing time from the IRS website (currently 7 weeks).

For your first question, when submitting the paper 1040 with form W-7, I left my wife's SSN blank as the IRS will fill in the ITIN once assigned.

Edited to add: I would certainly not put "NRA" instead of her first name. Remember that you are also required to submit a statement indicating the choice be considered a U.S. resident for tax purposes, so putting NRA (=Non-Resident Alien) anywhere does not make sense in this case.

For the second question, in 2021 I sent the return and W-7 to Austin before the filing deadline and without filing an extension, and had no problems in spite of the rest of the process taking over a year.

Not sure about your third question.

Here is a relatively recent thread specific to Manila.  Not sure if it is helpful, but the main thing is getting in touch with the Consulate, explaining the situation and having proof of the immediate need for repatriation.

    Good Luck!
