  1. I'm not a native English speaker, but to me "by" = "before". And "before" is not "on" the day. I guess wording could have been better. The best shot OP has is to mail everything today with post mark showing today's date. But again, wording in USCIS letter says they should receive it in the office by June 4th. So it's already late. It's unlikely petition is going to be revived. Motion to reconsider is also pointless. New N-400 petition is likely needed.
  2. So this is the only potential issue I could think of. It's unlikely going to be a proble though. There are very rare cases when officers interpret marital union requirement super strictly. In any case, you can always apply on 5 year rule if this petition gets denied.

  4. @TravelingLilly do you satisfy physical presence requirement for naturalization? E.g. "must have been physically present in the United States for at least 18 months (548 days) out of the 3 years immediately preceding the date of filing the application."
  5. In my understanding it is any time before June 4th, 12 am. So perhaps June 3rd, 11:59pm was the last opportunity to upload. Either way you got too close to the deadline. I think you should have replied at least 2 weeks before the deadline. This all looks like you have to reapply for N-400.

  8. Can you please clarify? 1) Are you a US citizen? 2) Are you married to the "ex"? 3) Did you sponsor "ex" for Green Card? 4) What solid evidence do you have of her committing fraud?

  14. 20 months is pretty normal wait fine nowadays. You may / may not get approved within the next 6 months or you can go ahead and file N-400.
  15. Or WoM, which is more expensive. If end goal is naturalization, I concur, N-400 is the way to go.
  16. One way to attack it is to hire a lawyer to do full analysis and if OP is indeed not a citizen, write a letter requesting USCIS to justify how they came to conclusion OP could be naturalized before 5 year anniversary. Get some action, perhaps another oath and new certificate?
  17. I heard of cases other branches (DoS, SSA) are not happy and ask to reprove somebody's citizenship. In many cases people don't have certificate of naturalization and get stuck in limbo. This is a more interesting case. Hopefully OP's certificate satisfy any questions raised. But if DoS for example, insists OP is not a citizen, and USCIS says they are, it's an issue that's hard to resolve.

  19. Yes you did naturalize early, unfortunately. It may never be a problem. But it may become whenever you try sponsoring somebody else, or many years later when renewing passport or trying to get social security benefits. We just don't know for sure. The lawyers who said it's not an issue, did they put this in writing or was it only verbal affirmation?
  20. Employment in family business is pretty much unemployment in the eyes of many officials. And if you can't even produce paychecks that just confirms that perception.
