  1. It's a complicated case, but it's possible to get approved. Treat it as a new relationship. Don't rush into filing CR-1. See each other few times, make sure you really want to be with each other. After few visits and marrying you, she can file CR-1. P.S. when was the divorce with her finalized?
  2. Everything is not necessary but it makes case a lot weaker if ignored. Mail can be delayed, lost in transit when using foreign location. And you said, not everything can be sent overseas. I gave the best advice that reduces chances of issues and leads to approval. I wouldn't give advice that has 50/50 chance of working. Good luck!
  3. Hopefully, USCIS will actually reschedule it and don't forget about it completely. It happens. You are free to travel if you wish, we're just giving you heads up on what might happen. USCIS is pretty good at quietly messing up cases leading to denials and months of stress.
  4. I wouldn't trust USCIS phone support. Their job is to tell you whatever you want to hear and get you off phone ASAP. Many people get in trouble listening to their advice. They're not held accountable for anything they tell over the phone.
  5. That's why it was urgent to go ASAP. You'd have more time to fix it. I'd try going to a different location, maybe they're better. I don't know if you ever dealt with SSA, for example. Location A may find reasons not to give you services, so you have to go to location B and eventually get it resolved. Good luck!
  6. Why do you need these documents? Usually for most petitions, birth certificates, passports, marriage and divorce certificates etc are needed as evidence. Have the same question as above... What case are you filing?
  7. No it's not OK. This looks suspicious and rightfully so. Most likely you'll receive a denial based on this scenario.
  8. If her own income is way above required minimum, say 50k+, her income alone is sufficient.
  9. Do you still have I-751 extension? Is it valid for 48 months? Is it expiring soon? Yes, you can get I-551 stamp in passport if this extension runs out before you naturalize.
  10. Household size for brother (joint sponsor) is currently 3 due to him listing parents as dependants on his taxes. For each I-864 his household size will be 3+1, where 3 is current size + 1 immigrant. This is my understanding, others can correct me.

  13. You really are in normal processing time. Especially for 3 year rule case. Especially if you have pending I-751. 12-15 months is a normal timeline for N-400. Yes, some people got lucky and got naturalized faster in 2024 due to elections. This is all behind, so I wouldn't worry until you hit at least 12 months mark on N-400 case
  14. Agree on this one. I'd let dust settle. I disagree with this. Staying in broken relationship for immigration benefit is pretty much fraud. If marriage is ending, divorce is a better and cleaner option.
  15. The I-751 is designed to be filed in the US. Issue #1 is GC holders are expected to live in the US. Issue #2 even if temporarily living outside the US, LPRs are expected to maintain ties to the US including residence, ideally (rented or owned) Issue #3 for mailing address, US address preferred. I don't believe USCIS is going to send mail internationally. From what I saw, many filers in your position use a good stable US address for Mailing Address (not for physical), such as their parents' or relative's house etc.
  16. Passport is what allowing somebody to fly. One cannot fly internationally on GC. Who looks at GC? US CBP Preclearance? Sure you'd show Canadian passport upon check in to airline and GC to US authorities.l futher in process. One should book tickets in passport name IMHO.
  17. This question deserves an analysis by lawyer. I would say the rules under which you got J-1 still apply to you. But I'm not a lawyer though.

  19. I don't see a problem putting petitioner's name and last name, then using space for both questions about petitioner and beneficiary as you list part number and question for each answer. If petitioner or beneficiary need to use entire page, you can make few copies.
  20. Do you need extra space? This section can be used for information about petitioner or beneficiary if there wasn't enough space on prior pages. For example, if petioner or beneficiary moved too many times, they may not have enough space to list all addresses on prior pages. You'd use this part 8 to add additional info. You can leave this section blank unless you need more space for questions on other pages.
  21. It all depends on your risk tolerance. Besides potential misrepresentation for AOS, you can also always be denied entry to the US by CBP on any trip while on visa. US CBP has full authority to check your phones / laptops etc. I'd imagine you'd have some photos from wedding or chats discussing it? I wouldn't risk it. Nobody can guarantee safe reentry and no problems down the line.
  22. I'm sorry about your loss. Passport is what allows you to board the plane. GC is what you need on US soil to enter the country. This is the right approach: After you land in the US, use your GC to go through border control.
