  1. Atty was correct in that waiver cannot be submitted prior to interview/finding of inadmissibility/refusal letter w specific sec of law for finding. Keep looking around ..you can try for a cheaper “ evaluation /assessment “ type of consult …maybe even 2 or 3. Ira Kurzuban is wrote the leading authority ..he writes the Bible of crimigration. 😂 You can hone your skills by reading through USCIS appeals database https://www.uscis.gov/administrative-appeals/aao-decisions/aao-non-precedent-decisions and FAM https://fam.state.gov/fam/09FAM/09FAM030204.html
  2. I like your healthy mindset ..about possible outcomes of interview . Nice set of lawyering skulls too 😂. So ler me cheer you on as well. Hopefully the conviction record contains no surprise language /wording and you’ve combed through it. So let’s wait and see ..here’s some reading in the meantime , note waiver is available. https://www.ilrc.org/sites/default/files/resources/immigrants_marijuana_may_2021_final.pdf https://flynnhodkinson.com/inadmissibility-based-on-a-criminal-record-involving-marijuana/ For immigrant applicants, a waiver is only available if the conviction was for simple possession of 30 grams or less of marijuana. A waiver may be granted in one of two situations. First, if it can be shown that a US citizen or LPR spouse, parent, or child would suffer extreme hardship if the applicant was refused a waiver. Alternatively, a waiver may be granted if the offense occurred more than 15 years ago, it can be demonstrated that the applicant has since been “rehabilitated”, and his or her admission to the US would not pose a safety risk.
  3. I hammered my point because I empathize with you and your children…I have no regard for your fellow who couldn’t be bothered to research the pot issue BEFORE his first interview…let alone the 2nd At least acknowledging that you understand what all those engaging you have tried to explain repeatedly. If I was rude, it was unintentional . Was a bit harsh but with good intentions, so don’t take it to heart.
  4. To get his visa , he just needs to get through /or go in person to the doctor that did medical and EVEN if doctor has never helped anyone before ..they make a few calls and figure out the protocol I won’t go down the Woeth Him..sad story . 12 step groups /meetings ARE available on ZOOM and are everywhere . ..where there are drugs , there are people helping each other .
  5. You need to try and understand what I have now repeated over and over . ..IF you want to bring him here. He HAS to establish and schedule his REQUIRED 4 drug tests ..every 3 months . The testing MUUST be done through the SAME panel physician. ..or one of their partner labs . I know you tried calling them ..but you can’t stop trying . Contact your congressman and have them reach out to CDC or licensing authority . Your finance CAN also go there in person and get his drug tests scheduled BY or THROUGH them as well as get a COPY of his 2 failed medical exams. These are the things that CAN be done and if you give up …then you will waste another year … I don’t think I am getting through to you but am puzzled as to why not .. someone please try and simplify this for OP : 1. INSIST and do what it takes to communicate w medical clinic 2. Make sure he tests ( ONLY where clinic tells him ) every 3 months
  6. Me…I like hugs . .. Republicans and Democrats increasingly critical of people in the opposing party Increasing shares of Republicans and Democrats ascribe several negative traits to members of the other party. And there is a similar pattern in views among those who lean toward the parties but do not identify as Republicans or Democrats. https://www.pewresearch.org/politics/2022/08/09/republicans-and-democrats-increasingly-critical-of-people-in-the-opposing-party/
  7. Ay ay que dolor es el Amor 😂 Woman with a Future found Love with Man with a Past . The MX attorney likely said If Nothing Shows up ..why tell …😂 The 27 grams is encouraging ..30 gr being the magic no What was the maximum sentence possible when he was convicted ? The link I sent you had tables from 2009 and mentioned a simple possession could end up with anything between 10 montjs to 3 years ..plus at that time only 5 grams allowed for charges as personal use ,.anything over was different . The US attorney who said no waiver available..is way off. An I-601 is available for the marijuana exception ..if they find inadmissibility. A good attorney could have ( after collecting a nice fee) sent your honey to the interview with a G-28 and a Loud Legal Brief arguing for the exception. Though I empathize with your long wait …your frustration is misdirected 😂 Be mad at Cupid not the Consulate
  8. Well ..MX had a funky criminal justice system as it related to drugs with municipalities and states and federales all involved .. But you really need to have them looked at by US immigration attorney with experience …unless YOU scoured the records and are versed in US law too. ..and are sure both the amount and sentence term will fly as a petty offense exception https://www.wola.org/sites/default/files/downloadable/Drug Policy/2011/WOLATNI-Systems_Overload-mexico-def.pdf
  9. The tests MUST done through the same Panel Physician /doctor . So you can’t afford to get frustrated /discouraged . Keep at it . Try reaching out to your Congressman and ask for help with forcing a response from Panel Physician . I believe they are licensed through CDC to do immigration exams ..so get help to complain about their lack of accessibility.. Google your congressman , fill out authorization form and email them a copy of your DL to prove your love in the district . Dont give up Your fellow will need to fund his way to a 12 step group ..to improve his chances of success with the visa and your future together. I know you and the children really want him here ..but understand that addiction is a heavy burden on the addicts family.
  10. I will defer to your research ( or staunch belief 😂)
  11. Yes to all . You now have clarity , full speed ahead Good wishes
  12. Ah well..there are odd laws throughout our great US of A ..CA has some doozies 😂 STRANGE LAW BY CITY: ##Carmel: In Carmel, a man can’t go outside while wearing a jacket and pants that do not match. In Carmel, women may not wear high heels while in the city limits. https://www.sevenslegal.com/criminal-attorney/strange-state-laws-illegal-california/587/
  13. The embassy will not walk you through this . The information has been out in the open , so to speak . For example , the link I sent you earlier that has the doctors info , also has links to CDC and actual rules /guidance for those doctors …they are called Panel Physicians..and here is a relevant part on pot /cbd, under mental health https://www.cdc.gov/immigrantrefugeehealth/panel-physicians/mental-health.html#cannabis Therefore, at this time, applicants who meet criteria for cannabis use disorder with the use of cannabis and/or any of its derivatives, including CBD or THC, are inadmissible and must be in sustained remission in order to be classified as Class B for travel clearance purposes.
  14. As I said , start communication with the clinic he has medical exam. Link below has all doctors and email address . Write an email in English and you can try Google translate if you run into difficulty . I am not sure why YOU are co signing his BIG mistake “ we “ thought it was ok to smoke it til Aug so he can test clean in Nov (??) “ as that implies he EITHER also had to lie about last time he used or told the truth and he is back to square one ..another ONE year ban. He is lucky to get a chance as Feds frown on immigrants and any drug use ..pop culture notwithstanding https://travel.state.gov/content/travel/en/us-visas/Supplements/Supplements_by_Post/BGT-Bogota.html
  15. Only your wife can file the N-400 application at this time ‘ 17 year old does not qualify, so she simply waits. If mom takes oath before she turns 18 ..she derives citizenship and can apply directly for a US passport. An N-600 is a great investment at that time as well If mom’s oath ceremony is after she turns 18, then she will do an N-400
  16. Contact the clinic where he got his medical and ask if they do the required drug testing ( every 3 months)..they will refer him to acceptable lab if they don’t do it in house. I suggest YOU do this ..( don’t leave it up to your fiancé . Also ask your fiancé for a copy of his medical to see if he tested clean… You should also ask of both clinic and consulate if the refusal is based on failure to do the testing … Do you think your fiancé was able to stay clean for entire year ?
  17. 😂 Trump: ‘May they rot in Hell. Merry Christmas’ It was one of several Christmas messages on the former president’s preferred social media platform going after President Biden, special counsel Jack Smith and other political opponents throughout Monday. https://news.yahoo.com/trump-may-rot-hell-merry-232118336.html
  18. You can book airline tickets with a 90 day guesstimated departure date …prepare yourself ( anticipated airline fee) to either advance or postpone the flight date ..to accommodate getting the passport waiver and visa in hand. Good luck , sounds like you are almost done!
  19. True ..unlikely vetting a Dutch school record would end up as the described I , however , am on my 6 th failed attempt at Dutch baby / kuken spec ( unrelated to topic )😂
  20. No doubt there as it is the only petition filed on OP s behalf . A 6 year delay between 1at interview and USCIS finally re affirming is dreadful..but lacking WOM action ..very real for many OP is evading the question on country of origin …a detail I am stuck on 😂…Am guessing India /Pakistan ..based on OP s proficient English…but not sure . What do you think?
  21. When is your new ( 2nd interview) date scheduled for ? If you can afford it , definitely lawyer up as @manyfudge recommends ..so you can submit a G.28 and legal brief before/at the interview. There are some countries whose government “ official “ papers face heavy scrutiny because of known corruption/fraud What country are you from ?
