    Thank you , I submitted a ton of evidence spanning 8 years. This isn't an easy journey it's even less easy with a spouse in prison because your fighting a prison system that isn't forgiving , I sure hope they understand that nobody would marry an incarcerated person for fun or misrepresentation, because when reality sets in it gets really tough. Unless you're in it you can't understand it but when you love someone you love that person, regardless of the situation and circumstances. I just want to be able to live here and be with my husband and be there when he gets out in 8 years.

    Wow!! Thank you so much , I cannot tell you how grateful I am for your your advice and input. Sometimes it's hard to look at if from a different prospective , I don't always see another point of view, so I am truly grateful that you take the time to help me. I don't have any family around like most people on their immigration journeys but unlike those, I don't have my husband with me all the times so I'm navigating this on my own for the most part as my husband can't help but I made my choices and I don't complain I understood what I was getting into , love is love no matter how difficult it gets . Again I'm so grateful to kind hearts like yourself you are a wonderful person .

    Since you are an Adjustment applicant an explanation is not required. In the instructions section pay attention to the "and", "or", etc. So the relevant info reads as: "If you are in the United States, you must attach: (1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and ... (3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the adjustment application;"
    Note that the (2) line ended in "; or" For (3) line purposes filing everything (e.g. I-485, I-130, I-131, and I-765) concurrently is sufficient. https://www.uscis.gov/sites/default/files/document/forms/i-131instr.pdf Page 9
     
    Also for I-131 dates not needed. Put "TBD" for the Date of the trip. You might need to handwrite "TBD" in that field if the PDF editor doesn't let you.
     
    And select the box for Multiple trips.
    Although entry is not guaranteed, AP travel is still very low risk. I recently used my AP 7 weeks ago at Miami International Airport. The circumstances of my previous US entry (i.e. an illegal entry; "Entry Without Inspection") was not questioned at all. A recently issued NOID (w/ 04/29 date on the notice) for my I-485 was brought up by the CBP secondary inspection area officer but I was also carrying the specific document that will help me succinctly respond to USCIS' concerns listed on the NOID. If you have a connecting domestic flight you should allot enough time to make the connection. I almost missed my connection to San Francisco.
    That woman was traveling with a TN nonimmigrant visa which is totally different than traveling with AP.

    Most likely since odds are I-765 will be processed before I-485.
    SSN is issued for life, but don't loose the SSN card. After an EAD is revoked getting a replacement SSN card will be extremely difficult; i.e. SSA communicates with DHS via the SAVE system and also the SSN cards with most restricted wording (e.g. "NOT VALID FOR EMPLOYMENT") are extremely rare.
     
    If I-485 is denied then the EAD is revoked.

    If one files an AOS without two documents, along with a letter indicating the two docs will be forwards upon receipt most likely nothing will happen except maybe a request for ADDITIONAL  information. Once the AOS is filed your safe

    These are my humble 2 cents. Be a gentle(man/woman) - gentle human being to your former spouse and cooperate with the NOID. In these situations, a notarized affidavit from the US citizen comes in very handy. While it it technically not your issue, you both entered the marriage with good intentions. Things fell apart and that happens. Your former spouse can get approved on the basis of divorce, if they can show sufficient evidence of Bona Fide Marriage since the date of the marriage. 
     
    In regards to your new relationship, everyone's heart beats at its own pace - so to speak. I personally would not rush into getting married again but that is your call. If you do choose to get married, I would wait to file for AOS and build a solid trail of evidence of Bona Fide Marriage since day one. Your future spouse has an I-20 that is valid for another 3 years. If I were in your shoes, I would help your former spouse with the NOID, wait for the dust to settle and in a year from now, marry your current girlfriend and then, later file for AOS. I would probably aim to get to the AOS interview after being married for 2 years already. That is just me, though.

    You stated the parents were joint sponsors. There can only be one joint sponsor. If they are married, then one of them(mother or father) will fill out their own I-864 as the joint sponsor, and then the other parent will fill out an I-864a to go along with it as their household member. They provide their documentation such as joint taxes, and their incomes will be combined to meet the requirement on Part 6 of the joint sponsor's I-864.

    @Jill Mackie I am sure your friend is looking out for you but I don’t think there’s anything suspicious about that. I think it shows how you and your husband manage your household. Thats commingling of finances and USCIS wants to see that. 

     My husband and I used to transfer money to each other via Zelle and we printed all those transfers for USCIS. We did not have issues. 
    Every case and household is unique and you are being transparent with USCIS. I think thats the best way to go through this process.

    I dug up my husband’s I-131 submission and we submitted 2 passport style photos, copy of passport identity page , copy of his visa, and copy of his I-94.

    It's states she had been living in Utah and working legally . You seem to be looking just to argue . It's a legitimate concern to me which is Why I asked in the first place.

    I'm not saying there's a case on VJ , I'm saying as I overstayed my visa there maybe a chance they won't let me back in. Also there was a case in Utah recently where a woman with a valid green card was denied entry because the officer thought she was lying . Not saying it will happen but there is a chance.

    Thank you for being a calming voice , yes, it is an extremely emotional issue for me , but I understand I made my own choices and take responsibility for them. I guess, I just want everything to be perfect ,because I have an incarcerated husband I know they will scrutinize me more. I just want it done correctly rather than mistakes . I do appreciate the help from everyone. Thank you again for being patient with a dumb blonde 🤪
