Hiring an attorney doesn't always mean success in this journey as you've seen here.. a lot of petitioners filed themselves and were successful. If your case is not complex, then it makes sense to file yourself.. however we cannot rule out the fact that hiring an attorney who knows what they are doing can make a difference only if your case is (complicated like I mentioned above) You have to find a way to convince your friends that writing an honest affidavit would not get them in trouble.. if all else fails you will have to put your all into a heavily saturated personal affidavit leaving no stone unturned. In my 18paged affidavit, I managed to capture details spanning a two year period before during and after marriage!👍

I agree, my problem is lacking documents, but i believe hiring attorney will not make much difference in that too, I can get some directions here and handle it on my own as i know my situation. I needed to know if RFE i received is something really serious and i need to worry about it or it is usual for people to get one like this. I will need to write my statement surrounding my RFE now. I got 3RFEs as well and believe me I didn't have so many documents however I made certain to explain in detail anywhere there was insufficient evidence.. I will advice you do the same.. also the 3rd party affidavits have to be very detailed not sketchy.. they have to demonstrate in written form the depth of their knowledge of your situation. No document is irrelevant bring them all.. if you can think of it, its relevant add new evidence to already submitted ones alongside detailed personal and 3rd party evidences and you should be good!👍

This is a google search and go for images you will find many decision letters provided by explaining why they did not approve particular case. I went through almost 50 of these letters so i know what to write and what not to write in affidavits,

 

I responded to my RFE on Nov, 23-2020. and i got my vawa approved in Feb-25th.

 

read as many notices you can make your story compelling and very detailed.

@Nick2020 thank you so much for helping me. I have no words to show my gratitude. Information you shared will be very vital. I thought if we apply through attorney, we dont get such RFE's. I am glad you responded or else i would have hired attorney and didnt know what to do, I will study these in details and prepare my statement. Problem is I do not have friends who are ready to write about my marriage and abuse, They are too afraid to get  into legal situation. I dont know how to convince them.

Timeline: 360: May 2020,  RFE, in May 2020, Good Moral, responded in June 2020. 

485/765/131: November 2020, No Bio

Lived with Abuser: 

1.  for 3rd point, My cousin helped buying me car and insurance, he was living in Illinois that. Car registration and policy has Illinois address. I added her on my insurance but address is not as of California. I forgot to remove her from my policy after i moved out, I then removed her in next 6month policy, As i am renewing my policy for every 6 months. How to handle this? 

2. She was in complete financial control, he was working when we were together and i was looking for job. So she was using her personal bank account and not our in common and as i was not going out much there are not many transactions on our common account.  What to do? 

3. She closed our common account, took all money out, as i was in panic state, i tried to add her on my saving account as i was not sure what to do that time, It was in October, i moved out in September, 

4. now i have tax transcript so i am good here i believe, 

5. What to provide for residence together? I already sent them joint account, but it dosent have much transactions, I sent my friends letter, she did not added me on any of her account and we were paying rent in cash, landlord is her friend and not ready to help. Recently got divorce and divorce paper has her same address we lived together, i am not sure if i should sent that or not.

4. It is asking for photos, but my wife deleted all my photos, i barely managed to get few selfies that i sent to my friends back to send it with my application. Please help me, Is this RFE something really serious? My friends who filed through Attorney have not received such detailed RFE. Going through attorney makes a difference? 

Writing statement only about RFE or I should re-write whole agony i been through?

Thank you for your reply. @sandranj, My apologies, I was not clear in my message. What i meant was, he will file VAWA only, he lost all hope working on his relationship. 

But he is confuse now how to proceed with VAWA when there is an RFE for his 485. He do not have much money left to file another 485. So far he told me, he is going to file VAWA by next month, then once he will receive his 360 case receipt, he will send that to NBC about his RFE that he is filing now VAWA and do not need sponsor as of now. He said he will also send this RFE to Vermont while filing VAWA. Is he missing something? 

Thanks @Stillwinning!!!😊,  Either my congressmen is not helpful, or USCIS is really slacked right now, Its been 2 months, i asked them to verify my address with USCIS. they havent received any update. Even for RFE they havent received any update. I already followed up with them.

Do you think Infopass will able to get me copy of my RFE? Last time i was at there office, they said they are not able to update my address. Not even able to accept I-131. that was odd. 

Hello VFamily, I have been issued an RFE on 02/05, i havent received my RFE letter yet. I am really panic because i moved thrice since i filed my VAWA. In infopass agent confirmed they have correct address on file but i am little worried. Online status said if i will not receive my letter by 03.13 i need to raise request. I already reached out to congressmen but no help. 

In worst case if i will never this RFE on my correct address, what i need to do to get copy of my RFE? TIA

Hello Vfamily, My friend received an RFE, it is for sponsor. seems his wife gave him incorrect \incomplete sponsor documents. He is almost done with his case and will need another month to send his case to USCIS, what he need to do now? 

Will this RFE will stop his EAD? What steps he need to take? He do not have a lawyer, he was thinking to submit his VAWA and mention in that about RFE is that enough or he need to reply to Service center as well where he filed his case?

Question for a friend. 

He is in process to apply for VAWA and will need another month to send documents to USCIS. However, he received an RFE for his I-485. (I do not know what kind of RFE) What he need to do now? His spouse is an evil women and i dont think she will help him with an RFE. 

Also, does this RFE halts his EAD? he had her bio as well. TIA,

So rfe may be for something else. I had my parents, cousins and friends statements which detailed information they knew about how we met and married. I think you can add those letters if required. I have seen other members suggesting resending detailed self statement on timeline of your relationship, marriage depending on rfe requirements. So not a bad idea to start penning another statement! Please try to manage your anxiety although i know it can be quite challenging. We all have been through these phases and eventually landed fine. I have seen and believe that uscis approves all genuine cases. God bless you.

I wrote my statement all over again, my family friend that saw everything wrote her statement all over again and I asked my family from my country that knows about my marriage to write statement to prove my marriage, they sent everything to me, I gathered as much as I could cos I believe that could be my last opportunity to prove myself and after 5months, I got my C31 EAD,waiting for my approval notice. I don’t hesitate to be over prepared as there’s nothing we have to lose by being proactive. Once you receive rfe you will have everything ready to file response! Thank you @PayingForward my first RFE was GM, so i guess  they will ask something else this time. Problem is i ran away from home when i got chance, and she never added me on her accounts, i do not have much to send them, that is why i am very panic. But i will start gathering more docs. 

What you recommend me to look for if they are sending me good faith marriage? All i have is bank statement on our name for 4 months, few selfies, one friend letter he saw the abuse and marriage. Taxes on our name. marriage certificate. some chats. thats its. Will writing my statement again will help?

I dont think so, my name is so rare that they wont even find more than 10-20 people in whole US. my first RFE was GM, 2nd i havent received it yet.

Ever since i get US visa, i always received RFE, not a single instance i reached out to USCIS and never received and RFE, not sure if i am on surveillance or something for some reason. 1. RFE when i applied for visa, got approved in 30 days. 2. when i applied for COS within US, approved in 8 months, 3. when i applied for OPT after graduation, approved in 9 months, 4. Even when i applied for STEM OPT I received exact same RFE i received for my OPT. approved in 3 months. and now two RFE's with my WAVA and i am not even half way through.

I was worried how USCIS could send 2nd RFE in 8-9 months specially when there are people are waiting from 2019 and even 2018.

@FeDaniela Thank you so much for your reply. You are no less than goddess right now for me. You are absolutely correct about first RFE. I clearly remembered i forgot to add police report with my Initial I-360 and mentioned that in list of documents (index) i sent to USCIS.

I am panic because i barely stayed for 4 months with my abusive wife. I literally ran at night when she was not home packing my stuff in trash bags. All i have is bank statements on our name, she even destroyed my documents, i was lucky enough my passport was in different bag and she didnt burned it. I dont have much to respond. I will post it here once i will receive my RFE in hand.

I believe it doesnt need to be an emergency for it to be issued.. it's a benefit of i485 pending petition.. it is only expedited when there's an emergency backed by supporting documents!👍

Good things: I been to my appointment today. Was able to verify USCIS has my correct address, yay. and also agent was able to provide me case number of I-131. but thats it, 

May be bad:  I checked my I-131 status and it says "correspondence received, and case is being reviewed" not sure what they mean by that. 

bad or possibly worst thing: 

1. Agent told me USCIS sent me something for my I-360, in October 2020 which i never received. Later she said they sent me mail stating my case is in pending. I am not sure what kind of mail is that or why they sent it. 

2. I asked her if i missed my Bio, she said she cant see in system if we sent any bio, 

definitely worst thing: 3. Just today morning before my appointment my I-360 status updated to RFE issued. I did not checked my email before meeting so was not able to ask agent about it. I applied for I-360 in  May 2020, received GM RFE in same month, responded in June 2020, never heard back until now. 

I am really worried because i went insane requesting USCIS to update my address, sent two mail, congressmen and Senator request and not Info pass, i am not sure if i upset this agent who is handling my case. I have never seen anyone receiving two RFE's in less than 8 months apart. Specially when USCIS already slammed with lot of work and already posted delayed processing timing just two days back. I dont even have much proof's with me and not sure what they need within 7 months. I never received Bio, 

Please help if you guys have seen any similar these cases before. @sandranj  @ValeryK, @justmarriedusciti, @Ana FL  @Engineering-rocks also VAWA family, please help, I am really stressed right now. 

Hey Guys, here is an update and couple of questions, i am really paranoid. 

Valery, I received Info pass to update my address tomorrow. So yes, they are still giving info pass appointments, 

360:May 2020, 

RFE: Good moral in May 2020, responded in same month, received status update in June, 

485/765/131: November 2020. 

I never received any Bio request, I am going to update my address with info pass tomorrow, 

1. Can i ask at info pass center if they ever sent me Bio request as usually status update dosnt reflect that? 

2. What if i will miss my Bio? I have all record or communication i sent update my address, will that help to defend my case? 

3. Can i also submit my I-131 as they only allow to submit my I-131 if it is emergency, issue is i never received receipt of my I-131. Can i ask them to print it for me? 

4. What is up with this bio? I saw some people got it some dont, why is like that?
