I was sent to secondary inspection and came out in less than 30 minutes. No problems. My buddy also travelled same day and he just returned last week, no problem. Why will you be different?     @Hope4me, thanks for your post. I am April 2020, with 2 RFE and responded In April 2022, planning a month long trip to my home country. Currently my case is in Background check. I am scared to death what if my vawa for any reason get denied while I am abroad ? I will never able to come back. 
     

    your friend who came back last week. What is his/her filing date ?

    they can ask for a RFE but denied a case with a lot evidence …I don’t think so 

    That’s why I never thought that way cause I sent to then everything …pic, police report , restraining order, hospital visit etc etc etc 

    I received 2 RFEs, I am from April 2020, my 2nd RFE was 4-5 page long. I did not had many pictures, just few selfies, my ex deleted all from my phone. My auto insurance was from another state but had her name on it. I kept that because it was cheap and I explained the same in my statement. Bank statements had very few transactions because we were using cash. I had no job that time. We lived only 4 months together as married. Dates for close to 1.5 year. I feel my case is weak. I could be and hope I am wrong. 
     

    my case is in background check. Last 2nd RFE was in Feb 2021, responded April 2021 and last update was in September 2021 corresponds received. I got my EAD and Ap in may 2022. And getting a PF’s as well. I am not sure if I am over thinking or shall I just travel. It’s been 8 years I saw my mom. Her tourist visa denied thrice because they were not able to find me in the system.

    4- it's difficult for your mom to get b2 visa she becomes a potential immigrant, the way I see it when you become USC you can sponsor her

    Thanks, i will tell my friend not to send medical before RFE

    I am about to hit 3 year mark, so may be 2 more years or less hopefully. 

    congressmen said my case is in background/security check.

    4. Ur parent can only apply tourist visa on their behalf. You can’t apply or sponsor for them for tourist visa. Normally if your parents can show strong ties with their home country the bigger chance for them to get tourist visa than told the consulate / embassy about ur vawa status. 

    Thanks for your help, she did showed strong ties, but all questions of VO were focused on me and my status, they were not able to see any of my details in their system, they found it suspicious and denied her visa. :( 

  4. Multiple questions in one post. 

     

    1. My friend. (Timeline: full packet: OCt 2020, I-360 , Vawa approval Sep 2022) fingerprints for 485 applied Oct 2022, His Medical was October 2021, asking if he can send medical even before they send RFE. he is getting mixed response, some are asking to submit the medical only once he get RFE for it, some are suggesting to send new medical. What you guys recommend? 

     

    2. What is the longest you seen someone took to get their VAWA approval? 

     

    3. My case is stuck in background check, is their anything i can do from my end to get it cleared? or send any documents that could help USCIS. I was contemplating to send FBI, my home country police clearance certificate and all. 

     

    4. Recently, my mom's tourist visa been rejected, anyone able to get tourist visa for their parents? My mom been to more than 15 countries in last 3 years. Their all questions were focused on me and my status, they were not able to see any details regarding me because of VAWA. As stupid as i sound, i did not send my VAWA details with my mother, She is planning to apply again and take my VAWA receipts with her this time. any other suggestions that might help? Its been 8 years i saw my mother. I was thinking to writing to USCIS Vermont about my mothers tourist visa refusal due to my VAWA secrecy and ask if they can help validating it with US consulate general. I know it is not normal, but would it be very bad move? this sepration is taking toll on me. I have AP but i am very scared to travel as anytime they can decide on my case. I already had 2 RFE's 

     

    Looking at processing time, i am started getting depressing thoughts that i might will never see my mother in this life time. Please help.

    I consider my case relatively weak. Very few documents, weak psychological evaluation as psychologist was not good. I received 2 RFE's so far. 2nd was on 6 page long asking all minor details about my case. Last status update was correspondence received in Sept 2021, nothing since then, recently i inquire through congressmen, got to know i am stuck in background check, dont know what they are checking, I am getting restless. I am thinking to file Mandamus, what you recommend? what are the criteria's, requirement for mandamus? Would it turn negative for me? I cant even travel as they could anytime deny my case i am being abroad.

    Yes, i have AP, I am April/May 2020, too close to get the decision, stuck in background check, Thanks, I have booked the tickets, If they want to deny my case let them.

    Thank you so much for sharing the experience, I am dying to see my parents, its been 8 years, I am May 2020 with 2 RFE's and currently my case is stuck in background check, Wait is frustrating because i need to travel and i can not. :( I guess someday i will just book the ticket and fly home, screw this process, if they want to deny me, let them,

    NYC is slow,but you are close. stay strong,  I would have been happy with my VAWA approval, i am not sure if they do two background checks. 1 for VAWA and 2. for 485. :(

    I understand security check is different than background check, but response said USCIS is doing both? I understand my case was weak as i did not had many documents with me, i  got 2 RFE but this is disheartening, 

    Why they mention both security and background check? Anything i need to worry about? Anyone been through checks, usually how long they take? Shall i expect any other RFE or straight decision now? I responded to my 2nd RFE in September 2021. Is it safe to say they must be doing background check lets say since December 2021?

  11. Asking for the friend. 

     

    VAWA approved recently, planning to travel abroad, might can expect fingerprints again, or Medical RFE or even interview request along with Medical. What to do when he will be out of states? Anyone been through same before? He might not able to travel back immediately for any USCIS request. Not sure how much more GC will take time. 

     

    Vermont is sleeping again i guess :(  

  12. Hello everyone, hope everyone doing great, happy to see approvals and cases moving forward. 

     

    I am 29 months, Shall i send inquiry through congressmen? I am little afraid as i have received an 2 RFE's already. Responded a year ago. I am April/May 2020. I know i am still in timeframe but 7 years in US i saw USCIS somehow always takes time on my case or give more RFE's than others. Please recommend me what to do? Shall i wait or there is no harm in sending and inquiry through congressmen? I do not have a lawyer.

    2.  That is true, there has been an increase in Notice of Intent to Revoke, and background checks are inclusive of verifying all information and not just a random check.

    Not 7 months sorry like 4 months, I am now curious, not just her but if i decide to travel and stay out like 3 months, would there be any problem to come back?  

     

    USCIS is doing what is right and good, just that this wait is killing, lucky are those who got their decision in 8-12 months in 2016-2018

    Hope everyone is fine, No matter how hard i try to keep myself busy but still VAWA keep drag me into the past, waiting for the result so i can move on but no,

     

    Anyways, got multiple things. coming on forum after long time, 

     

    1. Asking for a friend found on VAWA forum too afraid to ask, Shes April 2021, married to her abuser in November 2020, divorced finalized in May 2022. She was not living with him since April 2021. Shes pregnant now with her boyfriend. She have AP, and want to spend months in home country where her family can take care of her, can she stay abroad on AP for 3-7 months? anyone stayed that long?

     

    2. Someone on facebook forum posted some US citizen spouse organization filed complaint with USCIS about their foreign spouses abusing VAWA. She said USCIS released some findings about lot of fake cases and doubtful cases which are already approved. Not that i am much concern but seems VAWA timeline seems will go up "IF" it is true. By her POV, now USCIS cracking down these kind of cases which will take more time and may be more strict on VAWA applications. Again, i am not IN or against anything, just sharing what i came across. 

     

    I am May 2020, dying patiently.

    or you can request from USCIS (FOIA) just to see whether you checked the box or not. 

     

    Lately i have seen approval are taking much shorter than usually. I know few people on an other forum who got approved in 2 days after new card being produced.  

    Thanks, i was able to find the copy of  my 360 and box was checked, i just hope i didnt cross that our before filing the form, lets see, as you said, hope either status will update soon so i wont need to wait longer time, 2 RFEs are enough for lifetime anxiety along with abuse i went through ,

    if you have pending i-485 then you can file i-765 requesting EAD c09.

    Honestly i do not recall if i check the box on 360, what i can do now? I dont want to wait for months to get approval/rejection receipt to know. With C31, we get to know VAWA is approved. Thanks,

    Congratulations to all who received an approval and those are in line like me, hang in there, we are close, i know it is tough, 

     

    Q. I think i missed something here. 

    Do we need to file 765  with C31 along with 360 to get EAD based on C31 or just checking the box on 360 requesting EAD is enough? 

     

    I though, those who just filed I-360 just checked the box in 360 form requesting EAD and received an EAD after approval. 

     

    I do not recall if i requested EAD on my 360, but i am sure i did not filed 765 with C31 with it. Can i file 765 with C31 now? 

     

    PS. I do not need EAD, just that approval notice takes time after NEW card being produced and i do not want to wait another 2-3 months in anxiety to know my case outcome. Please help me. 

  18. Congratulations to everyone getting approvals. Seems people started getting their EAD's and AP. Even though some getting decoupled to expedite EAD. I saw people from January 2020 are now getting approvals and RFE's. With low Covid hope they will speed up working on our cases. Even i am horribly busy, still i cant take my mind off from VAWA. Anxiety started with my Ex still haunting me with this process. Hope everyone will get approval soon. Hope my case wont take it to 2023 to hear from the outcome. I am May 2020. Praying for all. ❤️

    Many of you remember me. I had a 204c FRAUD CHARGE on my I-130 that came last March 2021 while my i360 was pending already. even @sandranj gave me less than 1% chance. Many people here encouraged me but gave me less chance since I had a fraud charge

    I received NOID on my i360 last November asking me a list of things that seemed impossible (I posted my  NOID notice here) but I tried to gather proofs. Sent response to NOID on January 31, 22 and today booooommmm card production.  Applied i360 October, 2019.

    Heartiest congratulations, I am happy it worked well for you, I can feel the pain you been through, I got 2 RFE's so far and it is really stressful since i got married to my now Ex. god bless you, enjoy, sun is shining on you, ❤️

  21. Hope everyone is doing great, congratulations to all my brothers and sisters receiving approval, those are in line, hang in there, we are almost there. 

     

    Few weeks back asked congressmen to update my new address with USICS for 360/485. Today received update "name was updated" on 485. I know we get this status when they touch our file. I am 99% sure it was for address update. However, email i received with status update was initial review. Why they doing initial review if my 360 is not even approved? or this is just generic update like name was updated? TIA
