    Maybe this question is stupid but I want to make sure…

    I am responding to RFE soon and wanted to know if I have to send a letter or something else is required out of the normal documentation since my husband and I filled taxes jointly (I have not I come of course) 

     

    Just to make sure since both of our names are on the transcripts.

    Do you know if I can just upload the new form and supposing documents on my USCIS account since it has a button for that or  is it necessary to send it physically on the mail?

    Current income is what is important. I called my finance guy, and he says the IRS just announced you will be able to file your 2021 taxes on February 12th this year. If he made more in 2021, you can file your taxes on the first available day February 12th or 13th, and you will be able to download your 2021 transcripts a day after your return is accepted by the IRS( If you file electronically). Then you can do a new I-864 with hopefully a better income showing on your newest tax transcript, and along with as many pay stubs as you have before you have to mail them in to meet the deadline, and everything should be golden. You can actually do your taxes online now if you have all your documents, and you will know where you stand with the new return on the I-864 before you even actually file.

    Sorry I just feel very worried now. Does it matters that in 2020 his income was below requirements and the fact that he only has been at his new job for 2 weeks now.

    Yeah he did, those were the documents we sent as the “most recent tax year” the transcripts and 1040 and W2 we sent.

  8. Hi guys. We sent my AOS of status on December 21st and today I got a RFE, they say they couldn’t determine if my husband qualifies as an sponsor. Last tax recent year (2020)  my husband made 27,149 wich is a little below the 125%, now he makes 52,000. He stated this year working in a company that he left in June then started working subcontracted for 6 months and in December they contracted my husband directly, it’s physically the same company but he is not on the payroll directly. So my husband now has only like 2 weeks working with this company directly, we sent 6 last paystubs of the subcontractors and the offer letter of the main company, he only has 2 weeks working directly with this company,and not time to fill taxes again. What ca we do in this case? We know he make enough and we don’t have someone for joint sponsor as USCIS suggest if it’s needed we just need to prove he makes enough is my guessing but we don’t know where to start or how to do it. Attached the RFE letter.

  10. Hi guys. I was checking if I could find any other case like this but I couldn’t find any other topic with the exact situation. I received  10 days after submitting aOS packet my access code letter but I haven’t received the NOA1 for any of my AOS, EAD Or AP. Do you think it could come after? I ask because most people receive their NOA1 first and then the acces code letter.

    You are fine at least for USCIS stage, we only had one visit for 5 days when we started our journey after that there has been more visit that we have documented to bring evidence to the interview, we were approved at USCIS level. But it’s a good idea frontloading the petition for when it gets to the embassy, it will help you since most of the time they don’t look at the evidence you bring to the interview. I think you have enough, don’t send a bunch of screenshots of chats, just like 2 of every month, don’t for get your intent to marry letters, and the description of how you met. Your age gap is not significant.

     

    Side note:

    they never ask for how long was the visit (based on like 30 different experiences) they only ask “How many visits” since the relationship started to that point.

    You can do it now but why not waiting till the case is at the embassy? 💁🏽‍♀️ And right form for K1 is DS-160.

    If you could prove you are divorced, why couldn’t you prove you have never been married outside your own country?

     

    Doesnt hurt anyone if the beneficiary can get official documents, but of course it’s their decision anyways.  ☺️

    Like you said, I have a feeling they got it mixed up with someone else. Trying to figure out how I can prove I'm single now. 

    Well, the only way I see you could do it is getting a letter from the institution that is in charge of marriage records in your country, stating that you are single and that you have never been married, that there is nothing in their records. And another letter from you explaining that you think it was a mistake and why, maybe with a copy of the part of the form that says that you are single an never been married.

    Hi, 

     

    check if one of the two names are familiar to you of the married people on the form, if you put info in the wrong part of the form.

     

    Are you the beneficiary or the US citizen?

     

    Because you say you have never been married but if you are the petitioner what about your fiance (é)?

     

    If none of the two names are one of you then it’s probably a confusion with cases.

    They suggest to use Acrobat but unfortunately in a lot of spaces it doesn’t let you fill it, so we used Microsoft Edge, you just need to print it from Edge and try to not open it in Acrobat after that.
