Hello All,
I want to ask my if k-1 visas are being processed I cannot find clear cut answers. My fiancé already did the interview. It went to administrative processing. Plus the medical was still pending. During that his medical came back and there was an issue. They gave us a year. November 1st he was to repeat the medical in SDO. My question is. Are they doing medical exams? If everything comes out fine would his visa be able to be processed?
At the interview they told us we do not need to repeat the interview process again.
My Fiancé and I have been in this process for what seems like forever. Please do not go through our timeline and get freaked out. We have been one of a kind.
Hi. I called *Consultorio de visas* like one week ago, I wanted to ask some things about prices and all that so we can set our budget, they gave me all the info and told me they are working normally.

It depends on your fiancé's Insurance company and the plan that she has.
(1) Some insurance companies won't allow you to be added until the new cycle starts which will be around end of the year.
(2) Some won't add you until you have a SSN
(3) Some can add you to the plan immediately if there's a life event changes. (Such as Marriage)
Your fiancé would need to ask the insurance company to confirm the above; and ask her company if they are willing to add you to the plan. The provider is United healthcare and the plan is plus choice, My fiancé requested the information but no response yet, if someone have experience in this matter with this provider, please let us know, the info will be highly appreciated.

We were asked for a copy of the marriage license and copy of the US K1 visa page on the passport.
Ok. Thank you for your answer.

I added my husband right after we got married which was a year before he got a green card. On my plan (and I believe most plans) you are required to register with them within 60 days of marriage because it is a life-changing event. After that, you can not add them until the next year. The key is getting married right away when entering and not waiting the whole 90 days because you have to actually be married to add them to your insurance.
Ok, we will do that, thanks!

By far the easiest thing to do for insurance for a K-1 beneficiary, assuming the petitioner has employer-based health insurance, is to marry ASAP and add your new spouse as soon as you can (at least with some employers you can add your spouse retroactive to your wedding day; mine let me do that). Yes, even if you're able to add your spouse retroactively that still leaves them uninsured for a few days, but that's not too big of risk normally, and most short-term plans aren't that great.
Ok. Sounds like a good idea, the plan is marrying the first week.

Such cover falls into the better than nothing category, benefits are limited, does not cover COVID for example, and the inner limits may be an issue of something serious happened that was covered.
Yeah. That is why I want someone to suggest us an acceptable short term plan, in case the other option is not available.

I assume its going to depend somewhat on the requirements that your petitioner's insurance company has.
In my case I was getting married around 14 days after entering the USA on a k1. My (now) wife investigated adding me to her company health insurance and was told it would take a week or so after we were married and had the marriage certificate to show them. So this would mean I was not covered for 21 days or more after entry. So I could be covered several months before adjusting status.
I checked my global travel insurance that I had in the UK and they confirmed that it would only cover me for the first 24 hrs in the USA, since it was not travel but emigration.
I used this company to purchase a 1 month health insurance policy to cover me until I was covered by my wife's company policy. From what I recall it was a fairly quick and easy process. One month wasn't too bad, but if you were going to spend quite a few months on it, it could get costly.

My greencard interview was waived and I was never asked to provide any details of health insurance cover at any stage of my immigration journey, though my entry to the US was 5 years ago so things might have changed.
Understand, short term is one of our options if the insurance my fiancé has doesn’t gives me coverage within 30 days after arrival, he requested the information to know what we gonna face.

DS-5540 is currently not required, but the consul officer may still ask about health insurance coverage at the interview.
Oh ok, thanks! We are working on having a plan in case they ask.

That's what most people do is to indicate inclusion on spouse's plan upon marriage
Ok. Thank you very much for your answers!

Didnt have to provide anything that I recall except maybe our marriage certificate to prove the "life" event and her coverage began the first of the following month after we married
So it means we can say and show proof that I will be covered by my soon-to-be husband insurance within 30 days after my arrival to the US on the DS-5540 form and if they ask at the consular interview?
This is mostly because we are concerned about the DS-5540 and I-944 forms and the health insurance requirement.

I added my wife immediately after marriage and 9 months before she got her greencard
What documents did you have to provide and does she had coverage immediately?

Hi guys,
We are trying to figure out with time in advance how we would do the whole process of the K1 visa. We want to know if I (the Benefitiary) could be included in my now fiancé insurance plan (through employment) after we marry and before adjusting status, we know We could be asked about the Plans for health insurance at the interview, if that is not possible according to your experience we would like you to suggest an acceptable short term insurance until until I can be covered by the one my fiancé has.
Thanks in advance.

My fiancé and I were in a similar situation, we had everything for K1 but considered going CR1 because of its benefits, we even lost some time waiting for a divorce certificate to apostille and traduce and get married in Dominican Republic. When my fiance was asking for some days off At work to come they said he must have 6 months working before he could get days off, He only had 2 months, it means we would have to wait until January. Then we decided going K1 and wait.

Don't read into what's not there. It says "copies", so a court certified copy is fine for your submission.
That’s what I can’t get, the physical certified copy like I say in the first question. They say that they can just send me the document through email, this has stopped me from sending the application 😔, Do not know what to do. I know don’t need to be original.

Straight from the I-129f, Petition for Alien Fiancé(e) instructions:
Copies. You should submit legible photocopies of documents requested, unless the Instructions specifically state that you must submit an original document. USCIS may request an original document at the time of filing or at any time during processing of an application, petition, or request. If USCIS requests an original document from you, it will be returned to you after USCIS determines it no longer needs your original. NOTE: If you submit original documents when not required or requested by USCIS, your original documents may be immediately destroyed upon receipt.

This has me confused (The I129-f instructions) because it says *court certified copies*
Just trying to not have delays because of RFE.

All evidence submitted to the uscis can be photocopies or original or certified copies unless an original is specifically requested
Thanks for your response. I understand that, my concern is that it wouldn’t be the physical certified copy, they will scan the certified copy and send it to me through E-mail, that would be like a copy of the certified copy. Would that work for USCIS?

Hello all,
So, I had a DUI about 8 years ago, and I am currently putting together a K-1 Visa package together as the petitioner. I am trying to get my court records to send along with the package; however, the offices are currently closed, due to COVID-19 of course, and they do have an E-mail option. My question is would the E-mailed certified copies be sufficient for the package, or would it be no different from if I just printed them out on my own. I appreciate any help with this matter.
Thank you.
Can the beneficiary mail the application to USCIS from outside USA?

He could just bring the package with him and when you have the certificate you scan it, it doesn’t need to be original.
