And it’s non-immigrant indeed. The DS-160 and the I-134 are only used for non-immigrant visas. The fact that k1 visa holders have to file for Adjustment of Status, already says a lot in my opinion.

Guess who made it to America? Me!
So yesterday with Turkish airlines I went Zagreb- istanbul- Chicago.
Both planes super full and busy. I was meant to fly to Miami but that one got cancelled.
Now I’m laying in my hotel in Chicago, traveling to Florida tomorrow morning.
Now something about entering and if it was difficult. So I entered with ESTA, the reason to see my boyfriend and staying at my own house that I own in Florida.
First in Zagreb they kinda checked it, said it was fine. At Istanbul they did a completely different check, never seen anything like it. Checked all passports, bags and people right before the gate. There they first weren’t sure about my situation but called someone and also let me pass. Now to the actual important one in Chicago. I was so nervous. I went up said “Hi” when he looked at my passport I said “I have quarantined in Croatia for 14 days, stamp is on page 9 and here are some papers to also proof it.” He looked, asked me questions like why I was entering, how long I’m staying, where am I staying. He was confused because he said “Croatia is Europe right?” And I said “but not Schengen” so he went somewhere to ask. I was so nervous but he quickly came back, stamped it and let me go.
So overall I was maybe standing there 5 minutes max.
So guys be calm. You know legally you are in the right and if someone doesn’t know they just need to go check or call someone. But you’ll be fine.

your question is not clear enough at least to me , anyway k1 process is clear ( you mentioned fiancé )
but to answer your question about Military orders ( you mentioned PCS orders )
service members are either considered Single or Married when joining
when Married here is how things work
Visit the nearest military ID card issuing facility with the following documentation: NOT all overseas facilities offers enrollment on Deers
Your marriage certificate. Your spouse’s Social Security card. Your spouse’s birth certificate. Your spouse’s current photo identification card. THE ONLY document you can bypass is SSN , some deers facility will enroll you temporarily with an Alien number plus 2 ID documents passport and ID
to my knowledge , only dependents can be on pcs orders

Finally, thank you for saying this. I understand trying to show that certain words can be wrong, and I appreciate it, but most individuals in this thread were literally simply complaining about something that could’ve been concluded constructively. Obviously, as you can see, mainly those with the spousal.

Hi All,
Hoping for some expertise in this matter because the advice from the London Embassy seems bizarre. Recently, I had my request for an emergency K1 interview denied. Won't go into the details but it was a reasonable request as there were medical and job related reasons. The reason for the denial was the travel restrictions between the US and UK. I then pointed out that if that's the only reason why it's denied, they should still process it and my fiance could travel to another country for 14 days prior to entering the US. They then replied that if he plans on doing that, he should have the case transferred to the embassy in the country he plans to quarantine in and receive the visa there. They said make sure that embassy is able to process K1 visas and that it could take 8+ weeks to transfer.
Am I crazy or does this seem like bad advice? Can you just transfer to a country you plan on traveling to but don't actually live in? I thought you actually had to live there before transferring. It seems like you would waste 2+ months transferring with no guarantees the other embassy would follow through with the processing. Plus you would have to do whatever their Packet 3 requirements are which who knows how long it would take for that to be issues and gathered.
Overall, seems like bad advice to me but maybe I am missing something.

Please let us know if you’re able to obtain any results. I’ve already applied for an emergency appointment and I’ve been told they couldn’t assist me because of the Schengen ban. They said they are committed to processing K1s as soon as possible when the ban is lifted, however they have no idea when that will happen.
I was hoping the ban could be lifted in July, Europe is doing very well and I don’t see why it should be kept in place.

The consulate in Naples is rescheduling appointments for those with the spousal. I wouldn’t leave now, because they could send you an email with an appointment while you’re there. I would definitely wait.

Well, thanks for the advice. Let's see if something comes in this week, otherwise I'll try to leave anyway, moving the ticket will be expensive. If the appointment should arrive while I am in NY, I will ask to postpone it when I return. After vaccinations, everything will be ready.

I personally know an applicant with a CR1 that has had his appointment rescheduled recently. His appointment had been canceled, so my guess is that they’re scheduling appointments in order and yours should be next.

Thankfully it’s become clear K1s are not impacted by the labor market EO.
Consider focusing on the following points now when contacting your senators and representatives
1) K1s should be considered mission critical alongside spousal visas
2) A valid K1 holder should be exempt from travel bans as a spouse would
We’ve accomplished one goal, let’s conquer the rest!

Update: I just got off the phone with my representative. She collected some more information about my case. She is supposed to call the embassy today and see what needs to be done in order to classify K1 visas as mission critical as well as requesting they give me an emergency appointment. She said that there is no guarantees but it shows that there is congressional interest in my case and could have a good outcome possibly. I encourage you guys to reach out to your representatives as well because it will really draws attention to our visa category. She even said her said that K1 visas end up getting left out a lot because they are in a category of their own and are often overlooked by both immigrant and nonimmigrant departments.

Hello, welcome. First of all, I want to thank you for posting such a informative post with all the information you've gathered. I for one am very grateful and appreciative, which I'm sure others will be too.
My opinion is the DOS and the Embassies are not communicating well. Because NVC can't schedule interviews till the Embassy tells them to. And the DOS has already said that the exempted visa categories are "mission critical" and are to continue being processed. I know its probably also a "staffing issue", but some countries are out of lock down, running and open and the embassies are still not "resuming routine visa interviews". Its confusing.

People were absolutely criticizing the fact that the petition cited “immediate family members” and while some simply said it was not correct, others were offended by it and said they wouldn’t have signed the petition as they didn’t agree with that line. We have been told we’re trying to get equal rights as married couples, that we should’ve gotten married if we wanted to be immediate family, and so on. It was quite negative, in my opinion. But it’s okay, I’ve tried to send another version of the petition and as soon as someone will tell me it’s fine, I will ask the OP to create a petition.

Individuals can apply for a US visa in a country other than their home country in certain, limited circumstances. One of the most common reasons is that you are otherwise resident in a country that is not your own. The US Consulates do not want individuals to “forum shop”- that means they don’t want individuals choosing to appear for an interview at a certain consulate because it may be easier to get a visa there. It's recommended that you contact the embassy to which you want to interview from to determine their rules. I have read where some have been turned away at the interview because there was a stipulation that was not met prior to the interview. Time in country is one such reason.

Yes you need to interview at the consulate that has jurisdiction for the country of residence or citizenship. Mary was a resident of Mexico for 6 weeks before we filed and 5 months prior to interview.
I'd contact your congressional delegation and I'd think the legal services at your base or branch.
