    You write it yourself: https://www.irs.gov/individuals/international-taxpayers/nonresident-alien-spouse

    How to Make the Choice

Attach a statement, signed by both spouses, to your joint return for the first tax year for which the choice applies. It should contain the following information:

    1. A declaration that one spouse was a nonresident alien and the other spouse a U.S. citizen or resident alien on the last day of the tax year, and that you choose to be treated as U.S. residents for the entire tax year
    2. The name, address, and identification number of each spouse. (If one spouse died, include the name and address of the person making the choice for the deceased spouse.)

    Thank you!

In order to file jointly, you must be considered a resident for tax purposes for the whole year. So by considering yourself a resident for the whole year and by having a SSN you automatically qualify for the stimulus money, if the combined income in 2020 was lower than 150k.

To be considered a resident for the whole year, you need to either pass the presence test or write a statement asking to be considered a resident for tax purposes for the whole year.

And since you're a resident for tax purposes, you must declare all worldwide income. This income might be exempted by using 2555 form.

Thanks! Is there a specific document for the statement or just something I can write myself? Do I have to write one for my daughter as well so she can be eligible for the payments and the new monthly child payment?

I assume all worldwide income includes child support so will do. Thank you!

  3. Hello everyone! US taxes are confusing to me as an Australian so I am hoping to come here and find someone with more knowledge who can set me on the right path.
Myself (married to US citizen and hold a GC) and my daughter (3 and holds a GC) entered the US on July 14th, 2020. I am filing jointly with my husband and we will be claiming my daughter when we do our tax - soon.

But I want to know. Am I eligible for the stimulus as I wasn't here for half of the year? I would have to claim to be resident for the whole of 2020 correct? I only received my GC this year. I did earn some money in Australia before I came and I just don't want that to put us out. Only like 7k USD. Would I have to put my Australian child support on the US tax reports?

As for my daughter, is she eligible for the $300 monthly from the COVID package? Do I have to do anything for her other than claim her on the taxes we will be filing soon. Is she eligible for a COVID stimulus as well and is there any requirement for that?

Sorry for all of the questions,

    Thank you!

Did the online status update to reflect that her biometrics was taken yet?

Nope and it won't as she has her GC.

We received his Green Card in the mail yesterday! YAY! We can relax for almost 2 years 😅🤣💜💜. I'm so grateful to this community, without it I don't think we would have been able to do it by ourselves. *so happy*

Congratulations! Did you end up having an interview?

The person in the Reddit thread said that contacting local congressman helped them: "I'm just thankful that congress were willing to help us."

"Help with a Federal Agency" or "Assistance Needed" page select Social Security Administration (SSA)

Adults also don't "need" an interview.

Thanks! They made it sound like they did. I am definitely not an expert as this is all new to me. I'll look into it!
Is that page on SS or congress page or somewhere else?

You will have to balance the cost (replacing a set of critical documents) versus the benefit (slightly lower taxes).

    Not worth it to me.

See this link for what sone immigrant did who stood her ground to force an interview

I did call a second time and mentioned things she did like I need to have our green cards on us and she dismissed me and said people send them all of the time. Also that adults can be scheduled during the pandemic -like your example- but kids never need an interview so I either send it in or wait.

The risk of lost documents, so it's not worth it. Wait until SSN office fully open and go apply it in person.

I agree. I am not confident sending so much in especially when it'll be hard to replace.

  7. Hello,

I received my SSN through my EAD/AP card but my three year old daughters was never processed and we both have our green cards now. I called the SSO today and they told me that she would need to do a new application but because she is three she doesn't get an interview so it has to be my mail. I need to send her green card, passport as well as my passport and her birth certificate and they will mail it back. I really do not feel comfortable sending all of those documents considering we need them and they are hard to replace here. Is this really the only way around it? If it is I will do it but I thought I would ask here first as it makes me a bit nervous!

    Thank you!

Congrats!! You’re probably the first case I’ve heard that this happened to!

I have seen it happen to other people but they all had interviews canceled due to the pandemic. I have never seen it happen to someone who never had an interview scheduled. Thanks!

    Thanks! Two year.

I have my own question. I received my SSN when I received my combo card. My daughters combo card was never processed and won't now that she has her green card but what do I do for her SSN? Will the card come or do I have to contact the local office?

  9. Hi,

My AOS was approved and I have reflected that in my timeline but when I post it still says pending and I am not sure how to rectify that. I didn't have an interview but I played around and added an interview date and it made no difference. It isn't a big deal but it bugs me as I want it accurate. What am I doing wrong?

    Thank you!

Edit: Oh and is there no way to reflect an interview skip in the timeline? I have left it out but it still has the interview ticked at the top.

Just to give you a little example, I applied for AOS July 2020 I just got my EAD approved this week and had biometrics last week, unfortunately the wait is quite long.. My actual green card is "ready to scheduled for interview" that can still take months...

    Another weird timeline
I applied for AOS, EAD, AP in August (with my daughter), we did biometrics in October, my combo card was sent out January (her status never updated) and we skipped straight to getting our green cards February.

My EAD finally got approved to today!! Now I can go get a drivers license and my husband doesn't have to drive me everywhere 😅

This is what I am excited about too. Husband has to take me everywhere. Even though I have been driving for a decade; I am nervous to take the test here as it is on the other side of the road. Gonna drive a little bit first before I do it. Will be good for freedom!
