Congratulations! Yes, do include your first kid's birth certificate with both of parent's names on it. Could also include second child's BC after birth 🙂

I included that and I also included a letter from my OBGYN stating I am currently pregnant with a scan. I know the second item doesn't hold much weight as it doesn't have my husbands name on it but I love to supply as much as I can!

I think our interview is pretty much inevitable, but I’m hoping we’ll get lucky! We’re CR1 and haven’t had an interview with USCIS directly yet, just the one at the embassy. I’ll be pretty surprised if ours is waived, but still hopeful I guess🤷🏻‍♀️

Same. We had the initial at the embassy in my home country and nothing since. We are K1 and K2. I think our AOS petition was solid. Now I am currently pregnant with our second child which I think is proof enough lol.

Just received our text message!!! I’m pretty sure we got Texas (SRC prefix),which I’m surprised by since we are CR1; I was expecting NBC. Hopefully that means we can be part of the “risk-based” approach and have the interview waived. I sent enough evidence for it, that’s for sure lol!

    To recap:

    12/24/2022: 90 day window opened

12/27/2022: Sent via USPS to Phoenix Lockbox

    12/29/2022: Delivered

12/30/2022: case marked as “received” when I track the number

01/05/2023: text message received, money order not cashed yet

I am hoping we don't have an interview either.. But our green card interview was waived and apparently they like to do at least one.

  4. My husband sent our package tonight. So we just made it as a December filer.. even though it won't be received in December. I am still counting it lol.
I am a bit stressed though. He is sick and I said let's just go tomorrow but nope he went and he told me they put our paperwork in a box. It is clipped and has a band but I don't know if it is stable enough for a box and I am stressed it is going to go everywhere and they won't accept it. :(

  5. Ugh. When I set our utilities up when we purchased our home I listed both of our names but ALL of the bills have either my name OR my husbands name. Not both. I am so disappointed because this was going to help with our application and now I am stressed we are going to have some issues. I guess it is good some are under mine and some his same address so I can say we share the load but.. :(

  6. Good morning!

Sorry if this has already been asked but I am quite an anxious person when it comes to important things such as this and thus I want to be sure that I understand correctly. For AOS my K2 had her own complete application that was filed with mine. However, am I correct in understanding that for ROC she does not need an application at all and is just listed in the correct section in my application?

    Thank you!

Per the final calculation it looks like both you and your daughter are resident aliens for tax purposes in 2020: 171 days in 2020 + 1/3 (38 days in 2019) + 1/6 (0 days in 2018) = 183.6666 days

Thus that is at least 183 days. Your POE day (July 14) counts as a full day: https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test

Days of Presence in the United States

You are treated as present in the U.S. on any day you are physically present in the country, at any time during the day. However, there are exceptions to this rule. Do not count the following as days of presence in the U.S. for the substantial presence test:

    • Days you commute to work in the U.S. from a residence in Canada or Mexico, if you regularly commute from Canada or Mexico.
    • Days you are in the U.S. for less than 24 hours, when you are in transit between two places outside the United States.
    • Days you are in the U.S. as a crew member of a foreign vessel.
    • Days you are unable to leave the U.S. because of a medical condition that develops while you are in the United States.
    • Days you are an exempt individual (see below).

Oh wow. We JUST make the cut off then. Is this something I have to prove or will they know? Do I have to write a letter for my daughter and I?
Can we just use TurboTax then and claim the stimulus for myself, daughter and the new child benefit?
Sorry for all of the questions!!

@Cilllah, just to get an exact calculation for that test did you visit the US with ESTA (or B-2 visa) in 2018, 2019, and/or 2020? If so, how many days for each year?

https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test 2020 is the "current year" for that tax year

To meet this test, you must be physically present in the United States (U.S.) on at least:

    1. 31 days during the current year, and
    2. 183 days during the 3-year period that includes the current year and the 2 years immediately before that, counting:
      • All the days you were present in the current year, and
      • 1/3 of the days you were present in the first year before the current year, and
      • 1/6 of the days you were present in the second year before the current year.

Husband and I alternated years so I did 2019 and my daughter and I were here for 38 days that year.

pfft missed AOS.  CR/IR is so much simpler LOL

Same return, filed by mail, with a declaration letter then would suffice.

So I can still do Turbo Tax and add the letter even though I know I am non-resident?
